I asked for a meeting with Mr*** or a written response from Lennar to find out why it takes longer than year to get things covered by warranty to be fixed or replaced I want to have this meeting so that Mr*** as a Lennar representative can find out what is the breakdown in the system and correct it so others do not have to go through all the trouble that I went through. As things are now, I would not recommend a Lennar home to any of my friends or relatives.*** ***

because: This is NOT the solution that I am looking for The dirt is supposed to go UNDER my grass not ON TOP of my grassThe reason why my grass is not growing like they should is there no soil underneathThe ground is complete clay and so the grass couldn't root due to lack of oxygen and nutrientsThe solution I am looking for is: all current grass needs to be ripped out, a thick layer of soil needs to be put in, then new grass can go on top of the soilThat is the only solution for the problems.

Lennars stance will continue to be that we installed 4" of topsoil prior to installing the sod like we do on all homes. The home owner signed a landscape acceptance form prior to closing saying that they accept the landscape in current condition. We've made an attempt to go above and help the home owner by offering to topsdress the yard. No further action will be taken by Lennar

To whom it may concern:Thank you for contacting Lennar about Mr***'s concerns with the height variance on the front porch arch Lennar takes its responsibility to its homeowners very seriously, and our devotion to our homeowners extends beyond merely constructing and selling them their homes It is with this commitment in mind that we respond to Mr***'s demand for cash remuneration in lieu of a fix already offered by Lennar.Mr***'s complaint is that the arch was constructed six (6) inches lower than indicated on his initial plan Mr*** contractually agreed to potential variances between the Home plan and actual construction Two parts of Paragraph of Mr***'s Purchase and Sale Agreement is instructive in this regard:" Seller's Absolute Right to Make Modifications to Plans and Specifications Seller has the absolute right to make modifications to the plans and specifications for the Home Without limiting the generality of the foregoing, Buyer specifically agrees that changes in the dimensions of rooms and patios, entrances and terraces, if applicable, and changes in room size, in the locations of windows, doors, walls, partitions...may be made by Seller in its sole discretion Such changes may also include but are not limited to, changes...in the building location, setbacks, and facing, the building's external configuration, its structural components, its finishes and the landscaping associated therewith."; and" No Warranty for Plans and Specifications on File ...[I]n the event of any conflict between the actual construction of the Home and/or the Community, and that which is set forth on the plans and specifications, Buyer agrees that the actual construction shall prevail and to accept the Home and Community as actually constructed (in lieu of what is set forth on the plans and specifications)."Lennar must respectfully reject Mr***'s demand for cash damages As previously discussed, despite the fact that it has no contractual obligation to do so, Lennar remains willing to resolve this issue by professionally removing the existing masonry, raising the arch by six (6) inches, and then professionally reinstalling the masonryOnce we have all the materials needed to make this repair it would take week to complete, weather pending This is not a structural modification and will be performed at no cost to Mr*** Further, the offered modification will not require the homeowners to be displaced from their home during the process.Thank you again for helping the parties reach a mutually agreeable resolution Hopefully, the foregoing offer will be acceptable to Mr*** Should you have any questions or wish to discuss the matter further, please feel free to contact me at your convenience We welcome and appreciate all feedback from our homeowners and the Revdex.com, as we work to provide the best home ownership experience possible

Response to Revdex.com Concern Sola Vista October 4, 2017 Issue 1: “Travis Country discovered Lennar took shortcuts when installing roads in the subdivision.” Response: The roads in Sola Vista were designed and constructed to Travis County standardsNo shortcuts were taken. Issue 2: "red tagged" at least one of their homes until the issue was resolved.” Response: A drainage issue was discovered during construction of a home and the county did “red tag” a homeowner’s septic permit and pool permit until the issue is resolved. Lennar is working on correcting that issue so the red-tag can be removed. Issue 3: “Part of the "resolution" including completely digging through our front yard, including our landscaping and driveway.” Response: There is no work “completely digging” through or on any private propertyAll work is being done in the Travis County public right of way or in public utility easements. Issue 4: “Lennar had agreed via a verbal face to face meeting on 9/to help me with full reimbursement to replace the landscape.” Response: Mr*** is not authorized to make such agreement without management approval. The contractor is negotiating with the County to either replace the noncompliant landscaping within the ROW with Travis County-approved material or reimburse the homeowner the cost of replacing the landscaping. The county will not allow an exact replacement as it does not meet county standards. Issue 5: “hold a deposit from their contractor doing the work in the event our $10,of front-yard fencing gets damaged.” Response: The homeowner was told that Lennar would need to discuss this with management before such an agreement could be made. Management determined that is the contractor who is contractually responsible for damage during construction. The contractor has already covered the fence in OSB to protect it during construction and appears to be diligent in their efforts to avoid further damage. Issue 6: “I received communication two days ago from *** *** [Lennar Representative] that Lennar no longer is honoring their verbal agreement and instead is forcing me to work with their selected contractor exclusively and is "staying out" of it, even though this entire problem was caused by their negligence in installation of the development.” Response: The contractor on the project, not Lennar, is to be the point person managing the construction work. The homeowner has contact information for the contractor’s owner and project manager and has been in constant (multiple times daily, it appears) contact with bothAs stated above there was no final agreement, just a discussion. Lennar does not believe there was “negligence during installation of the development”. Lennar is not “staying out” but is monitoring the contractor, receiving periodic updates on construction progress and making onsite inspections. Issue 7: “issue a check for replacement landscaping to me, be the primary point of contact for any issues as well as abide by the original agreement to hold a deposit in our name should damage occur to our fencing.” Page of 2 Response: The contractor will negotiate with the homeowner to replace damaged landscaping with a county-approved material or reimburse the homeowner so he may reinstall at his own risk. Issue 8: “Their contractor’s negligence has already caused them to cut through my internet service line and the project hasn't even started yetI don't have high hopes their contractor can do the job appropriately, nor reimburse me properly for damage done to my property during construction.” Response: The contractor took the necessary precautions to locate any underground improvements within the county right of way. Unfortunately, despite those precautions, the fiber optic cable to the homeowner’s house was damaged during installation of erosion controls

The warranty on the roof is a 2-year warranty based on when the home closed. The home closed on 05/24/2007; therefore, the roof warranty expired on 05/24/At this time, Mr*** roof has been out of warranty for years & months.The first roof issue reported to Lennar for this
home was in March (nearly years after the roof warranty had expired) when shingles blew off the roof during very heavy winds. The problem was caused by the very high winds; it was not an installation issue. The current issues with the roof are not warranted by Lennar

Hello, We have spoken with homeowner and have notified them that their fence is encroaching on the county right away and was also not approved by the county, homeowner has been asked to move their fence on behalf of the countyFence was built by homeowner after they closed the home with
LennarThe homeowner also upgraded their own landscaping which was also not approved by the county, which is why they are being asked to get rid of it as wellLennar has agreed to help with the landscaping by adding rocks which is what the homeowner wants, Lennar will not be paying the $6,or the $10,for the fence because that is a fence that the homeowner put up that was not approved by the countyPlease let me know if you have any questions or concerns Thank you, *** ***

The Landscaping company did not have time to schedule last Week and it is supposed to be installed this Week.The Area Manager [redacted], said he left a message that it would be schedule for this Week.Your doors are on order and paint on window sills and shelves will be re-painted. The Customer Care Rep., [redacted] will be setting that up with the homeowner.

I am rejecting this response because:1. Fence is 100% approved by Lennar/[redacted] and you can even check with the county, there is a variance on file to this effect so your information is totally incorrect.2. I'm not asking to pay to replace it, I want a deposit assurance should it be damaged during construction. In speaking to Travis County Lennar has not followed the rules in this development, and I don't trust they will replace the fence should it be damaged. This complaint serves as record that Lennar is responsible for any damage to approved fencing during construction which is currently in progress.3. Lennar is solely responsible for the need to dig in the right of way, and should replace landscaping. Do they prefer the community to look like trash with weeds and their unapproved drainage material (which is why Travis County is not approving the final on their roads)? Our landscaping added value to the home and much nicer than anything Lennar provided. I expect it to be replaced with equivalent approved hardscape - Brazos rock (which was there), landscape fabric (which was there) , plants (existing) and repair existing sprinklers - it's not my fault Lennar tried to defraud Travis County in this subdivision and got caught in the process. They need to take care of their customers or this will become a huge PR problem and I will take this as far as it needs to go to make sure we are taken care of.

I am rejecting this response because, the work done by Lennar was substandard.  The roof is leaking due to substandard work and not the age of the roof.  the poor workmanship was know by Lennar's roofing contractor, because they attempted to seal up the improperly installed flashing using window caulk.  Of course this caulking being exposed to the sun dried out over time and then the roof began leaking.  It was obviously a very slow leak which was not visible from inside the garage.  However, when I removed some items from my garage shelving I then noticed the sheetrock was wet and stained.  When I went up into my garage attic I found the roof leak.  It was coming from the aforementioned poorly installed flashing.  The roof decking was; wet, rotten and moldy.  the mold is a clear indication that this leak has been occurring over time.  Since mold requires the elements of dark wet spaces to grow this is also evidence that this leak extends back to the original construction or within a short time of construction completion which would have fallen in the warranty period.I apologize for my delayed response to Lennar's response, but I was out of country attending to business and missed the stated timeline.

We installed 4" of topsoil prior to installing the landscape like we do on all homes. We met home owner onsite this week and agreed to do as a courtesy a one time top dressing of yard. We explained after that it would be up to home owner to maintain.

To whom it may concern,Lennar has been in contact with the homeowner and is installing  a French drain for the drainage issue. Also, Installing new doors and using a different paint for the shelves and window sills.Thank you.
