Non-Performance of Contracted Services On 5/5/2015, I signed a 12-month lawn services contract with Garnto's Lawn N Trim, to performa lawn and trim services every two weeks for the sum of $per month/$per visitThe contract specified that Garnto would trim all shrubbery and hedges once per month for months (April thru October), mulch and bag leaves during the winter months and place by the road, mow the grass, edge the driveway, curb, sidewalks, and patio, and weed-wack and blow off debris of the area On Monday 2/22/2016, I cleaned all the leaves, pine straw, and other debris out of all my shrubbery and hedge beds, which was not part of the contract in preparation for laying down new mulch It was an all day job I left the debris in the driveway and on the sidewalks On Tuesday 2/23/2016, Garnto arrived to mow and hedge the yard Although I didn't ask nor expect him to pick up the shrubbery bed debris I left in the driveway, Garnto did pick up the debris and place it by the road He then left the premises without talking to me On 2/27/2016, I received a letter from Garnto informing customers that picking up debris from shrubbery beds left by the customer were not part of the contract and, in the future, there would be additional charges is such work needed to be performed On 3/8/2016, Garnto returned to perform lawn and trim services He mowed the yard in less than minutes, a task that normally takes 25-minutes, did not edge the sidewalks, driveway, or curb, but did blow off the sidewalks and driveway Garnto quickly loaded his equipment in his truck to leave as I approached him I asked Garnto why he sent the letter out and who did he send the letter to Garnto replied that he sent the letter to all his customers and, then, became very belligerent and irritated raising his voice at me while saying he's not going to pick up debris from people's shrubbery beds and gardens because it's not covered in the contract I calmly replied to Garnto that he made the assumption that I left the debris for him to pick up Secondly, he picked the debris up by choice I never asked him to pick up the debris and I reminded Garnto that he knew I was home and he could have knocked on my door and we could have discussed the debris I left in the yard He could have asked me if I intended for him to pick up the debris and, if I said Yes, he could have then informed me that there would be additional charges But, Garnto didn't do any of that Instead, he picked the debris up, left angrily, then, sent out a letter citing the contract Then, I wrote Garnto a check for $in advance for March Lawn and Trim Services as I had always done since signing the contract After paying Garnto for March 2016, I reminded Garnto that the contract was coming up for renewal and that I intended change the services I wanted done as part of a new contract and we'd discuss it He said OK or words to that effect, then, left the premises On 3/10/2016, I received a rather belligerent and strongly worded letter from Garnto informing me that customers may make suggestions, but that customers cannot rewrite the contract to their liking for the services rendered Garnto also returned the $check I had given him in advance for March services and informed me he was terminating the contract I had told Garnto when I renewed the contract I'd probably keep the shrubbery and hedges trimmed myself and just contract for lawn mowing and trimming All of this bewildered me because we had a good business relationship up to this point As a result, Garnto non-performed the contract with months remaining on the contract by failing to trim the shrubbery and hedges this coming April and by failing to edge the driveway and sidewalks during the last visitI request the Revdex.com inform Garnto Lawn and Trim that a complaint has been filed against his business for non-performance of a signed contact with months remaining on the contract, and that a permanent file at the Revdex.com has been initiated to better inform the public of questionable practices by said business

The contract specified that Garnto would trim all shrubbery and hedges once per month for 7 months (April thru October), mulch and bag leaves during the winter months and place by the road, mow the grass, edge the driveway, curb, sidewalks, and patio, and weed-wack and blow off debris of the area.
