The company was supposed to come out on Friday and they never showed up.
I called them today and let them know that the piece that fall off is around the same area of the problem. They have known this for a whole year. I call them from my phone number and they will not answer my calls. If I call from another number, they answer and then tell me they will call back and they don't. They told me today they were coming out. They will say they will come and they never show. I just want them to fix the issue. They are saying I am calling the wrong person but I am calling their main phone number

Our superviser *** has been in contact with the customerAfter calling multiple times last week, the customer called *** today to apologize for not getting back with him soonerHe stated he had been in Hawaii for the past weekHe gave *** the information he needed to come do the repairsWe have him on our schedule to be completed

Initial Business Response /* (1000, 10, 2015/12/03) */
***Document Attached***
I went to Ms***'s residence and inspected the crumbling of the concrete that was installed years agoWithout a doubt the deterioration is due to using saltThe work was completed as per the agreement including
sealantThe failure comes from using salt and the salt eats through the concrete/pavers causing water to pass through the concrete/pavers and eroding the leveling pad thus leading to sinking and extensive moisture under the paversIf the failure was caused by dampness due to lack of sun on the porch and steps as Ms*** claims (which we dispute) I believe that to be a matter out of our control
Thank You,

Initial Consumer Rebuttal /* (3000, 12, 2015/12/03) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Mr *** is being deceitful in his responsesFirst of all HE did not inspect anythingHe sent his project managerFurthermore a porch and steps no matter what it is made out of or what is used on it or if it gets sun or not should be able to withstand all these elements a lot longer than yearsAlso the sealant was never applied because he never returned once I paid the bill as he told me it needed to settle prior to applying the sealantI realize mine was a smaller job but Mr *** needs to be a true Professional and fix the problemsAs I stated in my complaint I tried for over six months to get a responseObviously he had no intention of fixing the problemI paid cash for the job and expected to have the finished product last a lot longer than yearsI will not be silenced or ignored on this matterIf need be I will go to the news stationsAs I previously stated Mr *** is deceitful in response

discuss this matterI will be here today, Friday, July until 2:30;
next week from 11:to 3:Monday through Friday.Thank you07/14/
I stand by the job I did on this and we did a lot of extra work at my
expense. I had my men there for two weeks doing work by hand clearing
trees, brushes and laying sod (these weeks of labor at my expense)We
redid stuff didn't have to (such as the firepit)She wanted the patio
to be perfectly level and I told her there had to be some fall so it
would drainWe ripped up the whole patio and put a drain inAs far as
the firepit is concerned, we took out a nicer one we had installed and
put in what she wantedShe does have a sitting wall-it's between the
columns and is also a retaining wallI also think she is trying to get a
free driveway out of thisWe also took care of the fence issueTrees
are not part of the project but we spent two days in the woods clearing
some not part of our contract - she has a lot of dead trees there and it
is not our fault they fall over. After this experience, our contracts
are a lot tighterI will not set foot out there again - might throw her
a $1,or something to be rid of this.07/20/(received email from *** ***, office assistant, at BusinessPics sent put in library)***,The attorney general’s document is for case number is ***. provided this informationI'm just touching base to let you know that I
am still intermittently working on this complaintI have asked Ms
*** to come up with a list of specific complaints so we can focus on
what she would like to see addressedI have also suggested she obtain
an estimate from a Landscaping Company pertaining to the cost to
complete what she believes was undone or not done correctlyI expect to
have all of that toward the middle or end of next week, will forward it
to you to review, and then await your replyThank you09/01/{email sent by M to B on 9-1-with C's List of Concerns Attached}Hi, ***,Sorry it has taken me awhile to get back with you on where matters stand. After
reviewing the correspondence which the Revdex.com had on this matter before it
was assigned to me for mediation, and from my communications with
***, there seems to be many issues and I felt it would be best for
them to be listed so we could focus on them one at a time and not bounce
back and forth on various mattersI asked her to: 1) Let me
know her issues with the work that was to be done under the $24,
contract (patio, retaining walls, columns, sitting wall, firepit,
removal of some trees), 2) Problems/damages she believes occurred while the work was done for which she has already incurred time and expense
3) Problems/Damages she believes occurred while the work was done for
which she believes she will incur more time and expense in the future. She has taken the time to do that and it is attached for your reviewShe may have things to add to that based on a repair estimate she has obtained. After
getting some clarification about it, I will also be forwarding you soon
a copy of that estimate. It pertains to rectifying what she believes
was done improperly with the retaining walls, patio, columns, sitting
wall, etcI expect that repair estimate to exceed $40,000.00.I look forward to discussing with you your thoughts and position on these matters in the near futureThank you.- 09/05/e mail to B***,Attached is an estimate which Ms***
obtained to rectify what she believes was not done correctly by Baker
Landscaping. In addition to the cost of this repair, she also has the
complaints and requests for reimbursement for damage/problems caused by
the workmen while doing the installation, as mentioned in her List of
Concerns sent in my last email to you.Ms*** says she
has been told that it will be cheaper to tear all this out and start
over than try to fix it; the patio is only sqfeet and not
sqft(to make it sqfeet adds $to the $32,
estimate; = $41,total); the pavers are wavy; the semi circle
walls are uneven (one side longer) and the columns are of different
heights; cornerstone lacking and settling issues; etc.Obviously,
the dollar amount which she believes that Baker Landscaping owes her is
quite substantialAfter you have considered all this, please give me a
call to discuss this (and/or a reply email)thank you. Attachments area09/13/2017 I have talked with *** at *** *** *** (he used to work for us) and I'm not really sure he thinks all of this needs to be replacedHis company is not into repairs and is focused on new workO.K., I'm willing to pay whatever the difference is between a sqftpatio and a sqft.. If she was so upset about this whole job, why did she make the final paymentThis has been going on and on for two yearsThat place is hard to go back to because there is so much there and she does not take care of things. It would be tricky to move the columns for equidistance reasons as moving one of the columns could take up more of the patioAs far as height of columns, looking at the pictures I sent, I believe the three are level and all meet the retaining wall two stones down from the caps. If there is real settlement problems, it would have shown by now as that usually comes up in the first year and we are well past that (there is some warranty on some of that that could be running out)I really do not want to go back there and do anything about the columnsPerhaps an engineer should take a look at the wall and verify no worries about settling and collapsingNo, I won't pay $8,as the difference between a sqftpatio and a sq ft patio. Let me check the bid for the square footage cost. That would be $That's all I'll pay her and I'm done dealing with this10/12/(mediator had left several messages at Mr***'s office since the above PC on 9-and sent two emails; 9-and 10-6-Advised Mr*** his patio calculation appeared wrong and that he should really offer her $not $for the square foot shortage (consumer wanting $20,for all her complaints; patio part of those)The business stopped returning phone calls and emailsAsked him to confirm he was offering $or $Gave him a deadline of today at noon to respond, else close mediation and complaintNo response received as of 2:p.m, so closing)

Complaint: [redacted]
I am rejecting this response because:   This is another one of Mr. [redacted]'s many lies.  What the Attorney General said was: "We have been attempting to mediate...

your complaint with the above-mentioned company.  Since we have been unable to resolve your complaint through mediation, you may wish to consult with a private attorney, or consider an action through small claims court." Mr. [redacted] will say whatever he thinks he needs to say in order to not finish the job he was paid to do.  The man committed fraud when he contracted for a 1,000 square foot patio and was paid $24,000 and only built 684 square feet of patio.  The work was so shoddy and started falling apart within a few months.  I have been trying for three years to get him to finish the work and he refuses to do so.  I have never seen a contractor so shady and lies as much as he does.  He is unprofessional and will do and say whatever he needs to say in order to keep the money he was paid for this horrendous piece of work.   I read another complaint where he said the "sun" caused the lady's porch pavers to sink.  Mr. [redacted] is a [redacted] and a [redacted].  The man should be in jail for construction and/or consumer fraud.
Sincerely,
[redacted]

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me. They only called twice last week. I will hold judgement until they actually come and do what they say they will. I have gone through this process multiple times last year and they never did what they say they would.
Sincerely,
[redacted]

We contacted the homeowner to let him know we haven't received any messages. Determined contact information was for a past employee. Our current project manager has contacted the customer and will address the issue.

6/7/17 9:30Left message for callback6/12/17 9:45The big stone wall is separating , but some stones were doing that immediately after construction. The wall is probably 10 feet by 4 feet and on a hill, so if it slips too far, it's gone. They did not put in a proper foundation or cornerstone during construction. The Attorney General made him replace the firepit and the railing, since the railing was a danger and the firepit he originally installed wasn't matching. The owner tried to talk me out of doing the work the AG ordered Mr [redacted] to do! Mr [redacted] is also claiming that the sitting wall he put in, which doesn't look right, is a retaining wall. It's not!The southeast corner isn't level and has standing water in it when it rains. The tree in the back, that we specifically talked about cutting down and agreed he would haul away, has not been hauled away. I added it in to the contract! Not to mention the contract was orignaly for a 1,000 square foot patio that we both measured--it's only roughly about 800 feet. There was never any reason given for why the patio was smaller--structural limitations or anything. The owner didn't actually come out to the work site after I contracted with him. He sent out other guys, one of whom was drinking on the job. He promised to add to the patio, but has never shown up and is now refusing to haul the tree away or make good on his promise to do good work. I will send photos over of the tree, the separating wall, and the contract showing that I was purchasing a 1,000 square foot patio. If he doesn't make a good faith effort to fix this, I'll take him to small claims court for fraud since the contract was for a specific square footage.6/13/2017:It was a pleasure to speak with you today concerning the matter against Baker Landscaping & Concrete, LLC.I am attaching the following:1.  Contract
(3 pages) (Baker's contract dated August 5, 2014, my signed contract
dated August 19, 2014 (adding in the removal of trees), together with a
copy of my check for the initial
$1,000. (His first contract was for $28,950.00)2.  Copies of E-mails; and3.  Photographs of the patio and surrounding area. (By separate email)  I have many, many more photos if you need anything else.
Beware of Mr. [redacted].  He is a typical [redacted] and smooth talker!  Empty promises as you can see from his many, many emails.I am sorry it  has taken so long but I could not get my scanner to
scan so I had to look everything up on my computer and also had to scan
the contract with my phone.I am so sorry that this is so long but it has been going on for years
and I have so much material to go through.  What I'm sending to you is
only a small part of the entire matter.Thank you for your assistance in this matter and hopefully we can get
it concluded and behind me.  I'm 71 years old and a great-grandmother.
I would like to have peace in my old age - and a nice $24,000 patio! Again, thank you for your help.6/13/2017: Attached are the photographs that I feel will give you an idea of the
problems I have had over the last years with [redacted].   I have many more photographs if you need anything else.Again, thank you for your invaluable assistance in this matter and I look forward to hearing your assessment of the situation.Hopefully, you will be able to assist me in this very trying matter.07/07/2017 (email) Dear Mr. [redacted]:Thank you for your reply regarding my claim against Baker Landscaping & Concrete, LLC.Attached is a copy of the contract that I had with Baker Landscaping
dated August 19, 2014.  I am sorry for the quality of the attachment but
my scanner is not working.  I will mail to you a copy by regular U.S.
Mail.  Is your mailing address [redacted]; St. Louis, MO 63102?The second contract attached dated August 22, 2014 was after I paid the $1,000 down on August 19, 2014 (but was actually emailed to me by Mr. [redacted] on
October 21, 2014).  I paid $1,000.00 down when I signed the contract on August 19, 2014, and paid $8,400.00 on
September 22, 2014, the day the materials were delivered.  Before
the job was finished, one of the workmen told me that "[redacted] said he
needs the rest of his money today" so I sent him a check by the worker
on
October 24, 2014, in the amount of $14,600.00. (I was told by Mr.
[redacted] that the job would take 5 to 7 days and "You will have a
beautiful, big [redacted] patio." - his words verbatim)Hopefully, you can get Mr. [redacted] to
honor his contract by completing the 1,000 square foot patio in a
workmanlike manner and making the needed repairs to the existing portion
of the patio so that it complies with the norms
of the construction industry.
I babysit two of my great-grandchildren on Fridays and Saturdays
during the day.  They live on a farm in Dittmer and I cannot get cell
service out there.  I am retired so I am mostly available the other days
of the week. Please confirm by email your mailing address and I will get better copies in the mail to you right away.I look forward to hearing from you and hopefully getting this matter resolved.Thank you for your help.Sincerely,[redacted]07/10/2017 (email from consumer) Mr. [redacted]:Thank you so much for your help in this matter.  This situation is so disheartening and unsettling to me.   Beware of Mr. [redacted]'s slick promises if he does contact you.  He
promises a lot but does not deliver.  He is nothing but a [redacted] and if
he can get away with something, he will.He kept promising to come back out here and build the rest of my patio and fix the problems - but has done nothing! Please keep me informed of any progress with him.Again, thank you for your much needed help in this matter.[redacted], Missouri 63049 [redacted]07/26/2017  email from consumerMr. [redacted]:Thank you for your response and for your help in this matter.  I really appreciate it.At least one of the pictures he sent to
the AG was not my yard (with the white wooden fence).  I don't know if
he sent that one to you but I do not have a fence around my yard.
Another one he sent them of my back door step
does not show the back door step at all.  The pictures were taken the
day they were finishing the work.  When Mr. [redacted] was out here in June
and measured the patio, he came up with 850 sq. feet - not 1,000 - and
he promised profusely that he was going to come
out and build the rest of my patio and even told me where he was going
to build it on the west end of the existing patio.  But he never showed
up even though he kept promising that he was going to finish it. (I
believe he is stalling until the guarantee on
the workmanship runs out.)  But that does not excuse the fraud he
committed on the square footage.I have not had another contractor look at
the patio.  I did have someone measure the semi-circle because I didn't
know how to measure it.  Mr. [redacted] has never denied the 684 square footage in
my complaints. The guy who is rehabbing the house next
door came over when they were out here the last time because he was
thinking of having a stone wall put in the front yard of his house but
when he saw the mess they made of my project,
he said "nevermind."  And he rehabs houses so he knows something about
construction work.If I need to have someone do a report,
etc., please let me know.  Or if you know someone who does that kind of
thing, please give me their information.I will also be happy to send to you
recent pictures of the retaining wall, etc.  If possible, I would like
to see Mr. [redacted]'s responses to this matter so I can respond to them.Again, thank  you so much for your help with this very trying matter07/27/2017 email from consumer I believe the large grey stone South-facing wall (under the railings)
is what he is referring to as a "retaining wall" although his workers
also referred to the long brown wall around the firepit (semi-circle)
and along the back of my house as a "retaining
wall" because when it rains, the water and mud washes down the hill and
over the wall and onto the patio.  Mr. [redacted] also referred to this
brown wall as a "retaining wall"  when he first came to my house.  When
he referred to a "sitting wall," he pointed to
the area lower around where the firepit would be built and said "There
will be a sitting wall around the firepit to sit on."  June 28, 2016 - Mr. [redacted] did not put in a "new patio."  His workers
pulled up my existing pavers and put some sand under them and laid them
back down and as soon as it rained, they started sinking again.   He
sent 3 guys out here about 12:00 p.m. and
said
they were waiting for [redacted] who arrived about an hour later. On this
June 28 visit is when he kept pushing me that the new fire pit would not
be as big as the one I had and that it was cheaper (although he charged
me $1,200 for it) and that I should keep the
one I had and I kept telling him that I wanted the one that matched the
patio and the one that I had paid for.I really felt he was trying to intimidate me to keep the other
(wrong) firepit.   I also showed him the large grey (retaining) wall
that was separating
and the long piece of material hanging from the semi-circle, and other
matters.  When we got to the driveway, I told him that I had called
[redacted] and they had marked the utility lines on the West side of my
house because I wasn't sure when he was coming to
build the rest of my patio or where he was going to build it and he
said "I'm not!"As he was getting in his truck, he said "I'm not fixing your driveway either - it's in the contract."
 He left in a huff!
He did not send any tools for the guys to work with.  One had a long
knife, one had a small device about the size of a screwdriver with a
wire brush on it and one used my garden trowel to pull up and knock the
sand off my existing pavers.  They left about
4:30 p.m.  I was out of town the next 2 days so I do not know if they worked or not.  July 1, they brought some sand and laid some of my pavers back down.
July 5, they took out the old (cheap) fire pit and installed the drain July 11, 2016 - They worked on the patio pavers.  Said they were waiting on the railing. From July 11 to August 17 I believe there was no work done.
August 17 - (Approx. 5 weeks later) I was babysitting my
great-grandchildren in Dittmer and when I got home the railing was in.
As soon as it rained, the corner where they had just put the railing
and pavers in started sinking. From June 28 to August 17, 2016, (almost 2 months) by my records, they worked approx. 33 hours.August 18 - They mowed the lawn which I did not ask them to do,
planted some grass seed which I did not ask them to do, and cut down the
12-foot stump they had left standing in my yard after cutting all the
branches off. They had no way of hauling the cut
up pieces so they are still in my yard.  They also got into one of my
flower beds and cut down two Astibule plants with a weedeater (which I
did not ask them to do! :).  I'm just shaking my head!  It was like a
segment of the [redacted]!   The bottom of
the stump from the 12-ft stump with roots still attached in the ground
is still in my yard. They said they did not have any tools to take it
out. They still have not removed the tree that they took down in the back
yard and is still laying in my side front yard.  I have pulled off and
burned most of the limbs they threw across my neighbor's fence and
they pulled the fence to the ground.Mr. [redacted] only put in a new railing, new firepit, and drain because
the AG made him do it.  He was not about to do it until they told him
despite his many, many promises to do the right thing.  Like that other
complaint to the Revdex.com, the lady said she has
never seen such a dodgy contractor!  I agree with her absolutely on
that!Baker was out here before and I told him that water was standing
on the patio every time it rained and turning to green slime.  He said
"Maybe I can put in a 'bucket' drain." But he never did anything about
it until the AG got involved in the matter.  The
railing was a dangerous situation.  I have small great-grandchildren
and the little girl was born with cancer in both eyes and had to have
her right eye removed in January.  I could not have her walking around
that patio when she could walk through those railings
and fall to her death on those stones. Either one of them could have
cut themselves on the railings where they had cut them too short and had
razor sharp edges. Also, on the semi-circle, the column on the East wall is 34 inches
tall (without the topper), the center one is 32 inches and the next one
on the West side is 30 inches tall.  There is 12 feet between the East
column to the center column and 10 feet from
the center column to the West column so the center column is off by a
foot and the columns are off by 4 inches in height on one side.I have pictures of the columns and firepit and grey wall on my phone.
I will try to get them downloaded to my computer over the weekend or
onto a disk.  I babysit in Dittmer on Fridays and Saturdays for my
great-grandchildren.I am trying to contact someone to give me a bid on fixing the patio.  Maybe also someone from [redacted] to come out.I am sorry for the length of this email.  I promise the next ones
will be shorter but I thought you should know what I have been dealing
with.  It is very disheartening to pay your life savings to someone for
this kind of work.  All I wanted was a beautiful
patio that I could enjoy.  I am embarrassed for anyone to see this
mess.  I'm 71 years old and I am tired of dealing with Mr. [redacted]. Thank you for your help and again sorry for the length of this email. 08/02/2017 {Important email from consumer that provided a listing of all complaints, as requested by mediator. Content put in "Library" as her "List of Concerns" and was emailed to business}08/24/2017 email from consumer Mr. [redacted]:I am sorry for the delay in getting the estimate to you but the
company I had has notified me that they are unable to do the estimate at
this time.  However, they did give me the name of another company and I
have an appointment with them for next Thursday.
I also have a company that is supposed to be here today but I have not
heard from them to confirm or as to what time they will arrive.  I
assume Summer is a very busy time for construction companies and I
didn't want you to think that I have given up on this
matter.I have also been getting bids for taking down a very large oak tree
which is leaning toward my house.  I have a bid from one company to
also haul away the tree left in my side front yard by Baker.  They will haul it away for $450. (Estimate attached).Again, I am sorry for the delay but it was very unexpected after they
spent so much time measuring and going over the patio.  They did say at
the time that the patio is "very wavy."   He also said that the sand
and rock underneath the pavers is deficient
because there is not nearly enough of either sand or rock and that is
why the pavers are sinking and unless it is done properly, they will
continue to sink. They also said that the entire floor of the patio will
have to be taken up and redone. When he asked me about what kind of drain was in there, I showed
him a picture of the drain before it was paved over and he said that the drain would
have to come out.  I don't know exactly what he meant by that.
After that, I went in the house and let them do their work.As soon as I get the other estimates, I will send them to you.Mr. [redacted]:
This morning I met with  [redacted] from [redacted], Inc., and went over the problems with my patio.
He asked me who did the work and I told him that I would rather not
say and he asked if it was just a landscaping company or someone who did
other stuff and I told him landscaping and concrete and he asked if it
was Baker because Baker is about the only
one that does landscaping and concrete.  He said he used to work
for Baker years ago and that [redacted] is a friend of his but he said
he is not going to call [redacted] about this.
He said the patio has too many problems to fix them individually and that he would have to tear the
entire patio (walls and floor) out and build it new because with
all the problems it would be too labor intensive and trying to repair
it would be even more expensive than tearing the patio out and starting
new.  He said it would probably be more than
the original $24,000 because he would have to tear out the existing
patio and rebuild it from scratch.08/30/2017 {email from consumer}Mr. [redacted]:This morning I met with  [redacted] from [redacted], Inc., and went over the problems with my patio. He asked me who did the work and I told him that I would rather not

asked me what the stones are supposed to be and I told him [redacted] and
he said the stones in the wall are
not [redacted].
He said they are [redacted].  He said there are no [redacted] distributors in St. Louis and they are all in the East.   He said he  has no idea what the
floor pavers are.He said the semi-circle walls around the firepit are uneven (one side
is longer than the other side and this makes the firepit look off
center) and the three columns around the firepit are three different
heightsHe said the back step is built incorrectly and is separating and he
would never have put in that type of step back there.  He said it is
just glued together. He also said that the large grey wall does not have a proper
cornerstone at the bottom at the corner.  He said he does not know why
they didn't put one in because the three stones above it are
cornerstones.  He said he doesn't know why the grey wall (East
facing and South facing) was not made of the same stones as the rest of
the patio.I told him that one guy had told me that there was 4 inches of sand
underneath the pavers and he told me that there should never be more
than a half inch of sand and that there should be (I think he said) 12
inches of rock.  He said that is why they are
sinking and they will continue to sink.He told me that he would talk to his boss and discuss what would be the best solution and would be in touch with me.I'm worried that he may not carry through with the estimate because he is a "friend" of [redacted].  Thank you for your patience08/31/2017 emails from consumerMr. [redacted]:Attached is the email and the attachments I received from Mr. [redacted] of
[redacted], Inc.    If you are not able to open the
attachments, please let me know and I will mail them to you.  These are
in .pdf so they may be easier to open.  I have
asked Mr. [redacted] to also send to me the sketch of my patio that he did
while he was here yesterday.  I will send it to you upon receipt from
Mr. [redacted].Re: Fw: Estimate [redacted] from [redacted], Inc.
Mr.
[redacted]:Mr. [redacted]'s estimate only covers tearing out and rebuilding the 600 square foot patio that Mr. [redacted] built in my yard.  The Baker patio contract was for a 1,000 square foot patio.  Mr. [redacted]'s contract does not address the
cost of the remaining 400 square feet of patio for which I paid Baker and he never built. The remaining 400 square feet of patio is a serious issue which must
also be addressed with Mr. [redacted].  That is a large section of patio.
That is almost half of the 1000 square foot patio for which I paid him.
Additionally, I contracted for the patio to be built with [redacted]
stones and pavers and Baker installed [redacted].  I was never informed of
this switch.  This is another issue to be addressed with Baker. As I understand Mr. [redacted]'s proposal, it is: The $19,477.00 is for tearing out the old retaining wall system and installing new walls
and columns around the patio. The $13,021.00 is for removal of the pavers (floor of the patio) and install a new patio floor of 600 square feet.  He did not give me a bid on the remaining 400 square feet of missing patio.  Total - $32,498.00 for 600 square foot of patio floor and walls. Then the remaining $500 is for drawings, permits, grass seed, etc.Total
- $32,998.00 and I will still only have a 600 foot patio - not 1,000
square feet called for and paid for under the contract.Additional costs to me:There are 7 sono tubes at $20 each. Also additional cost to have someone else take out and reinstall the railings.
Thank you for your assistance in this matter.  It is greatly appreciatedMr. [redacted]:
Attached is the drawing Mr. [redacted] made of my patio when he was here
yesterday.  I think it will give you a better idea of what the patio
looks like.  I know it is probably hard to imagine when I talk about the
"semi-circle, the large square area and the long
part along the back of my house."  Also, is an estimate as to what it
will cost to build the additional 400 square feet of my patio -
$8,656.00 for a total of $41,654.00.
Where he has marked "foundation" is my house.  The patio runs along
the back of my house.  The patio ends at the West end of my  house.
Where he has written -13- is where the large grey wall is located and
faces South.
There are three columns around the semi-circle/fire pit and the
fourth column is at the west end of the long wall running along behind
my house.
I hope this helps09/01/2017email from consumerMr. [redacted]:I just got an email from Mr. [redacted] and he said he does not mind you sending his estimate to [redacted].  But Mr. [redacted] would rather that [redacted] not know that I told him that Baker did the work originally. Thank you. 09/25/2017 email from consumerMr. [redacted]:Thank you so much for your help in this matter.  I do not remember
anything about the amount in dispute being $10,000.  If I did, it would
have been
before I was told that Baker only built a little over half of the
patio and pulled a bait and switch on the stones.  This matter has
dragged on for years and Baker did such an  unprofessional job that according to Mr. [redacted]'s
estimate, the entire patio cannot be repaired and will have to be torn down and rebuilt from scratch. However, in a good faith effort to
resolve this matter and Mr. [redacted]'s criminal conduct, Baker will refund
to me $20,000 and Baker can keep $4,000 for the cost of the materials.
I believe $4,000 is a high end estimate since
Mr. [redacted] said he "has no idea what the floor pavers are" - so I am
assuming they are neither [redacted] nor [redacted] because Mr. [redacted]
immediately recognized the wall stones as being [redacted].I believe this to be a very generous
offer considering that  he only built half of what I paid for and the
workmanship is so shoddy it has to be redone and also considering the
damage Mr. [redacted]'s workers did to my yard, driveway,
trees and other personal property and the time, labor and money I have
spent on this matter and cleaning up his mess he left behind.Thank you again for all the work you have done on this matter. 10/11/2017 email from consumerMr. [redacted]:Thank you for your continuing efforts with Baker.  The contract price
and the amount I paid Baker was $24,000 - not $12,000.  If he is not
willing to correct his fraud, he will leave me with no alternative but
to contact the Prosecuting Attorney.  Mr. [redacted]  is a [redacted] and as the one lady said in her complaint "I have never
seen such a shady contractor."   He should not be allowed to run around
the state cheating people out of their life savings.  I will also be
sending Mr. [redacted]'s estimate to the Attorney General
so they can re-open the case against him.As I previously told you, I talked to an attorney and he said that if
I sued  Baker, I would probably be left with a "dry judgment" and a lot
of attorney fees. Please let me know by your deadline (Noon on October 12) Mr. [redacted]'s final position10/12/2017 Well, I am not surprised he did not contact you by the deadline you gave him. I understand without his participation, which has been lacking for quite awhile, mediation cannot proceed any longer. I will probably reopen my complaint with the Attorney General's office, and go see the Prosecuting attorney. I have considered suing, but, my tax lawyer who used to be a litigator said Baker's LLC probably has no assets. I did not want to settle for the $3500.00 (or $4800.00 if he had calculated correctly -not surprised he never called you back and clarified). My offer was $20,000. I'm not quitting on this. Thanks for all your hard work.Show details

Initial Business Response /* (1000, 10, 2015/10/20) */
This homeowner said it was okay to go on their driveway because they were replacing it anyways. Now, they want a whole new driveway through my insurance company. We got a company over there last week, Wednesday or Thursday, and they completed...

the asphalt job for them. We would have never went on their driveway if they said we could not. We only did because they said it was okay. It is not right to try to do this and get a free driveway. We have repaired this & it is done with. Thank you.
Initial Consumer Rebuttal /* (2000, 12, 2015/10/21) */
(The consumer indicated he/she ACCEPTED the response from the business.)
Where to begin? I've seen more accountability from ten year olds. First off, I never once gave them direct, written or oral, consent to use my driveway. I certainly never told them that my intentions were to get a new driveway. I never even talked to anyone from their company until they damaged my driveway. Even then, trying to get ahold of [redacted] was next to impossible. Never have I dealt with a business owner who was so dodgy. This should give a clear representation of how he operates. He knew he was culpable and didn't want to do anything about it and made it obvious he hoped I'd be silent and forget about it and it'd go away. I managed to only get two conversations from him after a month of trying to get ahold of him. The second time I talked to him was only after I sent an email to him stating that I had sought legal counsel and intended to protect my legal rights in this matter. Somehow he was able to find five minutes after receiving that email to call me to inform me that he was planning on coming the following week to make the repairs. The repairs we agreed upon were to have him fix what he damaged, not to replace the whole driveway. (Reference my filed complaint) He said he'd call me back to schedule a time to do the work. I called him back a couple hours later and got his voicemail. I left a message to say that we should meet in person at my house to go over exactly what needed to be fixed so that there was no misunderstanding. He did not return that call. I called him the next day and left a message. No response. I called and left messages for the next week- nothing. My final call and message was informing him that he had until the end of the next day to call me back to schedule a time to meet, otherwise I'd move forward filing complaints. No response, yet again. Therefore, I filed a complaint. After the complaint was filed and sent to him, he initially had until 9/30/15 to respond. No response. Somehow that got pushed back to 10/1. Then to 10/16. Very indicative and telling of his unreliable nature as I'm sure he was getting extensions instead of dealing with the matter at hand. Lo and behold I come home from work on 10/15, the last day before he had to respond to my complaint, and I notice work had been done to my driveway. Never once was I contacted that this was going to take place. I was shocked. Again, very demonstrative of his evasive ways of conducting business. The fact that he can't even return my calls and only takes action after the threat of legal recourse should tell any prospective customer that they aren't forthright and could care less about customer satisfaction. The repair work done was done so haphazardly. Obviously it was done quickly with inferior asphalt. The work didn't even fix all the gouges and cracks in my driveway. Had he taken some responsibility and made time to meet with me in person, let alone return my phone calls, he could've known exactly what needed to be repaired as opposed to just making guesses. Buyer certainly beware. I didn't even employ his company and this is the treatment I get after they destroy my driveway and try to tell me it's my fault. Terrible customer service at Baker Landscaping and after seeing the construction of my neighbor's retaining wall, seemingly terrible at that, too. The thing isn't square and wavers substantially, but that's not my problem. If we're really getting into this, during construction their laborers took it upon themselves to sit all throughout my front yard to take their lunch break. They also trampled over some of my landscaping causing a section of lily turf, or monkey grass, (whatever you'd call it) to die. I had to take it out. Several braches of my Japanese Maple were also broken as the laborers completely disregarded my property. Not only that, they said they'd clean up their mess. I found numerous pieces of trash in and around my property when they left. These things I never mentioned to him as I was more concerned about having my driveway repaired. But since he's making the claim of somehow me being the bad guy, I need to paint a clearer picture of how this guy operates. Completely and totally unprofessional. Next time they decide to use someone else's property to complete their work, I suggest actually talking to that person instead of making second handed assumptions. I'm only accepting this response from the business so I can get them out of my life for good. Good riddance.
