(“B&L”)My client has provided me with a copy of the letter that it received from your office? dated January 17, A copy of the letter is enclosed herewith for your referencePlease? allow this correspondence to serve a response to that letter.I would like to provide an account of what actually occurred with respect to the? complainant (the “Customer”) and B<he Customer contacted B&L in the beginning of? January, 2018, complaining that his heating ventilation and air conditioning unit (the “Unit”)? needed to be re-charged with refrigerantOver the phone, the Customer was provided with a? quote from a B&L sales representative indicating that to do so would cost the Customer? ? approximately $for the refrigerant, and $for a diagnostic feeThe Customer? agreed, and asked for a technician to be sent to his home.On January 5, 2018, a technician went to the customer's home to service the UnitWhen? the technician arrived, he discovered that the Unit needed more than just refrigerant, and that? there were other issues with the Unit that needed to be addressedThe technician informed the? Customer of this, and explained that the necessary repairs would cost $2,The Customer? agreed to the price, and allowed the technician to perform the workIn fact, the Customer even? signed an invoice evidencing the change in the scope of work, and the change in the priceA? true and correct copy of the invoice is enclosed herewith (with the customer’s name and addressredacted for privacy purposes).? After the repairs were performed, the Customer paid the technician the agreed-upon price? of $2,with a credit cardShortly thereafter, the Customer stopped payment on the credit? card, and B&L received a letter from the customers credit card company indicating that the? Customer was disputing the chargeUpon receipt of the letter, a representative of B&L? contacted the Customer to find out why he was disputing the chargeThe Customer informed the representative that he got a quote from another company for an amount less than what B&L? charged him for the same work (the “Quote”)As such, the representative informed the? Customer that if the Customer provided B&L with the Quote, B&L would honor the Quote and? allow the Customer to pay B&L the amount contained in the QuoteThe Customer refused to? ? accept B&L’s offerSubsequently, B&L received the enclosed letter from your of?ce regarding? the customer’s complaint.B&L’s position is that the work that was performed by B&L and the price for that work? was agreed to by the customer, which is evidenced by his signature on the enclosed invoice.? Because B&L takes pride in their Customer service and reputation, when B&L discovered that? the Customer was unhappy, B&L offered the Customer a price discount based upon the QuoteThe Customer refused to accept this offer, and instead has paid nothing for the work that B&L performedThe Customer has not complained about the work performed -? only the fact that he is being asked to pay for it.As such, the complaint against B&L is baseless and should be disregarded by your office.? ? B&L also requests that the complaint is not posted on your office’s website as it is without merit.? ?
