Non delivery of service for building a garage.
In November of 2016, I paid *** $3,000 to build a garage. He asked for a down payment to get priority when I was ready to build. I have reached out several times over the last 2 years to see when he was going to start building. There was a couple of times he came over but never started building. There were several excuses as to why he couldn't build. I ended up asking for my money back in March of 2017 and he said he couldn't because it was to build the garage. I then asked when he would be able to start and he said it would be a couple of weeks. I gave him another chance since I needed the garage built. A couple of weeks passed I hadn't heard anything so I reached out to see if he could start asap since I had paid the $3K down payment to get priority on my building before he took any other jobs. He said it would be a couple of weeks because he had some roofs to finish up. In October of 2017, he still hadn't built the garage so I needed some other work done in the house and asked him to give me a bid. He said he would stop over but never did. There were several times I texted *** to remind him of my $3K cash that he had with out any rendered service. He would consistently say that it would be a couple of weeks & he would stop by. He never did and consistently had an excuse that he was busy on another job every time I texted & called him. I am seeking for my $3K cash to be returned to me, as it has been 2 years since I have paid him and no services have been rendered.

Desired Outcome

I am looking for $3,000(deposit I paid) plus $150 in accumulated interest.

We were given a down payment of 3000 to build a garage. After reviewing the pad that they had built by a different company after having multiple hours into figuring out what we were going to do and multiple times talking with the city inspector saying he would not build on that pad unless it was fixed or replaced. It took them over a year to say they fixed the pad. Than they talked about me just building part of it and so forth and I told them there is no refunds on deposits from original deal. I am willing to work with them as much as I can on on anything that can be done. And I have a bunch of time figuring out what to do on the concrete pad with multiple people and the city. There was multiple problems with this building from day on from trusses to concrete pad. And now she wants me to fix a retaining wall which I am willing to do but it is a massive wall that will be additional cost. And I am really busy at the moment but I am willing to do what I can but there will be additional cost.

We had Klinger employees, along with the company who laid the pad disagree with the measurements that were taken by *** saying that the pad was sloped. *** said the pad was sloped by 2 inches and the other companies shot the pad at 3/8th's of an inch. Because of the disagreement between all parties, I took the garage blueprint with ***'s measurements on the slab to Bacon Creek Engineering and paid an extra $250 for an approval to move forward with applying mortar below a ground plate to flush any uneven areas, as it's common for pads to NOT be flush. I informed *** that I wanted him to set the ground plate w/ mortar & proceed. He said he wasn't comfortable with building that way & would need to have a brick wall built in order to proceed. So I contacted another company to build a 2 foot brick wall for another $700 on top of the pad cost. In March of 2017, I told *** the block wall was up & asked him when he would be able to start. He said it would be a couple of weeks as he was working on roofs. After a couple of weeks, no show & no text. I text *** & asked for my deposit back, he refused. My husband then built the garage. To get my $3K back, I asked *** to bid my kitchen in December of 2017. He said he could and would be over, but he was a no show. I then asked him to bid my retaining wall, again he said he would come over & was a no show. I had significant additional costs incurred due to ruined materials, engineering and trips to inspections. I'm asking for my $3K deposit and interest.

The 1st time I had requested my deposit back would have avoided where I am at now. I asked for my deposit back because of your repeated no-show and continuous excuses why my garage could not be built. If you could NOT build my garage, I was entitled to my deposit back at the very least. Instead, I tried to accommodate your requests including hiring the engineer to provide alternative methods to building directly on the pad. That still wasn't sufficient, so I hired out a block wall as we had discussed to build on. After the block wall was finished, you indicated you would start, which never happened. I paid an extra $950 including the engineer and wall alone, because of YOUR unwillingness to build. After those 2 items were done, you were no longer able to contest anything from a building standpoint. Instead, you became a no show and did not deliver on the contract of which I made a deposit for.

I decided to not give you your deposit back cuz I have close to $2,500 invested in that place in time in time messing around with that pad. And then you wanted to change it to just build *** with no rough no windows no doors no sighting you were going to take care of that that was outside of your verbal contract with me so that was the reason why I decided no refund on your deposit and I'll give you five hundred bucks but that would be it
