We are in receipt of Mr. [redacted]’s response
dated August 13, 2015.
With all due respect, Mr. [redacted] was advised several times that we
did not build the balcony.  Mr. [redacted]
contacted us 5 years after the project was completed to look at the
kitchen.  We fully explained to Mr.
[redacted] that this was no longer under warranty (Backyard Retreats structures
are warranted for a period of 12 months from the date of completion)
additionally it was not properly maintained.
We must admit we are dismayed that Mr. [redacted]
is now claiming, 6 years later, that the cover we did build is unsafe, which is
completely untrue and unsubstantiated.  Backyard
Retreats has strict building standards that we build to.  Mr. [redacted]’s project was built to local
building codes and inspected during construction by a certified windstorm
engineer which ensured that it meets the required windstorm construction codes
with all the necessary straps, anchors, bolts, hold-downs and nailing. This
includes the foundation, roof shingles, exterior and interior walls and roof
structure for the wind loads to be imposed.
We understand Mr. [redacted] is not happy that his project is no
longer under warranty and will have to pay for maintenance repairs.  However, that does not warrant his disparaging
allegations against our company.
We appreciate the opportunity to explain our
position and wish Mr. [redacted] the best.

[Provide details of why you are not satisfied with this resolution.]
Regards,
I moved in the house in 2010 and I called them in 2011.  They came to my house and said they will fix it.  I needed to pay only for material and I agreed. After that, they came without calling me and nobody was in the house. I saw my balcony, they cut some composite boards, replaced with new ones and did not know what else they did.  I thought they really fixed the problem. They never contacted me afterwords or sent any kind of bill. As soon as noticed leak again I called them.  He did not tell me that his company did not built balcony. The previous owner of the house gave me the name of company.  They also never mentioned about payment even after my several phone calls to the company. The owner of company came second time in 2014 and still did not ask for any money (shameful claim that I did not want to pay them). I showed him damage under grill area and he said that he is going to replace only piece of plywood that is most damaged (charge 750$). He also said about silicone and his charge is going to be 150$. First of all I new there is more damage underneath it and it needed major work.  The area was built without any proper drainage and I had to keep stainless doors open all the time to dry out.  I had growing mold also.  I tried to apply silicone but silicone itself was not problem. However, the major concern was the outdoor kitchen roof wall which was only attached to the balcony without any stud support. He may claim that roof is built to the standards. I do not know that. My intentions were  to call the same company to fix it because they knew how they built it. I am really disappointed with his claims how his company was so helpful. By the way I have all the pictures of damage.  Now everything is fixed I and hope for good. I would not recommend their company to anybody else.

RE:  Customer [redacted]...

[redacted]                                   ... Revdex.com Case#[redacted]
         [redacted]
We appreciate the opportunity to
respond.  We have to say, we are very
disappointed to read Mr. [redacted]’s comments.
In 2009, we completed an outdoor kitchen,
covered patio with an outdoor fireplace and replaced top boards on a balcony at
3002 Elsbury Lane for a previous homeowner.
Approximately, two to three years later we received a call from a Mr. [redacted]
(not the original homeowner) to come
out and look at an area that he claimed was leaking.  I personally
went out to inspect it and noticed that it did have a small leak in the second
story deck, however, our company did not build the balcony. We were only
contracted to replace the top boards on it. I explained to Mr. [redacted] that we
could fix the leak on the existing structure but it would cost between $150 to
$200 to repair, as we did not build the balcony.  Mr. [redacted] agreed to the cost and we did the
repair. We must note, that to date Mr. [redacted] has never paid us for the
repair.
The next contact we had with Mr.
[redacted]  was in August 2014 (5 years
after the project was completed) requesting us to come out and look at the
outdoor kitchen.  Again, I personally met
with Mr. [redacted] to see what his concerns were.
What we had found was the outdoor kitchen had not been maintained with
the silicone on the granite surface, which in turn caused it to leak and
started to rot the inner structure. At this point I explained to Mr. [redacted] that the project was not properly maintained
which lead to the problem.  Anything that
is built outside, exposed to the nature elements will need general maintenance.  Additionally, the project was no longer under
warranty (one year from the date of completion) as it was 5 years old.  I reviewed with Mr. [redacted] what would be
required to repair the outdoor kitchen, which was removing the granite and
replacing the inside structure.  He was
given an approximate price on the spot, which he said was too much and he
expected us to fix the problem at no cost to him.  He mentioned the balcony having another leak
and I tried to explain to Mr. [redacted] that we did not build the balcony.  As a
goodwill gesture, I emailed him a contact number for a roofer and reiterated
that we are not responsible for the rook leak and it will be his responsibility
to pay the roofer directly.
We are very shocked to hear of his
new allegation that the roof that we did build was not built to standards.  All of our structures are built according to
the highest standards and local codes for ultimate safety and durability.  Additionally, this project was engineer
inspected and certified. To simply say the structure is unsafe, is very
untrue.
We have tried our best to work with
Mr. [redacted].  However, as we hope you can
understand we simply cannot be held responsible for something we did not build
and/or the project was not properly maintained.
