In response to the above referenced complaint The contractor is correct, he has not been paid The reasons for this are several:First, the floors in the kitchen and behind the bar have not been completed I have attached pictures to verify this The cement board and epoxy behind the bar and the cove in the kitchen are not completedSecond, according to the contract we signed with the contractor, the work was to be completed by Tuesday July, 7th If not, Badlander's Pub and Grill would assess a $per day penaltyAs stated and verified by the pictures attached, the job has not been completed and at this point the contractor owes me moneyThird, the contract specifically states that the existing 1/inch cement board would be removed and new 1/inch cement board would be installed This was not doneThe contractor removed the ceramic tile but did not remove or even grind the existing thin set down to level I have attached pictures showing the epoxy over the trowel marks of the thin set This proves that the cement board was not removed and replaced as per contract Finally, the work completed is unacceptable The contractor was supposed to grind the floors smooth and as level as possible There are large holes in the epoxy, the coving that was supposed to be done is pathetic and the floors in both the kitchen and the server room are already giving awayAgain, pictures are attached The contract that was signed by both [redacted] and myself states that the work done needed to be acceptable to me before final payment was made and his work is completely unacceptable so payment has not been made He has stated in several text messages, which I can provide if necessary, that he knows I am not happy with the floors.In response to the rest of the complaint of me telling the contractor we would not be able to open This is also correct We had to go to Menards to purchase vinyl coving and paint to repair the large holes left by the contractor The coving he installed had large holes between the floor and wall which is a violation of the Wisconsin Health Code We had to install the Menards purchased coving in the kitchen to get up to health code We also had to paint the walls in the kitchen where the contractor ripped the drywall while they were removing the existing coving Again, bare surfaces in the kitchen is a health code violation I could not open Wednesday, July 8th until 5pm because of all the work we needed to do to get the kitchen up to health code Normally we are open at 11am I can provide copies of the receipts from Menards if necessary.In addition, I now have to pay another contractor $to fix the mess that [redacted] made The owner of the new company, Premier Flooring, stated that "his year old son" could have done a better job" I have contacted an attorney and am in the process of suing [redacted] for breach of contract and shoddy workIf you have any additional question, please contact me directly [redacted] ***OwnerBadlander's Pub and Grill
