My punch listMy husband (at the time) and I purchased a home to be built last year in February of 2012 and moved into this home in July of 2012 and our contract said that we have a one year warranty on it and that our punch list would be finished with in that time. I have numerously contacted them to schedule something first couple times we did schedule the repair mam to come out but he never showed so I called and emailed and returned calls and nothing has been done. I have a ln area under my carpet that sinks noticed that in our final walk through and a lock that is missing on one of my windows and my sprinkler system doesn't work. I was given a number for the sprinkled system and those people never came out. My driveway is chipping and cracked noticed that mid summer, my garage door squeels. Its been over a year now and I have stopped contacting them since August of this year and nothing has been done. My house is up for sale now due to a divorce but these things need to be fixed before it can be sold. Some of my other neighbors are having the same issues not getting their punch lists finished.Desired SettlementMy punch list finished and things repaired Business Response We have been in contact with [redacted]. We scheduled to address the issues on Thursday 1/9/13. [redacted] called us to say she was unable to make the appointment, and rescheduled for Tuesday 1/14/13. We are aware of her items and are working with her to resolve them.

I signed a contract with Bailey Homes for a new construction on a house. I was pre-approved by [redacted] for the home loan. During the process of signing the contract I was told that if any problems with the lender in approval of home loan, Bailey homes would refund the $500 that was given during contract signing. We were notified in January that [redacted] made a mistakes on the calculation on the income and were no longer able to provide mortgage loan. This information was given to [redacted] at the time. He now refuses to refund the $500 that was given. Again he said if any issues arises with lending, this money would be refunded.Desired SettlementI would like for [redacted] to be an honest business owner and keep his word and refund the monies that are due to me in the amount of $500.00Business Response [redacted] Homes requires that each buyer is pre-approved for the purchase of a home prior to entering contract. The earnest money deposit of $500 is very minimal for a purchase of this magnitude where the industry standard is closer to 1% or about $2500. [redacted] incurs significant expense to prepare contracts, meet with the client for selections, and other expenses which are only partially covered if the client backs out of their contract forfeiting their earnest money. However, [redacted] works with each client and ultimately hopes to resolve any issues that arise between them and their lender. In this instance the client was never told she could not receive her earnest money back, but she was told that the initial mistake by [redacted] had been worked out and that [redacted] could still qualify her for the home. [redacted] also provided [redacted] written notice of this, [redacted] and [redacted] tried for several weeks to get hold of the client to determine if she wanted to move forward and received no response until this complaint was filed with the Revdex.com. Clearly this is a misunderstanding that could have been resolved if the client returned our phonecalls. Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)[redacted] Mortgage did not say they could approve for a loan after the error was found, in fact [redacted] had me go speak with Shawn at Eagle Home mortgage which told me there was absolutely no way of being qualified. This information was given to [redacted] from myself as well as Shawn. I was told that the $500 would not be refunded, it wasn't until this complaint was filed and that is when I received emails and phone calls.Final Consumer Response Complaint has been resolved with refund
