Review: I hired [redacted] of Bah Realty to help me look for a house. [redacted] shown me numerous houses, some didnt have driveway; others have small living rooms and bed rooms. Then he showed me the house on [redacted], at the time he shown me the house was under construction. There were a few things missing from the house, and some things needed to be repaired such as the lanolin tiles in all three apartments living rooms, the cabinets draws were falling off the track, the air conditioner covers were not there, the windows had no screens, broken windows, crakes through out the house such as crack door frames, and big open holes in the walls with cracks in the corners of the walls, toilets seats were missing soap dishes and towel racks were missing, and the bathroom tiles were very dirty too. When I inquiry about these problems [redacted] informed me that the issues will be fix before the closing. He lied to me and that is misleading. On that day [redacted] also promise that they will installed stainless steel appliances in all three apartments, and they will cut the curb for driveway in front of the house. [redacted] misleads me to buy an uncompleted house promising to have the house completed. There were no refrigerators until the day after the closing. I started to feel that [redacted] was working for the Seller instead of me. On the day of the closing April [redacted] 2013 I produced to them a 70 pages report regarding the inspection of the repairs in the house, and a $45,000.00 estimate. I was force to except $15,000.00 in escrow instead of the $45,000.00 estimate for the escrow I requested. The two attorneys made an agreement to keep the $15,000.00 in escrow so that the seller do the repairs that is on the Punch list in a timely manner in 15 days, if repairs are done within the 15 days the seller get to keep the $15,000.00 that is in the escrow account and if the repairs are not completed in the 15 days I keep the $15,000.00 in the escrow account so I can finished the repairs.Desired Settlement: I want [redacted] practice to be investigated and for him to speak to the Seller regarding the $15,000.00 in the escrow so that I can do the repairs myself.

My name is [redacted], Since 1998 I have owned several businesses including a retaurant in Jamaica queens and drug and DNA collection facility in manhattan new york. Therefore, I have a back ground on customer service. I joined the real estate industry in 2011; I am a licensed real easte agent in new york state. My job is to help clients find properties to rent,sell or buy. As of todays date I am blessed to have closed my 29th transaction in residential sale and 40th transaction in rentals.

[redacted] was refereed to me by his banker [redacted], he called and told me that he have hard a lots of great things about me, that he would like me to help him find a house. We set up to meet in the Bronx to do some evaluation and get a better understanding of his wants. But before my meeting with mr. [redacted] I called [redacted] the banker to thank him for the referral, [redacted] ( the banker) told me that [redacted] has been looking for a house for the past 16 months, he was in a contract already but for some reason the deal didn’t go through. My first meeting with [redacted] was on a Wednesday on his day off from work. My first question to him was why is he having problem finding a house for more than a year during the easiest time to find a property. His answer was he has working with four agents and none of them were honest with him , then I ask him why he didn’t close on the last deal he had contract on, he said to me that the seller was trying to reap him off by over pricing the house. After hearing all his concerns, I told him that I am sure he did his research and it sounds like he knows the market very well by now; how ever I might have some properties to show him. He specifically ask me who will be paying my fee I told him its the seller, But I assured him that I will negotiate to get him the best price possible. He agreed to work with me; during the same day I showed him about 6 properties 3 of which he saw already, I took him for a second time and showed him 4 properties including [redacted](the house in question). The house was under construction but he liked it. I told him that this house is not yet completed but he can hire a licensed inspector to check the condition of the house and his lawyer can add all repairs to the contract so its legally binding and the seller will be required to do the repairs before closing. He said its okay I should just get him the contract he will sign it with his lawyer and he will do inspection after he gets a mortgage commitment from the bank, he said he will spend money on anything until his sure he will get the mortgage for the property. During the time he got into contract similar houses in that area were being sold for $600,000 plus and I got him his property for $540,000 and I also got $27,000 sellers concession to help him toward his closing cost. The bank appraisal can confirm this statement.

He did inspection after the he got a commitment from the bank and sent it to me, I forwarded the same report to the seller.

When the closing is scheduled on a property its required by law to do final walk through within 24 hours before closing. The morning before closing I did a final walk through with [redacted] on the property to check the condition of the property. We took notes of all items that were to be fixed, I told him its his choice he can either delay the closing until everything is fixed or he can ask his lawyer to hold some money on escrow until everything is repaired. He decided to move on with the closing and he said he will speak to his lawyer for solution.

To the best of my knowledge [redacted] attorney and sellers attorney agrees that they hold $15000 on escrow until the rest of the repairs are done, the seller was given 2 weeks to complete the job, both attorneys also chose the listing agent of the property to control the repairs and sign off on once the job is completed, and that was a legal binding between lawyers which has nothing to do with me. [redacted] was part of all discussion, I am sure his lawyer consulted him before he made a decision.

After the closing [redacted] thank me for making the deal go through he even promise me a bonus after he consults his wife. I didn’t hear from [redacted] after word until one morning he called and said that the seller did not keep his word that the repairs wasn’t completed and he is going to sue the seller for the $15,000 I ask him if he spoke to his lawyer about it, his answer was yes but his going to sue his lawyer too, because his lawyer was a crook. Then I told him he should really think about it because it might be a waste of time for no reason if he can negotiate directly with the seller he should do that instead of going to court. Then he said to me that not worry about that, he is familiar with lawsuits that he sued the city and got $25,000 before. Since that I haven’t heard from him again.

I am really surprised to hear him say that he was forced to do anything, but what is not clear in his statement is he is not telling who really forced him to accept a deal he don’t want or how exactly he was forced.

As a licensed real estate agent I believed I have done my job to the best of my ability, what I was really expecting from [redacted] is at least a thank you not calling me a liar, he is really ungreatful. Through the various businesses I owned and managed I have always dealt with people with different background. For past 15years of dealing with people [redacted] is the one and only client who complain on me. I am ready at any given time to come in front of any one to explain with evidences of this whole transaction.

once Again this will be my last time responding to this complain, I have made it clear that as a sales agent I have nothing to do with funds held in escrow account. Mr. [redacted] should contact his attorney to get him back his money. It seems like Mr. [redacted] is waiting for me to fail to answer one of his emails so Revdex.com will give a our business a bad rating he knows himself his request doesn't make any sense; am sure he is a very intelligent man. how could he ask me to give him back what his lawyer has?

You see [redacted], as far as am concern you will get a bad rating whether you answer my Email or not and the reason is I am complaining the wrong and falls promises you and your people has done to me, and all you keep saying is, this is my last time responding to [redacted] complain, Mr. [redacted] is a very intelligent man, He should be having this conversation with his attorney, I am ready to sit in front of a committee to discuss this issue. You see [redacted] you are not addressing the complain. You made over $10,000 from me by falsify information and selling me the uncompleted house, so if you ready to sit in front of a committee instead why don’t you call your co broker [redacted] of [redacted], and the seller and his attorney and sit down and discuss why it is important that they release the $15,000 in the escrow, because they wrote the agreement and it’s only fair your co broker also made more than $10,000 from me and the seller made over $567,000 and it’s all because you made false promises and sold me an uncompleted house.
