Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below "Obviously we have several issues to address here Sadly, this was the responseThe tow capacity of my vehicle has absolutely nothing to do with the issues hereAll we are trying to achieve is to get our new boat repaired so it resembles a new boatThe boat is damaged, it looks usedIt doesn’t perform close to what is publishedYamaha Marine agreesMaybe Marine Center (MCI) received the boat damaged, I don’t knowBut that doesn’t change the facts hereNo sense in straying off topic We paid for a new boat and warranty, and until we filed this complaint, we had no warranty or response at all It’s ridiculous we have to try this hard to get warranty issues addressedAnd, many of the responses from MCI are simply not trueI’ll gladly provide numerous email messages and communications with the staff at MCI and StingrayWe submitted the messages for review prior to sending letters via certified mail Here’s the first of the incorrect responses from MCIThe 195RX model is the inboard/outboard version of the 191RX outboard An RX model is a stripped down version of the LX It is not the next size boat, which is incorrect We went to Marine Center of Indiana (MCI) to see the newly released 188LE and also saw the leftover 195RX with the 3.0L engine in their showroomThe 188LE was too small and the 191RX was to plain and we didn’t like itYes we could pull it, but we didn’t like the boatApparently, it’s still for sale there The 195rx also has a little less room in it than the 191LX due to the dimensional differences between an I/O and an outboardThat can all be verified with StingrayAdditionally, the 195RX does not outperform the 191LX, which can be verified by Stingray, Yamaha and Mercury in published marine testsIf those tests are incorrect and the series doesn’t perform even close to what is published and documented as mine doesn’t, then there is another, bigger issue here tooOur boat ventilates very easy no matter how it's trimmed "Marine Center unfortunately did The statement about Marine Center finding "the boat" I had my mind set on is not correct tooYes, I knew of that boat, as well as four other 191LX’s located within similar distance at that timeI had inquired about all of themThree had trailers I wasn't comfortable withI’ll gladly send the contact names (and email messages) from those dealers too [redacted] found this boat when he searched for a dealer trade through Stingray, he also stated that the other dealer could trade with him because they did similar sales volumeHe had no idea I knew this boat existed when he called me on March 13th telling me he had found a new 191LX That is when I told him I wasn’t interested in that boat due to the trailer it was onI wanted a trailer with brakes and a swing tongueI was afraid of pulling approximately lbswithout brakesI also couldn't store the boat without the swing tongueThat was all part of the dealHe then told me he could get that boat and put it on a new Phoenix trailerThat's when I decided to move forward with the purchase "Marine Center always requires Marine Center requested that we pay in full at the time of purchase, so they could then purchase the boat from the other dealer and get it sent to the factory where it would be detailed and have the ski pole installed, then shrink wrapped and sent to MCI on the next shipment which we were told was to be within 3-weeks The boat was delivered to Harrison Ohio where I met the driver in [redacted] lot, not my residence [redacted] offered delivery to us at the start since we have a mutual friendHe was originally going to deliver it to that place of businessThe statement about me trying to buy the boat at the Cincinnati Boat show is far from the truthThat is when my wife and I first started to look for a boatAt that time, [redacted] was eager to sell us a boat they had at the show or the new 188LE that wasn't released by Stingray yetIn fact, after the show he sent me some pre-published literature from Stingray about the 188LE at that timeHe asked me not to share the information because it was not supposed to be public(I have the emails) We never made any decision to purchase a boat until March 13thWe didn't visit MCI until they had the 188LE on the showroom floorHis statement is about the boat show, waiting, is not true The statement about delivery is not true either [redacted] told us that once we paid, our boat would arrive in about 3-weeksCheck your messages "Marine Center transported I asked the driver ( [redacted] brother who lives somewhere in the Cinti area) why the boat was delivered without the cushions inHe said that the cushions would blow out if he trailed it with them inReally? I came to find out it was because the rear cushions wouldn’t fit into the holding sockets which should secure them, yet another problem with this boatI can't imagine removing seat cushions in a boat while trailing it in the rainIs that so the storage compartments and underfloor can get soaked? Really? I seriously doubt that's a Stingray standard? And, by the way, the boat has bow and cockpit covers which could have easily been snapped onYes the boat was soaked; it took days to dry it outIt was very soaked under the front storage and underfloor areasYes the boat was very dirty too, I spent hours cleaning it the first afternoonMaybe it was wet because it came through the heavy storms that went through this portion of the country as it shipped to MCI the previous dayAnd, the boat was only at MCI for less than hoursThe mechanic I spoke to at MCI when I called the first time on May 16th with a question stated the boat did a very quick in and out of MCI's shopHe called it the boat with the grey motor Another series of statements The boat was to be transported to MCI on a shipment from the Stingray factoryThe boat was to be taken from the dealer in S.Cafter we purchased it, sent to the factory, detailed, factory ski tow pole installed, all per [redacted] and [redacted] The boat was still on the floor at the dealer in S.C in MayI spoke with the dealer in SCThat is easily confirmed MCI was providing a Phoenix trailer with brakes and a swing tongue all alongThat is all documented in the first of the three non-matching Bill of Sales in MarchIt’s listed right thereSaying otherwise is also not trueThe trailer the boat was on in S.Cwas one reason why I never purchased that particular boat from that dealer in S.C So, if I understand what MCI has stated correctly, MCI never intended to send the boat the factory like we were promised by [redacted] and [redacted] "As far as boat trailer tire So, I guess that "only emails" with issues aren't enough Seems like it should be Certified mail to ***, [redacted] and [redacted] from my attorney wasn’t eitherI also corresponded with [redacted] at Stingray Boats multiple times about the issues when MCI didn’t respondCheck with your staff membersI also contacted Phoenix trailers about the tires and they said that the tires where what is provided with that particular trailer modelHowever, the gentleman at Phoenix recommended to me that I replace them with better radial type tiresSo I did instead of taking on yet another issue By the way, the cheap original tires have PSI stamped right on the side of themThey're sitting in my garageI’ll gladly send a photoThe mechanic at MCI probably assumed the tires were of good standard quality and didn’t need to check the sidewall "Mr [redacted] is I asked for my money back, but [redacted] said he would have to work out the some difference for the cost of the trailer, so we wouldn’t get all of our money backRegardless, I decided once more to trust them and wait for the boat, because that's all we've tried to buy from the startThe statement about the reducing the cost of the ski tow bar is not correct, if it was, why haven’t we received the money back from the original sale? And, by the way, I guess the company who installed the ski pole forgot to remove their company sticker, definitely not a stingray ski poleAgain, I’ll gladly send a photoIt was supposed to be installed at the factory That was agreed upon when we bought the boatAlso, [redacted] stated he would credit us the cost of the covers back in April, that hasn't happened yet either? Months have gone by without any response until this complaint was filedAll we're wanting is what we purchased, an undamaged, new boat that runs properly [redacted]

Obviously we have several issues to address here. Mr. [redacted] 's main concern on his boat purchase was the ability to meet tow restrictions with his vehicle. Marine Center attempted to convince Mr. [redacted] into upgrading to the next size model boat (195 RX), that we had in stock, that was just 200 pounds heavier than the boat he was interested in knowing it was a better option. Marine Center unfortunately did not stock the boat (191 LX) that Mr. [redacted] already had his mind set on. Marine Center then contacted Stingray Boats to arrange a dealer trade that Mr. [redacted] had found online from a South Carolina boat dealership that had this particular model boat in stock. Marine Center always requires a substantial deposit on a special ordered boat, so we are not stuck with a model boat that is difficult to sell. At this point Mr. [redacted] decided to pay for his ordered boat in full up front Marine Center never demanded that Mr. [redacted] pay for his boat in full. Mr. [redacted] is correct in saying that the boat was officially purchased on March 15th 2014. The boat was delivered to Mr. [redacted] at his residence in Cincinnati Ohio on May 16th 2014. Mr. [redacted] started trying to buy the boat from us at the Cincinnati Boat Show which ended January 17th, 2014. He then came to the dealership much later, and then took weeks to make a decision. He did not agree to make the purchase until March le, 2014. This was two months later. Had Mr. [redacted] made a purchase sooner he would have been guaranteed to receive his boat much sooner rather than later in the prime of a very busy boating season. Marine Center transported Mr. [redacted] 's boat to his personnel residence in Cincinnati Ohio due to Stingray's delay, because Mr. [redacted] did not have time to come to our facility. On the way to Cincinnati, unfortunately it did drizzle slightly causing Mr. [redacted] 's boat to get wet Prior to transport all cushions and covers were removed as to not get damaged in transport When transport driver met Mr. [redacted] , cushions and covers were transferred directly into Mr. [redacted] 's minivan. Our transport driver assured us that Mr. [redacted] 's boat was not soaking wet as he has claimed. Stingray Boat company was to transport the boat to us via the South Carolina boat dealer on the next load of production boats heading to our facility as to keep transport costs down. Marine Center had to order Mr. [redacted] a new trailer from our trailer manufacturer Phoenix trailers. Due to Stingray Boats production delays, Marine Center offered to pick up Mr. [redacted] 's boat from the South Carolina dealer on his trailer that we received in, but Mr. [redacted] elected for that not to happen because Mr. [redacted] did not want any miles on his new trailer. This decision delayed the boat another two weeks. Overall is took a total of 8 weeks to deliver Mr. [redacted] 's boat instead of 6 weeks due to Mr. [redacted] 's decision not to have his boat picked up on his trailer. As far as boat trailer tire pressure is concerned, the tire pressure is located on the side of a tire state the maximum pressure that a tire can hold. Mr. [redacted] 's trailer tire pressure rating is 44 pounds. All trailer tires are checked by the rigging mechanic prior to leaving our dealership. To date Marine Center has not received any photographic documentation regarding Mr. [redacted] 's trailer tires. Since the boat was delivered on May 16th, 2014, Marine Center has only received (3) emails from Mr. [redacted] . If the trailer tires were that bad, my questions to Mr. [redacted] would be why didn't you attempt to get these tires replaced under the trailer manufactures warranty verses claiming that he had to purchase another set. Mr. [redacted] is correct in saying that he at one point was asking for his money back. The owner of Marine Center Mr. [redacted] personally tried to refund Mr. [redacted] money because the customer was being very difficult to work with. At this point Mr. [redacted] backed down and was just concerned about receiving his boat Marine Center also included some good will gestures because we were wall aware that we missed Mr. [redacted] 's delivery deadline by two weeks. First of all we reduced the cost of the ski tow bar from $500 dollars down to $300 dollars saving Mr. [redacted] $200 dollars and included two free hours of installation at $188.00 dollars. We also included a break-away swing tongue to trailer and delivered free of charge, Mr. [redacted] 's boat to his residence. Furthermore, we have contacted our representative at Stingray Boats and he has assured us that Mr. [redacted] will receive a check for the boats bow and cockpit covers. We have also sent out a Stingray boat manual that the manufacturer supplies its customers. Marine Center did have difficulty with registering Mr. [redacted] 's Yamaha motor due to the fact that we are not a Yamaha dealer. Prior to this reply Mr. [redacted] 's Yamaha outboard motor and Stingray boat have been registered with the appropriate manufacturers. As far as any Stingray boat warranty issues are concerned. The manufacturer states that all warranty work has to be completed by an authorized Stingray dealer at their facility. Marine Center is always willing as well as the manufacturer to solve any warranty Issues. M Mr. Moorman needs to do is bring us his boat so we can address all of the issues that he has listed. I just got my back my boat from a certified Yamaha service dealer last Thursday afternoonI took it there since Marine Center is not certified to work on Yamaha engines and the engine has never operated properly since I recieved the boat in May. It also took some time to get it in for service this time of seasonThat is the reason for my slow response. The Yamaha service dealer discovered that the performance issues with the motor were directly related to the time the boat sat at the dealer in S.CThe motor was running very lean due to the fuel injectors being gummed upI had to pay to get it fixed since it wasn't a Yamaha issueSecond issue with performance was the rigging of the throttleThe throttle cable was binding, preventing the cable from moving properly, the mounting hole for the throttle wasn't rightThe Yamaha service dealer drilled out the hole to proper size per Yamaha rigging instructions. I had to pay for all of that tooBoth of these issues prevented the motor from ever running at WOTIn fact it has always operated rpm shortThe boat finally runs like it should as of yesterday, 9/20/The local Yamaha service dealer contacted Stingray boats about the issues and was given no assistance or resolution
Outstanding issues not addressed:
The money owed us from Stingray still has not been recievedThat's outstanding since April per *** *** at Stingray Boats. (outstanding months)
The motor warranty is still short two yearsWe only have a year warranty not the years that was all part of purchasing the boat in March(outstanding months)
The ladder plug and seat parts were never sent to us by *** *** at StingrayHe stated in an email he would send them in May(outstanding months)
I've had to have the finish on the boat professionally worked onI was tired of the comments from people. It looks better than when I recieved the boatDoesn't look new but it's betterI paid for that too
I trusted Stingray would honor the warranty and their wordThey haven't yet. None of these issues were my fault nor should have been my responsibility to pay to get fixed. This boat was supposed to be new
Resolve the issues listed above so we can move on

The only current outstanding issue that has not been addressed at this time as previously discussed was the bow and cockpit cover rebate from Stringray boats We have contacted our manufacturer representative at Stingray by the name of *** *** and he has assured us that all the necessary paperwork is in place to obtain the rebate Once rebate is approved by Stringray boats they will send Marina Center the funds which we will intern give rebate back to Mr***
Once again, when Mr*** brings his boat in for service, we then will be able to repair any take care of any problems and issued that he is experiencing

Mr.
[redacted] is correct in saying that he at one point was asking for his money
back. The owner of Marine Center Mr. [redacted] personally tried to refund
Mr. [redacted] money because the customer was being very difficult to work with.
At this point Mr. [redacted] backed down and was just concerned about receiving
his boat

Center also included some good will gestures because we were wall aware that we
missed Mr. [redacted]'s delivery deadline by two weeks. First of all we reduced
the cost of the ski tow bar from $500 dollars down to $300 dollars saving Mr.
[redacted] $200 dollars and included two free hours of installation at $188.00
dollars. We also included a break-away swing tongue to trailer and delivered
free of charge, Mr. [redacted]'s boat to his residence. Furthermore, we have
contacted our representative at Stingray Boats and he has assured us that Mr.
[redacted] will receive a check for the boats bow and cockpit covers. We have
also sent out a Stingray boat manual that the manufacturer supplies its customers.
Marine
Center did have difficulty with registering Mr. [redacted]'s Yamaha motor due to
the fact that we are not a Yamaha dealer. Prior to this reply Mr. [redacted]'s
Yamaha outboard motor and Stingray boat have been registered with the
appropriate manufacturers.
As
far as any Stingray boat warranty issues are concerned. The manufacturer states
that all warranty work has to be completed by an authorized Stingray dealer at
their facility. Marine Center is always willing as well as the manufacturer to
solve any warranty Issues. M Mr. Moorman needs to do is bring us his boat so we
can address all of the issues that he has listed.
