Please be advised that I am representing Mr. [redacted] trading and doing
business as BT Tire in the above captioned matter.
Mr. [redacted] acknowledges that BT Tire did replace an axle seal on Mr. [redacted]’s
Prius. Mr. [redacted] denies that it was installed improperly. This seal can...

in one direction. Further, there are many potential causes for a seal to fail other than
improper installation. It is obvious from Mr. [redacted]’s own narrative that he continued to
drive his Prius after he was made aware of the continuing leak In kct, prior to BT’s
involvement, Mr. [redacted] drove his Prius without transaxle fluid. Mr. [redacted] contends
that he is not responsible for the replacement costs of the transaxle nor towing charges,
lost wages, pain and suffering•or for the purchase costs of a replacement vehicle.
In light of the above facts and the outrageous requests for damages, I cannot
envision an opportunity to amicably resolve this matter.

Review: On June 19, 2014 BT tire replaced an axle seal on my 2007 Prius. The fluid needed to be filled at a Toyota dealership the same day. [redacted] in Johnstown informed me that the axle seal was still leaking. I called BT Tire and left a message with an employee. The next day, June 20, the car stopped working and would not let it go into gear. I called BT Tire several times and left messages with employees and the answering machine, but the manager never called me back so I had the car towed on to [redacted] on June 22 for them to look at it. [redacted] looked at the car on June 23 and informed me the seal was not installed properly. Also on June 23 [redacted] replaced the seal with a new one, which cost me $206. When I picked up the car on June 23, they informed me that due to the seal being installed wrong all the fluid had been thrown out of the transaxle assembly and now there is a noise in the transaxle assembly. Over the next few weeks I left a few messages for the owner at BT Tire but he never returned any calls. On July 12 the car once again stopped running and would not go into gear. I paid again to have it towed to [redacted] on July 13. On July 14 [redacted] informed me that as a result of the axle seal being installed wrong and the fluid coming out, that the transaxle assembly is ruined and needs replaced. The assembly costs $3500 plus $210 tax plus $65 to fill and $960 for labor.Desired Settlement: I want BT Tire to pay to replace the transaxle assembly ($4730), the cost for me to tow the vehicle in twice ($150) and the cost for [redacted] to install the axle seal correctly ($206) lost wages for two days (400) and 2000 for pain and suffering. I was without a vehicle from June 20 to the 23, from July 12 until August 7 when I had to purchase an inexpensive used vehicle for $1000 because I do not have the money to repair what BT Tire broke.
