Mr*** contacted Finishing touch via phone to request an estimate for labor only on a project athis home in Jefferson NYContractor went to the site and looked the property and measured itto give the appropriate quote for work requested, which was a deck, a concrete pad and windowand door.The
customer requested labor price on deck dimension listed in attached contractAlthough property owners ultimately bear the legal responsibility for obtaining the correct permits their requested work the contractor also further included that as customer responsibility in thecontract.Per contract customer is responsible for all materials, except concrete per contract-Contract was signed on July 8, but the initial deposit payment was not received for daysafter the signing, in which time the contractor had to travel to meet the customer at a locationclose to NYC, hours from job site(see pic 142)90% of all framing materials that the customer purchased were incorrect and had to be returned,and new materials were orderedIn return, the contractor spent hours total fixing the customers incorrect purchases and returns made by the customer on the weekend(See attachedhome depot files)Slab was poured over a solid rock area and was told to customer stone was not needed(See pic158/159)Upon finishing the deck footing customer decided to change the dimension of the deck he also wanted to put a hot tub on the deck which changed the decks framing thickness (see pic147/148)Sono tubes for frame at this point were already poured and had to be decreased inheight to allow for a framing member be located under the deck as opposed to on topThis caused delays which also included removing dirt to allow for proper drainageCustomer also added on under deck rain gutters (pic 185), retaining walls (pic 292), and electric services (pic288) from the house to the garage, and tone color of concreteOther changes included designchanges as the project commenced (pic and 217) All of which were added above and beyondthe original scope of workCustomer also requested retaining walls all to be back filled with dirtfrom site, which is why he is having mud issues per his complaint (see pic 172)During the construction multiple changes were made and finishing touch did its best to accommodate the changes without any issuesOriginal request was to outline the deck with two boards and stagger the interior boards like any deckCustomer wanted to build as you gowhich added countless man hours to accommodate this request.Code officer set foot on the site on or about Friday Sept He handed customer a stopwork order and requested that a permit filed for all work being completedIn a text customertold contractor that he was "right" implying that he should have gotten a permit at the start of thisproject(See Pic 198/199)Customer requested work to be complete on OCT (See pic 348/)During that week(Monday/Tuesday) we cut two vertical slits in wall to accommodate window and door install.Two vertical slits were cut as they do not jeopardize any framing of the house(WE have acertified NYS structure engineer to approve this statement) During cutting the saw had amalfunction and needed to be replacedWe contacted the rental company where we rented themachine and were told they would repair the tool and let us rent it another day without anyfurther costDue to the delay and the two slits in the walls we spray foamed the holes toprevent any draft and or rodents from entering the homeAt no time during this were we told tostop work or questioned on the work performedThe code enforcement officer showed up onsite during the week and informed us the customer had not procured a permit for the windowworkIt was assumed as the customer signed a contract with the scope of work he would havereceived a permit for all work requestedHe did not- Again it was the customer's responsibilityto acquire thisThe customer was continuously late with progress payments and has not paid the most recentpayment, and refused to pay until the end(see pic 365) The contractor stopped work when thecustomer refused to pay the next progress payment and acquire the correct permits andpaperwork to continueTo date the customer owes contractor $for work to date completed,including hours put forward for his contracted obligations.Please read all attached messages via text, contracts, estimates, and attachmentsNone of theinformation has been altered or changed and is strictly pictured as it was sent and or received.Finishing touch has gone above and beyond to make this customer happyWe have includedlabor for items without costYet Mr *** continues to try to over extend his free rideAnexample of this is, there were a couple of pallets of landscaping blocks left over and he asked usto continue to lay wall above and beyond the agreement at no cost to himAnother example ispermits and paperwork to commence this projectWe have exhausted all means of workingwith this customer shy of giving him this jobHe is requesting full refund for a project that is90% completePlease feel free to visit the site and or look at photographs attached to this letter via disk.Thank you for your time in this matter,VIR Bjorn ***Finishing Touch
