I have reviewed the offer and/or response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.
According to a written receipt, on 4/6/2014, Bailey's Home Improvement repaired the soffit, fascia, gutter, roof, and sept. flushing (?). At no time during this repair, or any time thereafter (until his response to my complaint), did [redacted] ever make any recommendations for additional repairs/replacement of the gutter or other structures.  Furthermore, he did not stipulate verbally or in writing such conditions as necessary for the success or longevity of his repair.  In fact, [redacted]'s confidence in the soundness, adequacy, and sufficiency of his repair was evidenced by his willingness to extend his customary one-year warranty to a period of two years.  As such, no other repairs or replacements of the gutter or the supporting structures have been made by me or any other contractor.I contacted [redacted] on 3/27/2015, immediately after I noticed that the soffit/fascia/gutter segment he repaired was once again visibly sloping/sagging (i.e., detached), with recurrence of the same symptoms: water dripping out of the sloping end during light rain, and overflowing during heavy rain.  These symptoms were identical to the original problem, which reappeared less than one year after the repair.Over the course of more than 1.5 months of multiple exchanges and attempts on my part to get [redacted] to repair the problem under the warranty, he did come to my residence once.  However, he did not make any repairs, stating instead that he needed to return during rain in order to properly address the problem.  [redacted] has never returned to make any repairs, and has used various excuses and evasion tactics, such as forgetting about appointments, calling to reschedule, failing to appear for scheduled appointments, having to consult with his carpenters, and finally failing to respond to my phone calls and e-mails.  I would like to add that my house was constructed in 2006, and I never experienced any problems with the soffit, fascia, or gutter until spring 2014 when I contacted Bailey's Home Improvement.  There is at least one more house in my subdivision with identical exterior (i.e., the same model), and many others structurally similar, constructed by the same builder, around the same time.  To my knowledge, none of these houses have developed a visible slope in the front portion of the soffit/fascia/gutter.  Taken together, this evidence strongly suggests the absence of any inherent problems related to improper gutter size, or inadequacy/deficiency of the supporting structures.  Instead, it points to a random occurrence of the problem, inadequacy of the original repair, and the need to reattach the soffit/fascia segment.I have attached (1) a receipt I received from Bailey's Home Improvement, and (2) and a photo of the front of my house, which shows where Bailey's Home Improvement performed the repair and where the problem reappeared.At this time, I am renewing my request for Bailey's Home Improvement to make the repair under the warranty.  Thank you.

I have reviewed the offer and/or response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  I think there may be some confusion about the problem itself and what I would like the business to do about it.  To clarify, on 4/6/2014 Bailey's Home Improvement repaired a portion of the soffit/fascia/gutter that was sagging/sloping down in the direction opposite to what it should be.  The business raised the segment to its proper position and reattached it.  This allowed the rain water to properly drain away and into the downspout.  In less than a year, the problem came back: the soffit/fascia/gutter segment is again sagging (please see [redacted] 1 -- house photo).  I am asking the business to redo the failed repair: to raise the soffit/fascia/gutter segment to it s proper position and reattach the soffit.  As part of the contract, this repair is covered by a 2-year warranty (please see [redacted] 2 -- contract).  Thank you.

Perhaps Bailey's Home Improvement is confusing me with another customer. As I have stated previously, [redacted] came to my residence only once (not twice) since the original repair and told me that he needed to return at a later time.  He never did return.  To repeat once again, I DO NOT WANT THE BUSINESS TO REPAIR MY GUTTERS, as they do not need repairing.  What needs repairing is what [redacted] referred to as the framework (segment of soffit and fascia), which supports the gutter.  The business raised and reattached the sagging/sloping down framework last year, and the repair worked well for a while.  After less than a year, the framework started VISIBLY sloping/pointing down once again.  The framework needs to be raised and reattached, so that the gutter which is supported by the framework will once again slope toward the downspout.  This repair is covered under the provided warranty.  Again, there is no need to repair the gutter, only the framework that supports it.  The fact that the business is trying to create a different problem--faulty gutters--which the business has never discussed with me and which simply does not exist, seems to me like an attempt to divert attention from the real problem of a failed repair that needs to be corrected.I have [redacted] a photo showing the segment of the framework which was repaired and which failed.

I repaired the framework on the [redacted] house previously and returned on two separate occasions this calendar year.  The repair I made last year is still in tact.  When I examined the area I found no problem with the repair that was completed last year.  The framework is still attached to the house as required.  The problem now is a totally separate problem then what existed last year and I did not make any repairs the gutters.  The repair was done to the framework, NOT THE GUTTERS.  The current problem has to do with the gutters and I did not repair the gutters last year therefore the gutter problem is not part of the warranty to the framework and I have no obligation to make repairs to the gutters.

Review: In spring 2014, I contacted Bailey’s Home Improvement about a problem that involved sloping down/sagging portion of the soffit, fascia, and gutter on the right side of my house, above the porch area. Because of the sagging, the gutter was sloping in the direction opposite to what it should be in order for the water to properly drain away. This resulted in water pooling and dripping out of the sloping end during light rain, and overflowing and gushing over my porch light and onto the pedestal during heavy rain. On 4/6/2014, [redacted] of Bailey’s Home Improvement and his assistant repaired the problem for a total of $425, with a 2-year warranty on all repairs. They repaired the sagging structure so the water would properly drain away, and sealed the gutter. The repair worked perfectly at first–the problem was completely alleviated. Unfortunately, after a relatively mild winter, the problem returned. The soffit, fascia, and the attached gutter were once again visibly sloping down/sagging. The gutter was once again leaking and overflowing on the sloping end. I first contacted [redacted] on 3/27/2015 to inform him that the problem has returned, and asked him to repair it. Following this first contact was more than one month and a half of multiple exchanges and attempts on my part to try to get [redacted] to repair the problem under the warranty he gave me. Throughout this period, [redacted] has used various evasion tactics and excuses to avoid making any repairs. As of 5/13/2015 there have been no repairs made to my soffit/fascia/gutter. Furthermore, [redacted] has not returned my phone calls or e-mail since 4/28/2015. I have available a timeline of the multiple attempts to schedule a repair with Bailey’s Home Improvement, photos and videos documenting the problem, and a written contract/receipt I received at the time of the repair, in case these are helpful or needed. I would be grateful for any assistance that Revdex.com can offer in resolving this matter.Desired Settlement: I would like Bailey's Home Improvement to make the necessary repairs under the warranty.

Bailey's Home Improvement responded to Ms. [redacted] complaint of a sloping gutter causing rain water to drain over her porch lights. This is a two (2) foot section with an outside mitre where the framing of the two foot section came loose from the brick. In order to correct the problem, we removed the soffit, reattached the framing which caused the fascia and gutter to return to their original place. We also reattached the soffit and we applied a bead of sealant on the end cap of the gutter as a courtesy cautionary measure for the customer's comfort. At the time of the repair, I advised the customer to replace the existing 5" gutters with 6" gutters and 2 X 4 downspouts because her main roof has a 12 X 12 pitch and the amount of rain draining from that pitch is very heavy. The larger gutters and downspouts would be able to handle that drainage properly. I returned to the customer's house in 2015 on 2 additional occasions after the initial repair in 2014. The framing was still intact and there was no sloping. I again, advised the customer to replace the gutters and she said she did that already and it did not work. I cannot understand why she would put up 6" gutters only to return to 5" gutters later. There was no evidence that the gutters had been replaced since my initial repair. It is my opinion then and now that the customer needs to replace the gutters in order for her drainage to be captured by the gutters and run off through the appropriate down spouts.
