Ms. [redacted] is not and has never been a client of the firm. Our firm did file a case in 2005 with one party with the same first and last name, but a different middle name. We did not use Ms. [redacted]'s Social Security number in that case. Attached is a document that is publicly...
available and is actually mailed to all of the creditors in any bankruptcy case for the [redacted]. [redacted] that we DID represent. I have talked with the complainant and verified that her identifying information was not used in the case filed in 2005. I have also sent her this and other documents so she can provide these to the agency that advised her that SHE had filed a bankruptcy in 2005 (which she certainly did not).It appears that the complainant was advised by a third party that there was a record of HER filing a bankruptcy. I do not know who told her this and our firm did not use the identifying information of the Ms. [redacted] who filed this complaint. As an aside the "[redacted]" she was told had filed the case and listed her as a co-signor is actually the Chapter 12 & 13 Trustee for the Northern District of New York who is in charge of administering cases, and he has not filed either!Our firm uses a rigorous system for verifying the identity of our clients. We call up credit reports and tax transcripts, as well as getting the original of photo id's and social security cards. I had an interesting discussion with the Ms. [redacted] making this complaint and determined that she was referred to a third party by the student loan lender "[redacted]" and this agency informed her of the incorrect information THEY had on her record.I am happy to help this woman correct the error if I can, but again, she has never been a client of the firm and we did not use her information to file the bankruptcy case in 2005.
