the contract: Half down at the the starting of the job, the remaining balance to be paid on the completion of the job. We do not accept Credit Card payments. The job that was contracted for was completed before the final payment. The consumer did ask for chipped areas of her front stoop to be patched. I agree to patch the chipped areas of this stoop for NO additional charge. I did patch these chipped areas before the completion of the job. That is when I received final payment. The consumer contacted me about patching more areas of the stoop. I went out and patched the stoop again. The consumer called again for more spots to be patched. I asked her to circle the spots with a pencil. I went out again and there where approximately 20 chips smaller than nickles that where circled. I patched those spots also. That must be what the consumer is referring to as bird droppings. The stoop is approximately 8' x 10'. We did not pour this stoop, it was an existing stoop with chips that the consumer requested patched. We patched the chips at no additional charge. There was a permit for this job. It was inspected before it was poured by the Village of Crestwood. We put control lines in the concrete. If the concrete were to ever crack, it should be in the control lines, they are there to control the concrete if it cracks. It is stated on our signed contracts that we B & M Concrete Construction, Inc. cannot be held responsible for cracks, peeling, scaling or discoloration due to weather, salting, freezing or other uncontrollable reasons. The consumer contacted me about the hairline crack in the stoop. I did go out and sealed the stoop and the lines prior to receiving this complaint. I was back three times to satisfy the customer. B & M Concrete Construction, Inc. has been in business for 30 years. We try to work with the consumer to satisfy them.

I am rejecting this response because: i I apologize for the incorrect dates, the job was done the last weekend in April. However I did not ask him for him to patch my stoop he offered as incentive for me to choose him to the job, said he would make it look real nice and use all the handy tricks of the trade to make it blend in real nice, which he did not. The job was not complete when I gave him the rest of the payment because the stoop was not done and even though it was a perk he threw in it was still part of the contract. I had to bug him numerous times to come finish it. In which I have our conversations via text if I need to pull those out and prove it. He also did not come and put the compound in the large cracks until after I filed this complaint he came and did it while I was not home and did not even notify me in doing so!!! He also did nothing to the large hairline crack that continues to grow in the back step!!! Coming to my house without notifying me is not acceptable. And then acting as if he had taken care of it before this complaint. Lying is also very poor character. There's a reason ur contract states ur not responsible for cracks due to weather etc yet this cement was laid only five months ago and hasn't even seen winter yet. In which he himself said it shouldn't be doing this and would have to talk to ozinga.
