I purchased a freezer 11/4/20 was never delivered and numerous wasted days waiting Filed a complaint withthe state comptroller for deceptive trade acts still waiting for it to be completed? filed a claim with the BBB and he told me I could pick up the freezer and give me a refund it tookover a month for me to fi all get my refund after the complaint with the BBB he then tell me I would have to drive over 3 hours to Garland to pick the freezer up instead of Houston where I supposedly purchased the freezer. He finall got my refund to me July 5, 2021 but no freezer. He makes numerous excuses up and its never his fault. In December 2020 I tried to puck up the Freezer in Houston buthewould not respondafter I rented a trailer and had to rig it up to haul the freezer. He also gave me 2 different address in Houston to make it difficult to file theft charges. My opinion is they are a shady businessthatneeds to be closed down.

Through my investigation I found out he NEVER owned the items. That's the scam he advertise profits he don't own. He drags you til he get cash app payment while he delay delivery over and over again. Then refused communication. I want penal response to follow up legally

As stated *** agreed to $570 refund on several text. *** Request for $570 refund is noted on several texts. *** stated he will refund refused delivery pickup expense to ***. *** on multiple text and verbally he would refund. He implemented a stall tactic to have funds clear. *** is still scamming by offering me over two months later a lie. I purchased a freezer after last delay. Items spoiled due to all his lies deceptions and delays. I've suffered over $1170 in damages because of *** deceptive practices. Auction house was only notifying *** of unsold auction items pickup, not a pickup delivery to ***! Also U Ship only confirm inquiries to Post *** request to pay any private takers to delivery Item for $50. Which there was none. I have over 103 back and fort texts to work with him, even arranged and paid for pickup for deliver, but *** refused pickup and again agreed to refund expenses/damages.

Good evening,

We sell new and used commercial and residential refrigerators and freezers. We sell from our physical location, ship and also provide the option to pick up from various locations through various channels in which we are supplied. In this instance Mrs *** purchased a used upright freezer that was scheduled to be delivered. She insisted on having it picked up before the delivery date and it was made clear to her that there was a time window and date in which the item needed to be picked up as it was purchased through an estate sale auction. It was not picked up during that time and Mrs *** reached out to us two months later angry and threatening. We have offered to send her another upright and she will not accept and continues to make false claims and threats.

Please find attached paid invoice screenshot and receipt of the item sold to Mrs ***.

I can follow this email with attached screenshots of our text exchange with Mrs ***. We certainly are not happy with this outcome and will honor the offer to send her another upright if she will accept it.

Come now, ***-El(c), sui juris and propria persona (not to be construed as pro se), on behalf of the strawman corporation (DEBTOR) - ***, civility mortuuse. In the above entitled cause, the plaintiff is filing an Notice of Affidavit of Rebuttal/First Amended Complaint so that a more clearer understanding of the claims first opportunity to amend plaintiff's complaint to identify the claim that was being asserted against each and every named party defendant(s), that plaintiff deems she had a Cognizable Claim against.

FIRST FACTUAL EVENTS

Shawn *** (Owner/Operator male introduced himself as Shawn *** via text and phone conversation) and BACK OF THE HOUSE STORE both knew or should have known that they should have refunded the $380.00 Cash App Transfer, $70.00 Cash App Transfer and $125.00 Pre-Paid Pickup 3rd party, *** 24/7 delivery fee. On June 11, 2020 after 1:30 p.m. as agreed.

On June 9, 2020, at approximately 12:14 a.m. ., Plaintiff texted Shawn *** to forward pictures of inside of freezers (priced "USED freezer" for $350.00 + $30.00 (delivery fee) = $380.00). Once Shawn *** could not produce pictures of interior of (USED freezer) Admiral Freezer/mini Sony Freezers before delivery to verify "safety of use".

Shawn *** then text an offer to plaintiff to purchase a "New Fisher Scientific 20FFEETSA Isotemp Flammable Material Freezer" hereafter known as "New Scientific Freezer", Serial no. XXXXXXXXXXXXXXXX XX in x 30 in x 72 in H freezer for $450.00 on June 9, 2020 at 12:31 p.m. .

Plaintiff accepted Shawn ***' offer of $450.00 on June 9, 2020 at 5:38 p.m. for "New Scientific Freezer". Upon receipt of photos and specs of "New Scientific Freezer" on June 9, 2020 at 10:06 p.m. , Plaintiff paid an additional $70.00 via CASH App to be combined with previous CASH App transfer of $380.00 sent to Shawn *** at $Backofthehouse.com, TOTALING $450.00 for "New Scientific Freezer". Due to fact that Shawn *** didn't have the ability to secure legitimate delivery as of June 10, 2020 at 11:03 a.m. . Plaintiff requested "Refund of $450.00" and it was stated by Shawn *** that he will be refunding $450.00 on June 11, 2020, if "New Scientific Freezer" was not delivered.

Shawn *** then presented a "pending quote" from UShip for an "un-booked delivery quote" for unknown address in Downers Grove, Illinois XXXXX for "New Scientific Freezer". Upon receiving text copy of "un-booked delivery quote", Plaintiff requested refund from Shawn *** because of his inability to secure delivery of "New Scientific Freezer" to plaintiff's delivery drop-off location in Chicago Illinois XXXXX which address was given fully via text (twice) via text on June 9, at 1:00 a.m. and at 9:40 p.m. .

Shawn *** received confirmation of ***'s driver, which was booked by plaintiff on June 9, 2020 at 4:38 p.m. Plaintiff texted *** confirmation of pickup address for "New Scientific Freezer" to Shawn ***. Shawn ***, who refused *** on arrival access to pick-up and deliver "New Scientific Freezer." Due to Shawn ***' refusal of *** delivery pickup, Shawn *** previously agreed to refund $575.00 if "New Scientific Freezer" is not delivered by June 11, 2020.

SECOND FACTUAL EVENTS

Plaintiff confirm with Shawn *** that someone was on site until 6:00 p.m. *** Downers Grove XXXXX) as of 4;17 p.m. to pick-up "New Scientific Freezer" on June 10, 2020 by 6:15 p.m. . Plaintiff booked delivery pick-up with *** for verified address *** Downers Grove XXXXX) on June 10, 2020 at 5:38 p.m. . Plaintiff sent confirmation text at 5:38 p.m. on June 10, 2020 to Shawn ***, documenting/confirming *** pickup delivery address for "New Scientific Freezer". Confirmed via text at 5:56 p.m. to Shawn ***' cellphone (XXX-XXX-XXXX) that *** driver was in route to confirmed Downers Grove address and driver is due to arrive in less than 15 minutes. Shawn *** replied at 5:56 p.m. that he wanted to cancel pick-up and schedule two other guys the next day, on Thursday June 11, 2020!

Plaintiff reiterated to Shawn *** that *** was pre-paid and confirmed driver was (14) fourteen minutes out from pick-up site. Shawn ***' delay tactic are unlawful: all due to the controvertible facts and evidence outlined in the Text Transcript, that disclosed in pertinent detail the following: Text Transcript showing updated text confirmations of *** confirmed schedule delivery pick-up time (Wednesday, June 10, 2020 as agreed), refund agreements and Shawn ***'s inability to secure delivery by June 11th 1:30 p.m.

Shawn *** delivery issues were "never ending" and hindered plaintiff's purchased "New Scientific Freezer", to be picked-up and delivered contract via *** on Wednesday, June 10, 2020 at 4:30 p.m. plaintiff made two calls and secured *** with assigned driver, Leslaw H. to pick-up "New Scientific Freezer". Shawn *** agreed to a full refund of $575.00 is to be returned to plaintiff on Thursday, June 11, 2020 via Cash App , if "New Scientific Freezer" was not delivered on June 11, 2020 by 1:30 p.m. The "New Scientific Freezer", purchased from Shawn *** was not deliver nor allow to be pick-up by "plaintiff's booked and pre-paid" *** Driver, as promised in text transcripts.

Plaintiff made yet another refund request, and at 7:02 p.m. on June 10, 2020, Shawn *** offered to refund delivery cost of $125.00 in addition to $450.00 to be refunded (confirmed via text from Shawn *** at 7:29 p.m. on June 10, 2020) stating, " If you want, it will be delivered tomorrow (June 11, 2020). If not, I can refund your payment in morning."

Shawn *** could not arrange legitimate delivery for June 11, 2020 before 1:30 p.m. . Plaintiff's final request for refund of $575.00 was demanded of Shawn ***.

Plaintiff's requested refund was not honored by Shawn *** and BACK OF THE HOUSE STORE at 1:52 p.m. on June 11, 2020, even though Shawn *** on multiple occasions, via text has stated he would issue a refund of ($575.00 in pre-paid delivery fees and purchased cost incurred) "New Scientific Freezer" if not delivered.

PRESERVATION OF ALL RIGHTS
(BOTH KNOWN AND UNKNOWN)

For the preservation of all plaintiff's rights, plaintiff realleges former federal fraud claims (conducted via cell phone across state lines) made against Shawn *** and BACK OF THE HOUSE STORE, which did not "operate with clean hands" as alleged in both plaintiff's Original Complaint and this Revdex.com Amended Complaint.

Finally, plaintiff's confident that Revdex.com will entertain plaintiff's claim as it relates to actions and inactions of Shawn *** and BACK OF THE HOUSE STORE taken and those not taken to ensure delivery of "New Scientific Freezer" NOT "USED ADMIRAL FREEZER AND SONY MINI FRIG". At best, it's just not difficult to discern that plaintiff was not afforded access nor offered due diligences by Shawn *** and BACK OF THE HOUSE STORE to deliver said purchased "New Scientific Freezer" or refund $575 for "New Scientific Freezer" by June 11, 2020 as agreed. All damages incurred by plaintiff due to Shawn *** not allowing arranged picked-up for delivery by ***'s driver, *** H. on June 10, 2020 has doubled plaintiff's loss of products ($600).

Furthermore, neither Shawn *** nor BACK OF THE HOUSE STORE made any attempts to deliver "New Scientific Freezer" once Shawn *** refused plaintiff's pre-paid ***'s delivery services on June 10th . No further attempts made to honor verbal and written contract (via text Message) of delivery on or before June 11th , 2020. Shawn *** is diverting the focus that I purchased a NEW Freezer Not USED Freezer from auction he purchased for himself. Ask *** where was NEW freezer comimg from? *** Auction Has no record of "New Fisher Scientific 20FFEETSA Isotemp Flammable Material Freezer" hereafter known as "New Scientific Freezer", Serial no. XXXXXXXXXXXXXXXX XX in x 30 in x 72 in H freezer. Shawn *** is still using switch and bait tactic in his false claim that I agreed to pickup a USED freezer for $450.

We paid Shawn *** and Back of the House Store $4624.05 for a set of commercial kitchen appliances which he never delivered
Summary: Shawn *** represented that he would sell, deliver and install commercial kitchen equipment with specifications provided on the attached invoice and to be delivered by specific dates. The amount paid for these products and services was $4,624.05. The seller essentially stopped responding after we paid the invoice we were provided (proof of payment available) and has stalled on delivery in every communication since. Our last communication with him was on Wednesday May 20th. At that point, he continued to insist that we would receive the goods but refused to commit to sending over delivery company/contact information or time frames. He has now completely stopped responding to calls and messages and blocked our phone numbers. He is clearly trying to run away with our money with no intention of ever delivering the promised goods/services.

Good evening,

I apologize for the lack of response on my part but please take this down and let me resolve this issue. I started this company and have had shipping issues which I hope that I have worked through. This particular order I was told by the customer they wanted a refund after there were delays to get the equipment delivered on the date intended. I couldn't refund and they gave me no option on the delivery. I had a truck driver that I paid to deliver items throw all of my new equipment out of the back of his truck. I have been going back and forth with insurance on getting items covered. I will reimburse or deliver the items ordered when the insurance claim is resolved or I can get the items delivered. They are available for pick up.

This business advertised on craigslist for the selling of a lot of lockers. He charged me through PayPal and refunded the money when the shipping address was incorrect. He then charged me through CashApp. He sent an invoice and communicated regularly during the 5 day window of delivery but never gave any delivery information. When the unit never arrived I asked for a refund as I was without product and he continually denied this request and tried to bait and switch me for another product and more money. At this moment, I have no recourse for retrieving the lost funds nor securing the item originally purchased.

In the end he is a scam artist with a lot of time.
