This is my second response to this complaint. The first response was posted to this site on 4/17/18 but did not show up for a reason not clear to me. Maybe not a supported file type as I posted from my Iphone. Re: Complaint ID [redacted] B. Raines Construction and Roofing contracted with the... customer on September 2, 2017 for replacement of a damaged roof and construction of a carport. The customer paid a deposit of $3,000.00 to for the carport. B. Raines Construction and Roofing. B. Raines Construction and Roofing then paid over $4,300.00 to a subcontractor to purchase materials for the carport. However, that subcontractor absconded with the money and never ordered said materials. B. Raines Construction and Roofing then paid to order new materials in order to complete the carport, at no cost to the customer.B. Raines Construction and Roofing then retained a new subcontractor, who began spreading harmful and inaccurate information about B. Raines Construction and Roofing to the customer. As a result, the customer attempted to cancel their contract. The contract signed by the customer clearly states when it may be cancelled - prior to midnight on the fifth day after the owner receives written notice from the insurer that any part of a claim or contract is not covered by the insurance policy. As such, the customer is not permitted to cancel the contract at this late stage.B. Raines Construction and Roofing has expended significant labor and expenses on this project and it is our belief that we are entitled to full payment under the contract. However, in the interest of resolving this complaint we are willing to terminate the agreement and for both sides to walk away. We will not seek any further payment from the customer and the customer will be free to complete the job as they see fit. In exchange, we would retain the amounts that have been already paid (less than half of the contract amount) as compensation for the labor and materials we already expended.
