Revdex.com:I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.[To assist us in bringing this matter to a close, we would like to know your view on the matter.]Regards,*** ***
Attached you will see the the medically cleared email from the *** *** that BAC for Women has requestedAlso the contract BAC for Women is referring to is not signed by meThis contract is not validI would like to stop payment to BAC for WomenI have provided documentation that I am leaving for ***I would like to use my remaining money to purchase necessary items for Africa and I never signed a contractI request that begin immediately

We had corresponded with member and tried to instruct her on the proper procedure for medical cancellationWe refute that Jamie told her to simply bring in a note which we have never received a copy. Michelle tried to explain that a doctor note was not sufficient in terms of
cancelling and that she would need her doctor to complete the Medical Cancellation form (attached), member hung up on the call without further discussion. We have attached the necessary paperwork that needs to be completed by her doctor and once we have reviewed and processed we will notify her of our decision. Until the attached forms are submitted along with the $cancellation fee her membership (see attached copy of contract and additional terms section Additional Rights to Cancellation) her membership we will continue to be active and she will continue to be responsible for the payments according to the contract terms

I can confirm again that all information for *** *** was removedAfter receiving this complaint, we researched the number and found it listed under a *** *** (former member)We assume at this point this is the same person; with that in mind we have removed all information for *** *** as well

We have attached her contract and the terms and conditions section with regard to her rights to cancel based on her relocation.  To date we have only received a [redacted] offer letter (attached), per their letter it indicates she needs to receive final medical &...

legal clearance from the corps in order to be eligible.  Once she receives those documents and provide us a copy as proof of her eligibility to go to [redacted] we will be more than willing to  cancel her membership per the terms of her contract.

We apologize for any inconvenience we have caused her and we have moved all of her contact information from our systems.

Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.  Regards, [redacted]

The complaint states that [redacted] was not aware of [redacted] contract and the terms and conditions of the agreement which was signed on January 17, 2016.  The contract clearly shows signatures for both [redacted] (her daughter) and [redacted] as well as the initials next to the Automatic Renewal...

Program paragraph and the terms & conditions for cancellation of the automatic renewal. It also clearly shows [redacted] signature on the Credit Card Account which authorizes payment of her daughters dues on her credit card. According to our records a copy of the contract was emailed to [redacted] on January 19, 2016 at 1:36 PM to the following email [redacted] which appears on the contract under valid email. [redacted] first contact with the office to cancel her daughters membership was on August 18, 2017.  During [redacted]’s conversation with Michelle she stated that she was aware that she was being charged for her daughters contract since January 2017 and that she just didn’t find the time to call the office to have her daughters membership cancelled. We feel that we have been forthright with [redacted] and that we have a valid contract and therefore we will not be refunding any dues paid through August 2017 for her daughters account. In an effort of compromise we have cancelled [redacted] contract effective August 31, 2017 and we have waived the 30 day cancellation notice requirement as indicated in in the Automatic Renewal Program paragraph which would entitle us to draft the September dues payment if we were to adhere to the cancellation procedures.

Im writing to advise you the BAC did contact me directly and accepted the $250 as payment in full. Thank you for your help. I couldnt have done it without you.[redacted]

The BAC for Women apologizes for the unwanted communication. We have verified that all information has been removed from our systems.

[redacted] signed up online and did submit an electronic signature of her enrollment and also provided a method pf payment for her contract,  a copy of which she received immediately to her email the day she joined. We spoke to [redacted] at 10:53 AM on 3.21.17 and explained exactly how we will proceed with her request for cancellation.

The RAC for Women has been extremely fair with this Member. She claims to have sent relocation forms in June 2015 which we never received (she did not send it Certified Return Receipt as recommended in the instructions-see attached). She then waited 5 months to follow-up on this (see attached notes)...

and took 2 more months to finally provide the necessary paperwork, which we allowed her to fax, to expedite the process. I finally received the documentation on 1.15.16 at 9:32 AM. The request was approved and reviewed that same afternoon. The member provided a Credit Card # for the $25 processing fee which declined. The Member's account was also past due $34.95 and she filed this complaint the same day. The RAC for Women has been more than fair throughout this process; it is the Member who has failed to comply with this simple procedure; once she did, her Membership was cancelled the same day. In the interest of fairness, we have removed the past due amount ($34.95) and waived the $25 processing fee. We will be happy to provide the requested refund as soon as the member can provide a receipt proving she sent the necessary paperwork in June 2015; Short of that, the Membership is cancelled, nothing is due and there will be no refund.

We have contacted the member and will honor the payment of $250 for a full one year membership.
