Review: on 1/16/14 I payed backyard creations 7970.40 dollars to get started building a bbq island. on 2/19/14 they said it was done but could not be delivered until I paid the balance of 5313.00 dollars, claiming they had problems before with a delivery person. the contract states that payment can be made on delivery if by cashiers check. I had seen pictures of the island completed so I did pay . one excuse after another and the island is delivered on 3/11/14 , however it is missing the gas bbq unit, side burner, refridgerator, lights, elec outlets and the delivery man said that they would be coming a different day. numerous phone calls, most of which went to voice mail and not returned , and [redacted] , a secretary I think, said they would complete installation on 4/3/14. again another excuse and cancellation but was assured they would be there 4/5/14. no calls and finally I contacted [redacted] and she said she did not know why and [redacted] , co-owner, would not return her calls.Desired Settlement: cashiers ck for3200 dollars to purchase missing items and complete the bbq island myself, or they have this project completed by 4/12/14

Review: I purchased two large patio islands and a patio cover from Backyard Creations. The islands and patio cover were all delivered on the same day, however, due to improper scheduling and coordination by the contractors the patio cover was not installed on the day it was delivered. Never-the-less, I was asked to pay in-full on the delivery day on did so with assurances from the manager/owner of Backyard Creations that the remaining work would be completed to my satisfaction. The patio cover was installed within the next week (the third week of July), however, the contractor made additional cuts into the countertop of the patio islands so that the patio cover posts would fit; unfortunately due to the shape of the posts this left large gaps in the countertop around each of the four posts. Over the coming weeks I made several phone calls to Backyard Creations - Backyard Creations finally scheduled someone to come repair the countertop surfaces on August 22. Nobody showed up to make the repairs and I received no phone call explaining why (this was the third time Backyard Creations was scheduled to perform work and did not show up). I personally returned to the Backyard Creations showroom on August 24 asking for the manager/owner of Backyard Creations to contact me to reschedule the repair work ASAP. On August 26 I received a phone call from a Backyard Creations employee saying I would receive another phone call by August 28 to schedule the work. I received no phone call and the gaps in my patio island countertops remain.Desired Settlement: I would like a phone call from the manager/owner of Backyard Creations telling me when the repair work will be completed, to actually have someone show up on the date and time scheduled, and to have the patio island countertops fixed so no gaps remain.

Review: Backyard Creations has failed repeatedly to deliver the products and services they are contractually obligated to supply.

I hired BC (Backyard Creations) to design, construct, deliver, and fully assemble an outdoor kitchen with a patio cover/roof. They were paid 50%($7,500) at time of contract signature.

Once we were informed by BC that the product was ready for delivery, we setup a delivery date. That date was delayed at least three times by them, citing issues getting the delivery people needed.

After delays of two weeks, we did receive delivery of the outdoor kitchen structure, but it did not include the appliances (grill, refrigerator, cabinets, doors) or the roof. We were told that they had issues with their vendors, and that it would be another week. We paid an additional $3500 at that time (leaving a balance of $4000 due)

We did receive the appliances within a week, but did not receive the roof. We were told (again) that there was issues with either vendor and/or delivery personnel (take your pick, the excuses changed almost daily). We paid BC $2500 (leaving a balance of $1500).

BC then promised us a delivery of the roof in 10 days, on a Thursday. On the day before delivery, they notified us that they would not be able to deliver on that date, and they also suggested that we should find another company for the roof; they indicated they were not confident that they would be able to deliver the roof at all.

We have bent over backwards in regards to working within their time frames, ever to the detriment of important business entertainment activities that we needed the outdoor kitchen for. Now they have admitted that they cannot up-hold their end of the contract, and we will be seeking legal remediation to cover the costs of both the new roof, as well as additional time and expenses.Desired Settlement: I insist that BC (obviously) waive the remaining $1,500 due. Additionally, I insist that BC cover any additional cost over $1,500 for a comparable roof that I will have to purchase separately, and any other additional expenses that will arise from this additional effort (delivery costs, hourly rates, my time, etc.).

Response:

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

"We have resolved all issues with Mr and Mrs [redacted]. They have their patio cover and recieved all items ordered from us. If they require further service of any kind, we will be happy to discuss their service needs with them and schedue an appt with our service technican as soon as possible."

This is an outright lie; we never received the patio cover, nor were we ever contacted by Backyard Creations in regards to an amicable settlement. I am shocked that they would even suggest this; it is clear that they expect me to forget about my complaint, and hope that their response here will not be challenged.

Review: On Sept 4, 2013 I agreed to final drawings/ design for a custom BBQ project. I had made a 50% down payment in July of 2013. The company promised a 4-6 week timeline for completion. On Oct 31, 2013. Ty called me to set up delivery of the finished project. I asked them to hold off for 2-3 weeks for my contractor to finish a related project at my house. Ty required that I pay the remaining 50% balance which I did by Visa. Total charges over $8000..

I called the company to arrange delivery in November and talked to [redacted] told me the project was not done yet but promised in writing a deliver date of December 20, 2013. On December 19, 2013 I attempted to contact the store and went by the Convoy St address only to learn the store is closed with no forwarding address or phone number posted. [redacted] replied to my email saying that the project could not be finished until Jan 2, or 3 2014. I told her the phone numbers were disconnected, the store is closed there is non one at the other address she gave me which is on Santa Fe st in San Diego..

The company has failed to deliver products in a timely manner, they have been deceptive and dishonest in the representation of the projects completion and have failed to provide notice of delays, phone contact information and and store location

They have had more than 14 weeks to complete and deliver the project. It is my opinion that the Santa Fe street office is not a working retail store based on the fact there is no phone number, the door is locked, lights off during hours mentioned in a phone recording at the production facility which is in Morena Valley

bottom line: breach of contract, misrepresentation of projects status, failure to communicate change of address, store closing, and changes to delivery commitments. The phones have been disconnected. I have spent 8000 dollars and have grave concerns this business had taken my money and gone bankrupt. I have email and text conversations to support my claims.Desired Settlement: I want all my money back immediately.

Review: On 2-8-2014 I signed a purchase agreement with a salesperson named [redacted] from Backyard Creations for a 6' x 10' BBQ island with several features including but not limited to a 40" Lion grill and lion sink. I put down a 50% deposit of $4,000 and was told the BBQ island would be completed within 6-8 weeks. During the 6-8 weeks I was told to expect many follows up emails and phone calls regarding tile and color choices, none which I received. I made several attempts to contact my salesperson [redacted] and find out my projects status, not 1 phone call was ever returned. After several failed attempts I drove down to Backyard Creations on 3-4-2014 to confront [redacted] and speak with the manager, when I arrived I spoke with my salesperson and was assured my BBQ Island was in production and would be done no later then 3-28-2014. He had no answer for not returning my emails or phone calls. On 4-7-2014 I received a phone call from my salesperson [redacted] who told me my island would be complete by Friday 4-11-2014 and asked if I could "come in and make payment in full". I told [redacted] that the agreement was to make payment in full "upon delivery and installation of the BBQ Island" to which he disagreed. I told [redacted] that is what the contract stated and if that was an issue to have his boss or manager give me a call. 2 days later 4-9-2014 I heard from a lady by the name of [redacted] from Backyard Creations factory where the product is manufacturerd and was told the San Diego office is closing down and moving up to Moreno Valley, she assured me the product was still being finished and I could reach her at [redacted] anytime to get an update. It is now 4-15-2014 and I am now unable to contact this business, they will not reply to any of the more then 6 emails I have sent nor do any of there 3 phone numbers work any longer. I am concerned this company has "taken my money and run". Backyard creations has not held there end of the deal up and have $4,000 of mine. I have not received any of the product on the purchase agreement and would like to know what happened or what is happening.Desired Settlement: I would like them to complete and deliver/install my BBQ Island, however if they are unable to do so I would like my money back in FULL if they cannot deliver on the product I have paid for.
