Review: My realtor hired this home inspection company on my behalf to inspect a home that I was preparing to purchase. After which and due in large part to the inspection results, a negotiated price was reached. After 2 days in the house I noticed a 7 foot long crack in the tile floor out in the middle of the formal dining room. I contacted my realtor who in turn contacted Baker Inspection Group and they asked if they could come back out and look at the floor again. [redacted] Baker came out looked at it and said “wow I can’t believe I missed that” what would you like to do. I told him I would get estimates for repair and since the negotiated home price was based on the inspection results I wanted assistance with the price for repair. They responded that "the crack was not there at the time of the inspection." When we first learned that the house might be selling we talked to the [redacted] and were invited to tour the home, so we toured the home and snapped some photos. After we discovered the floor defect we called the previous [redacted] and were told that the crack developed shortly after they purchased the home, and that the reason they didn’t disclose it is because it had been there so long that they had gotten so used to it that they forgot about it. When we went back over our time stamped photos we found a picture of the formal dining area that clearly shows the defect. We forwarded the picture to the inspector and were accused of altering the time stamp. Baker Inspections did my inspection missed a defect then accused me of fraud. I realize that mistakes are made but a professional doesn’t fix them by accusing the consumer of fraud. They were very professional to deal with and had no problem accepting our payment, I ask that they continue to act like professionals and be held accountable for their work. Their website states 100% satisfaction guarantee we were instead told This will be the last communication between us. Thank you in advance for any help in resolving this matterDesired Settlement: I feel that they should have discovered this defect so it could have been negotiated in the purchase price. So they should compensate us for the price of repair.

This consumers complaint is not truthful, just like all the emails we have received. You will see with the following emails back and forth that we say the same thing every time and they keep changing their story. First it wasn’t the crack!!! We received this email from [redacted] on 3/14/16 at 11:26 am. This is the most truthful email we received and then they start to not tell the truth. [redacted] and [redacted] ASSURED [redacted] The crack was not present before and didn’t happen while moving. The inspection happens before the client moves in so they state the crack was not there at moving in. Nowhere on any of the disclosures or Agent Visual Identification Disclosures does it say there is a crack in the tile. The agent and client look over the home together. The seller’s agent and client also fill out their own AVID. The question that is asked…do you know of any cracks in the ceiling, walls or floors? [redacted] went out to the property on March 16, 2016 and the first thing that was said to [redacted] was “I KNOW I DID NOT MISS THAT!” [redacted] then said he was going to get an estimate so I reminded [redacted] of the initial email that the crack was not there and it really isnt’ the crack. They are now saying that they have a picture of the crack before the inspection happened. So all of a sudden, they can now produce a picture of the exact crack? They are telling us to do the right thing when they are trying to extort money out of us. They all know as well as we do that the crack did not exist at the time of the inspection.

I am rejecting this response because: I don't accept their answer on this matter because I have proof that the defect was there before they inspected. I paid for the inspection in order to make an informed decision on the purchase of the home. And because they miss the defect it was not negotiated in the price. I sent an email to the address that I was provided with Timestamp photo. They on the other hand They on the other hand have only made accusations of Fraud and extortion. Please rest assured that I will not just lay down and let these people ( Because they own a big company) take advantage of me. Once again I appreciate all the help that you can give in moving this matter forward.

Please see sections four and seven of the signed Agreement.We have also included our Standards of Practice. Please see sections 3.10 Doors, Windows and Interior, Part II The inspector is not required to: inspect for finish treatments…tile is a finish treatment. “this details the extent of our interior inspection”.The Standards of Practice are part of the email we send out with the agreement and a hard copy in the handout we delivered at the inspection.We do this to set the expectations of what is and is not included in a home inspection.You can also see in the 3 pages of the report where we called out problems with leaking gutters. I am rejecting this response because: This so called home inspection company is doing nothing more than using a contract that’s flooded with a lot of words and restrictions that most people read past. Because we as consumers put our trust in a company that supposed to be looking after our best interest. If they want to start quoting text from their contracts then quote this one directly from their web page: Satisfaction Guarantee if at any time during the inspection you are not completely satisfied, let us know and we will either make it right or we will refund the inspection fee. It’s quite obvious that these people are going to continue to evade the fact that they missed a defect that they were paid to uncover. They continue to deny it was there before the inspection, when confronted with irrefutable proof (a time stamped picture and a statement signed by the previous owners stating the crack has been there for years) they throw out accusations of fraud and conspiracy. If they’re such a stickler for contract then at the very least return my inspection fee and I’ll have to live with the fact that their incompetence cost me a couple thousand dollars. Also please record and make a note about how this business has treated us clients.
