October 1, 2017Dear *** ***;This is in response to the matter of *** ***'s complaint against BaSun, Inc.On June 18, at 11:38AM, *** came into the salon and joined our Sunless Club, which allows spray tans a month for the price of $per monthAll of our clubs have a $sifee, and then our clients are drafted through an EFT process on the first of each month thereafter.The minimum draft requirement for all of our clubs is monthsAfter that month time period, if a customer wants to Freeze or Cancel their account, they are required to come into our salon and fill out an Account Change FormAll this information is clearly explained when the customer sigfor any of our clubsAdditionally, as we review the Change/Cancel policy in detail, we ask the customer to initial each statement to make sure they completely understand the membership requirements.On June 18th, when *** joined the Sunless Club, we were unaware that the spray unit was not workingAfter she signed her contract, and paid her fee she went back for a spray tanUnfortunately, the spray unit had a maintenance issue, and *** asked for a refund and said she wanted to cancel her accountMy staff members cannot refund a sale, so my employee told *** she would ask me to cancel the account and send *** a refund checkAs a gesture of goodwill, I was willing to cancel ***'s contract and refund her membership fee, however, on June 25" *** returned to the salon and used her membership to get a spray tanOnce she used her membership, I felt she committed to her contract.*** was only drafted for months, which were July and August; I cancelled her membership on August 14, Per her signed membership agreement, I could have also drafted her for the month of September, but I did notShe committed to a contract and she used our serviceThe fact that she did not continue to use the service does not void the contractI feel I have compromised by not drafting her for all three months.Attached is a copy of her signed and initialed membership agreement and a screen shot of her salon visit historyI hope this information is helpful in resolving this issue.Sincerely,Andrea T.Owner
