Revdex.com: I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # [redacted] Please add your rejection comments belowTo whom it may concern:We at [redacted] have dealt with Axion for some years An Axion sales rep, [redacted] ***, approached usregarding upgrading our copier prior to the end of the lease due to a deal theyhad going on with a newer model Therewas some back and forth negotiations with [redacted] over our needs and we finallycame to an agreement on a new lease price for two (2) machines The agreed upon price and quote we receivedfrom [redacted] and Axion was for a totalamount of $per month On September26, both [redacted] AND [redacted] , VP of Sales & Marketing visitedour office to go over the contract and agreed upon price The contract was then signed as of that datefor the amount of $235/month Shortly afterthat we began to receive a separate bill for $49/month for maintenance whichshould have been included according to the quote from Axion and discussed withboth [redacted] and [redacted] prior to signing It appears as though Axion is now trying touse a former employee as a scapegoat saying they were unauthorized to make sucha deal However, their VP of Sales &Marketing also sat here in our office to discuss the contract and at no timeraised any concern as to the amount in question Having done business with Axion in the pastwe had no reason to believe that one of their sales reps would be unauthorizedto negotiate a new lease deal Furthermore,having their VP of Sales and Marketing sitting in our office and going throughthe lease deal would lead one to believe the agreed upon lease amount wasaccurate [redacted] has relied on to its detriment the actions of both [redacted] and [redacted] and should not be held accountable for Axionsfailure to ensure its employees acted within the scope of their employment Regards, [redacted]

Back in May Mr [redacted] requested to cancel his service contract with Axion, while per the terms and conditions we do require a day written notice of cancellation as a courtesy to him we credited off all open service and maintenance agreementsRegarding the fraudulent check this is not accurate, [redacted] called in a check by phone payment that came back from the bank as unable to locate account- which may have been an issue with an incorrectly given account number and a $returned fee was accessed, since we were unable to confirm whose error it was regarding the account number we also waived the returned fee.As the two most recent invoices for supplies back in November were sent and billed this was an error on our part, I did confirm with [redacted] that the shipments were in facet refused and sent back to sender ( Axion) as of the account has been credited and and closed and at this time the account is at a $( zero) balance,

I did make an offer even though I believe we did nothing wrongThe first offer was made by an unauthorized service employeeA VP services employee was sent over to them with a 2nd offer to check situationAs a gesture of goodwill, I will give them a case of paperWe will be able to resolve this

We have never stated that the sales rep (*** ***) is anofficer of the company. However, thesales rep is most certainly an agent of the company who by his actions has theimplied actual authority to bind his company in contract. With that being said, the timeline of eventsin Axion’s response is completely inaccurate. It was not the VP of Sales, *** ***, who noticed the numbers beingout of whack prior to the execution of the contract. In fact, it was our Office Manager, ***, who questioned Axion on why we were receiving two separate invoices AFTER the contract had beensigned. There was never a conversationabout numbers being off, nor did *** *** visit our office to discuss thismatter prior to his one and only visit confirming the terms we received on thecontract It was only after The VisperGroup notified Axion of the discrepancy did they contact us to see how we canresolve the issue. Instead of offeringto honor the contract, their solution was to give us a box of paper to make upthe difference. We are asking Axion tohonor the contract both sides bargained for, and if they feel they cannot, thento terminate the agreement. Again, TheVisper Group should not be held accountable for Axions failure to ensure itsemployees acted within the scope of their employment. The Visper Group has copies of all emailcorrespondence with *** *** which shows that Axion never “fixed it” priorto the execution of the contract, rather it shows the discreancy was brought totheir attention after the fact

The customer for some reason keeps leaving out the most critical component of the investigation. The sales rep, all sales reps of our company, are in no way, shape, or form Officers of the company. The sales rep at the time *** ***, only provided a quote, that was given to the customer, and a copy to the VP of Sales, *** ***. When my VP reviewed the final numbers he noticed that service was given away free in the paymentThat would have resulted in a loss for the companyHowever *** *** did not want a new sales rep at the time to go back and explain this, instead he went out himself, as to not upset the customerThen went on to explain that the ma contact for the $is a separate invoice/charge, and in fact could not be included in the lease as we would lose moneyI believe that in this case the customer is being unreasonable and taking it out on a rookie sales person, who made a mistake, and then we fixed it. In closing , I also had my General Manager go to the customers office to try and offer them something to make them happy, they were not interestedAs we hate to have even a single customer upset or not happy with my company so that is whyon occcasions we tried to resolve
