Review: I had spoken to the trainer in April 2013, about training my Staffordshire Terrier. I knew her from having my German Shepherd trained by her in Florida 9 years prior. She had explained that due to family matter she moved from Florida to New Jersey but still offered board and train. Having had a history I had know reason to not trust her or her ability, she never sent me a contract to sign we discussed everything verbally. The only criteria I was made aware of was her fee, which was $3000.00 and the agreement that my dog would board for 3 weeks and then she would accompany my dog back home to work with me to make sure I was enforcing what she taught. She also asked me how invested I was in my dog? In other words she would access him and see if he came from a good line and had a good temperament , she did and said he was fine and also made the statement that " her dad would of loved him" . I discussed the payment and asked her, if she could provide me with 4 invoices totaling $750 ea, the funds were originally to be drawn from my business located out if the country and the requirements for funds to be paid were a invoice from the business with wiring instructions and explanation of service or contract to confirm bill. [redacted] expressed that she would have to go Kinkos or an outside service because her office equipment was not working and that the structure would be no problem., given our history that she would accommodate this structure. We spoke back and forth for approximately 3 weeks before I sent my dog, while waiting for her to send me an invoice so I could proceed with getting the funds to her about the time my dog arrived, she seemed to have a hard time doing this, all while expressing no concerns about any payment prior to him arriving. I sent my dog at a fee of $385.00 , I finally received a invoice and it was incorrect in the wording and scratched off in the amount and my bank would not of honored this it looked very unprofessional. I asked her also if she needed to send any cards for pet supplies she said I did not that she had his food etcetera . I did not want her to have to wait until she corrected the invoice so I went to the bank and deposited funds, she was paid in full by way of bank deposits, western union and credit card. All this could of been avoided had she supplied a proper invoice. She asked me if she could keep my dog an extra 2 weeks at no charge the reason was she needed more time to work with him, which I now know was because she had not worked with him at all, I trusted her and I offered to fly there and work with her and my dog so she wouldn't have the stress of her situation she had expressed to deal with when it came time to bring him home. She declined, I sent my dog his treats, I asked for photos I never received them it took 5 weeks to get a photo, and she sent me no updates, as to what they were working on, if I did not ask she did not provide. I tried to be as accommodating as I. Could given her situation with her personal situation. The impression I am now under is that she apparently felt that she may of been justified in her lack of performance and obligation by how the payment structure was. However, after counseling I now understand that she took payment for works, she did not complete. If at anytime she could not provide the service in which I was paying for she had the option to return my dog and not accept any further monies. . She switched my dogs diet without asking me or giving me an opportunity to send him his diet, and the worst part is I was not made aware until he was on his way home I had no time to purchase this food, as it is only carried at certain places. Her lack of concern for my dog was evident as I look at the entire picture, she expressed on many occasions what a nice dog he was, I cannot believe someone could be so deceitful and un caring about an animal especially the field she is inn. My dog was not trained at all, I have had him observed my dog trainers and my vet and the consensus is the same for the amount of time she had my dog, what did she do? When she sent my dog home she was to send me a tape of the work she did, she sent nothing, she was to send me a contact too work with me in her place as she could not honor her commitment to bring him home, she sent me no contact. She was to send me receipts I was sent nothing. I asked her on more than. One occasion if she was going to be bringing him home, she at no time said she was not and expressed nothing about there being a problem with anything I had done, her issue was with having someone to care for her other obligations, I even offered to accommodate her if she needed to bring along anyone, she said due to her her circumstances it would not be a good idea. I feel very bad at the way this has gone and I feel for her as a single mother, but I feel like she took advantage of me and my dog. I trusted her, and in this Economy $3000.00 is a lot of money to take from someone and not provide a service this is considered deceptive business practice. I was not aware of any obligations other than what we discussed because I had never been given a contract. This has been a very emotional situation for me and for my dog, the stress of being away from his home for 5 weeks, his diet being changed provide stress on him as verified by my vet. I sent Her a letter of intent with the hope that she would see how she handled this was not correct . She did not respond and has offered no apologies or any attempts to right this wrong. It is illegal to take money for a service and not provide that service. I have kept every correspondence by way of email, text etc.., I have had consultation with an attorney , I was advised to proceed with litigation for recovery and damages. However, I would utilize this as a last resort I would like to give her an opportunity to correct this without having her reputation at risk. I probably should not be as considerate as I am being , but I have feeling as a woman and a mother. I hope she does the right thing.Desired Settlement: I would like a refund so I can pay another trainer to train my dog , I would like a refund for the transportation of my dog. And finally a letter of apology for the way in which she conducted this business agreement. I cannot allow her to justify her lack of obligation by way of anything other than what it is, if at anytime she was unhappy or felt that I was not doing what I was supposed to , she could of sent my dog home or spoken to me. But to keep my dog and then send him home without having performed the service in which she accepted payment for is incomprehensible .
