B&B Contracting came with the block layer(*** ***) B&B was toshow up according to Mr*** on 12-1-and he did not showMr.*** showed but B&B did notThen B&B was to show up 12-2-andthen stated he would be here on the 12-5-and once again was a noshowB&B brought their equipment on 12-7-and dug for hour (3pm to4pm), then he did not return until Thursday 12-10-at 9am to 10:30amwhen his equipment broke he worked on it and the left at 11am andreturned at 2pmIt is not the costumers responsibility to be charged for upkeep to his equipment It was not our fault his bucket supposely brokeHereturned at 2pm and left at about 3:30pm.Mr*** and myself were in the ditch preping, all Mr***e did wasdigThere was no old footer, it was tile blocks and they were used as filland buriedThe old cement floor I did with a sledge hammer and crow barand that was also used for fillI never asked anyone to remove any thingfrom site it was all to be used for fill and to my knowledge it was.Because of his equipment here and Mr***e not showing up, I contcteda different digger but they couldn’t come cause of Mr***e’s equipmentbeing here.I do have other witness and I can provide additional information if neededI respectfully would pay the $that I feel he is owed, that is hours ofdigging and hour transportof machineI do not feel I should pay forservices not rendered

When the work was to begin on the garage I took the first 2 weeks of deerseason off. (from 11-30-15 to 12-13-15) I was present while Mr. [redacted]and Mr. [redacted] were here. I was physically at the house since I helped Mr.[redacted] with preparing the footer for the cement to be poured.I have no issues paying for the time Mr. [redacted] was here, but Mr. [redacted]was not her digging for 11 hours or 2 full days.As you can see according to the 1st invoice sent Mr. [redacted] stated heremoved the old block and disposed of all block and footings. The floor wassmashed by hand and all material was buried. The orange tile was in theold garage and as you can see in the photo’s it is here. (If you want I canalso dig a hole and show were all cement was also used as fill.) Mr. [redacted]did not itemize the bill and the amount was not adding up to what Mr.[redacted] stated he charged per hour of $70.00. I had texted Mr. [redacted] on1-14-16 at 12:59 pm that text is saved and I can get a copy from verizon ifneeded. Then a 2nd invoice came and he added the breakdown of the cost.I had no contract with Mr. [redacted].Also I have enclosed the reciept of paying Mr. [redacted] and his total laborwas $1,140.00. Mr. [redacted] had far more time then Mr. [redacted]. With all dorespect I helped Mr. [redacted] all Mr. [redacted] did was dig.1He was to dig a ditch from the garage to the house, as you can see from thepictures that was not completed. Mr. [redacted] did not come to backfill.I also told Mr. [redacted] that I was not the property owner and Mr. [redacted]was present.Mr. [redacted] had blocked the ally and as you can see the neighbors are close.If you would like numbers to talk with them I can get them. They alsostated I was here helping Mr. [redacted] and that Mr. [redacted] was not here 11hours.The one photo by the shed I shoveled and filled in.Mr. [redacted] was here daily (expect a few do to prior plans) I helped withcarrying block and mixing mud. I was in the ditch helping Mr. [redacted] prep itfor the cement.This is the 2 weeks and Mr. [redacted] was to start digging on 12-1-15 and Mr.[redacted] was here and so was I.12-1-15 B&B was to start digging no show12-2-15 B&B no show raining12-3-15 B&B no show12-4-15 no digging Mr. [redacted] had appointment12-5-15 Mr. [redacted] was to come on a Saturday, Mr. [redacted] showed andB&B did not. Mr. [redacted] stated he took his wife shopping.12-7-15 B&B showed at 3pm and left at 4pm total digging 1 hour12-8-16 B&8 no show, Mr. [redacted] was trying to get other excuvator to digso he could complete his job of the block laying.12-9-16 B&B showed about 9am and at 10:30am is bucket broke and hetried to fix it from 10:30am to 11am and could not. (My wife leaves for2work at 9am and Mr. [redacted] had just came) Mr. Tassin left at 11am and didnot return until 2pm and was gone at approxmently 3:33pm. (linda camehome from work and needed in ally Mr. [redacted] moved then loaded up hisequipment and left)I got a letter from his attorney stating the amount owed and this wasactually disputed back in the text I sent him. Then on 3-25-16 my wiferecieved the letter of a mechanical lien if she did not pay it. She did pay the$960.00 that was owed according to first bill, as to she had nothing to dowith this. I also believe where she gets her yard is destoryed is because ofhow it was left. I believe you will also see that in the pictures.This was between Mr. [redacted] and I, he was the one that involved my wife.I have enclosed photos, copy of the bills, and letters from attorney[redacted],and the paid reciept for the block layer. If you need any furtherinformation, photo’s, names and numbers of neighbors, then I will getthem.This is about honesty, I’m willing to pay for services rendered but not forwhat I did not receive.

Please note that the above customers submitted a prior complaint relative to the same matter onFebruary 24, 2016 (see Revdex.com ID# [redacted]). Attached to this response is B & B Contracting’s priorresponse which I respectfully request to be incorporated as part of this answer.In addition to our prior response, I will note the following:1. The customer alleges that B & B Contracting was not hired or told it could be on the property.This is strictly denied as evidenced by the customer’s initial complaint where Mr. Carlsonacknowledged that B & B Contracting “was to do digging for garage”. I will further note that overthe course of two days and multiple hours, the customer knew and allowed B & B Contracting toperform work. Any allegation that such services were performed illegally and destructively isfalse and potentially defamatory.2. As of the date of the second complaint, the customer was not the legal title holder to theproperty situated at [redacted] (See Elk County Record Book 544 at Page 523).Pursuant to Pennsylvania law, a contractor may seek a mechanic’s lien claim against realproperty due to unpaid services. A notice of B & B Contracting’s intention to do so was mailed tothe title holders of the subject property and the same was unchallenged. It should also be notedthat B & B Contracted accepted less than the customer’s outstanding invoice.I would be happy to supply you with any additional information requested.Sincerely,[redacted]Owner of B & B Contracting

Review: This contractor came and was to do digging for garage. He sent a bill for a total of 11 hours. He was here for 3 and 1/2 hours that he worked. He was all ways on phone. He charged for removing old footer, which we did with a sledge hammer, so he is not being very professional by trying to charge for a service he did not do. Plus disposal of blocks and cement that was used for fill and still here. I have several witness that can verify all this, and a business should be honest and not charge for services not rendered, I also have the bill to prove what he is trying to charge for.Desired Settlement: I will pay the amount of 70.00 per hour for the 3 1/2 hours of service I received.
