Mr [redacted] has CONTINUALLY delayed his payments, which are clearly spelled out in our written contractNot only did he agree to the original proposal, which he signed, but he also wanted to add a second egress window, to his basement project, which is no problem. We started his project, on March 11, by loading building materials into his basementOn March & 13, we framed his basement, and even accommodated some changes to the original floor planThe basement is now ready for electrical and plumbing contractors. My excavator and egress window installer are reluctant to perform at this project, because they are aware of his unwillingness to pay on time, per our contract.Mr [redacted] STILL has an unpaid, and overdue deposit of $3,which was due on March 11,

I'm not about to enter into a public "gossip-fest" with this homeowner. He has obviously ignored the fact that he is NOT holding up his part of a legal, written contract, which he has signedHe has not made ANY payments, since we met, which weren't "altered" by the homeowner. He has not complained about our quality of materials, nor workmanshipWhen we decided to start the project, he was totally fine with us starting inside the basement, as opposed to starting with basement windows. When my workers "altered" his floor plan, during construction, the homeowner was present, and approved, and consented, to the changesIn fact, he remarked, to me, that he could now have a bigger, better shower installed. There were delays, beyond our control: building permit approval, weather, extreme cold, secondary calls to *** *** - because homeowner wanted an additional, 2nd egre** window added to his contract, and the most recent, is when this homeowner chose window wells on *** website, which clearly states they are a 2-week delay for deliveryetc. This homeowner's overdue payment, is what is referred to, in our contract, as "1st payment upon start of work", which he will either acknowledge, or notI have the signed contractHe owes us $3,435.57, which was due weeks agoHe has the option of abiding by his contract, arbitration, mediation, or civil court

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below
Mr*** did not offer any sort of resolution or compromise, but instead attacked K&L Properties of Appleton LLC as well as other companies which have nothing whatsoever to do with this issue Locy Electric LLC and Clean Cut Maintenance LLC are separate entities and are not involved in this situation, nor should they beThe only real issue is the $1,down payment made by K&L Properties, which Mr*** is now apparently refusing to refund MrBaldwin's company was unable to perform the work in a timely manner, and the company did not purchase any materials or incur any other out of pocket costs Therefore, the down payment should be refunded in full to K&L PropertiesIt is clear from Mr*** response that the parties will not be able to work together K&L Properties has retained another contractor to do the work, and Mr*** is unable and unwilling to do the work and had not started or incurred any expensesThe document signed by K&L Properties did not include any anticipated completion date, which is an essential term of the contract Assuming the parties had a binding contract, *** Building Improvements has not honored that contract, and K&L Properties is under no obligation to pay them anything and is entitled to have the full down payment returnedIf Mr*** is willing to sign a mutual release and return the down payment we will consider this matter closed

I'm astonished, that this contraption/business.....  Locy Electric, Clean Cut Maintenance,  or K & L Properties...... ( whoEVER they are ) has chosen to air their mis-fit dirty laundry, via the Revdex.com website."They" are NOT a customer, and NEVER WILL BE. "They" tried to re-write MY...

company's Proposal, several times, which, of COURSE.... is NOT ALLOWED."THEY" also tried to impose, a "FINE", for days pursuant to a timeline, "THEY" tried to impose, based on "THEIR" timeline... of course, based on "THEIR" attempt to re-write a proposal, given, to them, and THEY failed to send documentation, payment, etc.....I'm awaiting to hear from "THEIR" attorney, as promised / threatened.... ..... but, as I imagined, the Revdex.com website, is free..... for  her, to plan an internet diatribe. As usual, ALL of my statements, cellphone records, emails, date/time stamps on my digital camera, calls to building inspectors, P.O.D.S. container rental, MENARDS, ABC SUPPLY, etc.... can be sublimely PROVED !!!If this complaint, goes any further, I won't hesitate, to inform BAY Insurance, Wisconsin D.S.P.S, phone calls from the building inspector, my own insurance company, etc.furthermore, this "company" did NOT hire another contractor.,  also pretended to hire "in-house" workers, etc  I BAILED the out, with their insurance, who CANCELLED them !!   .

Mr. [redacted] has CONTINUALLY delayed his payments, which are clearly spelled out in our written contract. Not only did he agree to the original proposal, which he signed, but he also wanted to add a second egress window, to his basement project, which is no problem. We started his project, on...

March 11, by loading building materials into his basement. On March 12 & 13, we framed his basement, and even accommodated some changes to the original floor plan. The basement is now ready for electrical and plumbing contractors. My excavator and egress window installer are reluctant to perform at this project, because they are aware of his unwillingness to pay on time, per our contract.Mr. [redacted] STILL has an unpaid, and overdue deposit of $3,435.57 which was due on March 11, 2015.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
This is not a "gossip-fest".  I am stating the actual facts. I have over 70 pages of e-mails and documentation backing up my statements.  [redacted] can not provide any backing for any of his statements because he knows they are not true.  [redacted] is trying to cover up for him breaking the contract on several levels, not providing the services he promised, and not telling the truth on many occasions. He has also tried to alter what items are included in the contract for 4 different areas of the project.   In response to each of his previous statements please see below:  [redacted]s comments about my payments are again an out-right lie.  When I agreed to go with his proposal he rushed over to my home on the same day (Jan 14).  I asked if I could date the check for the next day as I was moving funds from an investment account.  He said it might push me back on schedule if I couldn't give him something that day.  So I gave him a check on Jan 14 for $2,000 which he cashed within an hour.  I also gave him a check on Jan 14, dated for Jan 15, for $2,500 which he cashed on Jan 15.  The second payment was due when [redacted] started work.  On Feb 18 he started demanding the second payment and promised to start on Feb. 23.  By this time, I had been informed by other people he previously worked with that he wasn't paying some of his employees and sub-contractors.  I discussed this with [redacted] and he accused me of questioning his integrity and honesty.  I agreed to make 1/2 of the second payment based on his promise to start on Feb 23.  He agreed and said (in an e-mail) that the 2nd half of the second payment would be due when excavation and concrete cutting were completed.  I gave him a check for $3457 on Feb 18 and he cashed it the same day.  He never showed on Feb. 23 and then only did framing on Mar 12 & 13.  No work was ever done on excavation or concrete cutting so I didn't make any additional payments until those services were provided and because of the lie he told to get me to give him the $3457 in the first place and then didn't start until 3 weeks later.[redacted] broke the contract when he did not provide service with three days of Feb 17. Then, based on a promise to start on Feb. 23 he conned $3,457 more from me. He never showed on Feb. 23 saying it was too cold and when asked why his guys didn't just start framing he said it didn't make any since to do that before the windows were installed.I did make a complaint to [redacted] about the workmanship. His guys framed the wall inbetween two bedrooms 1.5 inches past a post. The post will now be in the way of installing drywell in that area. When [redacted] was told of this he just said "we will figure something out".  As to his statement about me being fine with him starting framing first, this is also untrue, since he had been saying all along the windows must go in first.  After his guys stopped framing on Mar 12 I asked when the windows would be put in.  He said excavation would be on Mar 17 and concrete cutting and finishing on Mar 18.  More lies, as no one showed up on either day.The "altered" floor plan [redacted] is referring to was a mistake made by his guys.  Rather then having them tear it down and start over I made the best of it and made adjustments with our plan.  [redacted] trying to take any credit for this is truly incredible. The building permit delay was fully caused by [redacted].  When I signed the contract on Jan 14 he said he was going to start working on the permit right away. He told me at least two additional times that he was working on it.  He never actually completed and submitted the permit application until Feb 18 which was after the contract start date. When [redacted] did finally start the project is was Mar 11 and he only did partial framing for two days. Doing the framing first was in direct conflict with what he told me on Feb 23 when he said he didn't make any sense to do the framing until the windows were in.On Feb. 18, [redacted] indicated they had a ticket open with [redacted] that would be effective at 10:00 Feb 23. This ticket ended up expiring because [redacted] couldn't find any excavators that would work with him due to his past history. [redacted] stated on seven different occasions (between Feb 7 and Mar 4) that the excavator would be coming to my home to look at the site or start digging.  No one ever showed up for any of the dates until Mar 11 and then that was just to look at the site.[redacted] was informed of the desire to add a second egress window on Feb 16.  He said no problem.  I then provided him with the window wells I was interested in from [redacted] on Mar 16.  [redacted] claimed he checked the webstite and they were in stock.  The fact was they were never in stock and they had to be special ordered.  Another out-right lie by [redacted].  When he couldn't find the wells I wanted I compromised again and agreed to use wells that he could find in stock.Below are copies of full e-mails exchanged between Feb 18 & Feb 23.  They confirm his promise to start on Feb 23 and  his agreement that the 2nd half of the second payment was due when excavation & concrete cutting had started.[redacted] <[redacted]> Feb 18to me Hi [redacted], Inspector is satisfied, with everything.I also called [redacted], so they can do the backyard, and front, again. We can "officially" start, next Monday. Extra window is $2,371.14 and "starting" payment is $4,500.00 for a total of $6,871.14. I want to give a substantial amount, to [redacted], so we can get on his excavation schedule....... which is open, at the moment. Do you have a "final" size of bathroom? When I spoke with inspector, this morning, I told him approx. 6' x 10' ? Regards, [redacted] <[redacted]> Feb 18to me Hi [redacted], Let me know when is a good time to pick up check.... If you need me to hold it, overnight, like last time, no problem. I think we'll bring materials, when the basement wall is cut open, so we don't have to go through the house. [redacted] <[redacted]> Feb 18to [redacted] Hi [redacted],I am anxious to get this project started, but I'm not comfortable with providing another check without some work being started or at least materials on site. The bathroom size you indicated is close.  I think it will be more like 6x9.I am fine with bringing materials through the house in order to get started.I would be happy to provide a check for 25% of the extra window cost (approx. $600) now and the remaining amount for the second payment when the project starts. Thanks![redacted] <[redacted]> Feb 18to me The attached Certificate of Survey, was provided to me, by [redacted] of the [redacted]I am assuming you don't have a copy, so I am providing one, for your homeowner records. It appears to be dated:May 08, 1994..... Hi [redacted], While I understand your hesitation, I'm not sure my honesty, integrity or professionalism should be questioned, because of an "anonymous note" left at your residence.  Our normal payment procedure is to obtain a 50% deposit, upon acceptance of a contract, but when jobs are scheduled more than 30 days in advance, we split this into an "earnest" deposit (25%) to guarantee our futurequota of a fulfilled work calendar. This assures my men that they will stay busy, and assures a steady income stream, for myself, and my business. The other 25% is due when all permits, drawings, etc., are completed, and my crew is ready to proceed with a given project, and deliver materials to a jobsite, and get started. Also, in our signed contract, is a provision which says, in part: " Any alteration or deviation from above specifications involving extra costs, will be executed upon written order, and will become an extra charge over and above the estimate ".This would, and does apply, to your 2nd window. As stated in my earlier email, the total for the extra window ($2,371.14) and the 'start' payment due ($4,500.00)is a total of $6,871.14.As a gesture of flexibility, I would be willing to accept 1/2 this amount, now, and the other 1/2 next week, when we start excavating, and cutting out the windows.   I sincerely hope that this offer will be acceptable to you, so we can move forward. $3,435.57 due now....$3,435.57 due next week I have done everything promised, thus far:Showed up, on time, to perform your free estimate.Returned for a follow up visit, to discu** floor plan options.Provided you a legal, written proposal / contract, with start dates, and payment schedule.Had my insurance company issue you a valid, current Certificate of Insurance.Maintained verbal or written dialogue, with you, to finalize options / floor plan(s).Submitted necessary drawings, and permit application, to the Little Chute Building Dept.Submitted location request to [redacted] (today)Adhering to promised start date of Feb. 17th ( plus or minus 3 business days ) as per our contract.I also allowed you to split your initial earnest deposit into 2 separate checks, and delayed deposit on one of them. As always, please feel free to call. Regards, [redacted]Baldwin Building Improvements[redacted] <[redacted]> Feb 18to [redacted] Hi [redacted],My hesitation to write out a check for $6,800+ had nothing to do with the issue involving the note.  I consider that to be a closed issue and I was satisfied with our conversations about it.  I also was not questioning your character and I apologize for not indicating that in my previous e-mail.  I would be hesitant to have over $11k tied up with any busine** venture in which I have not received any materials or services.I am fine with meeting half ($3,435.57) way on this.  Let me know when you want to pick up the check and I will have it ready.  I have the full amount of the project in my local accounts so no need to worry about delays in cashing my checks.  Thank you for your consideration about this and your flexibility with the initial payment.I am looking forward to getting this project started and working with you further. Thanks and have a great evening.
Regards,[redacted] <[redacted]> Feb 19to me Hi [redacted], Thanks for the clarification. I wasn't quite sure of the reasoning behind your previous email. I understand that all homeowners desire value, and safety, for their dollars, and can appreciate you wanting to be careful with your finances. You will find that I'm a pretty straightforward contractor, and everything we do is always in writing. This protects both of us. It's not only the law, but good business practice. If early afternoon, today, works for you, I can stop by, at that time. I want to go over a few things, with you, regarding the basement layout, before I go get your building permit.Hopefully my excavator can start Monday/Tuesday.[redacted] Ticket # [redacted] won't be valid ( diggable ) until 10:25am on Mon. Regards, [redacted]Baldwin Building Improvements [redacted] <[redacted]> Feb 22to me Hi [redacted], I've been looking at next weeks weather, and the overnight lows are too cold to install egress windows. The sealer we use to "caulk" the windows to the basement concrete, the adhesive we use to glue the window wells, to the basement, and the waterproofing, to coat the outside of the basement walls, will not adhere, (cure) with the expected temperatures. For the best results, I advise that we wait until the overnight low temperature is at LEAST 20-25 degrees. Otherwise, the windows, wells, and waterproofing will probably fail, and I don't want to risk that. Call me tomorrow, and I would be happy to explain alternatives, product limitations, etc. Regards, [redacted]Baldwin Building Improvements[redacted]Email: [redacted]Mobile: ###-###-####Internet: www.baldwinbuildingimprovements.netA+  Rated Business - Wisconsin Revdex.comWisconsin State Licenses: # 18569 &  #18570 VETERAN OWNED BUSINESSCommercial Insurance Policy: Employers Mutual CasualtyPolicy # 5D12956  [redacted] <[redacted]> Feb 22to me [redacted] <[redacted]> Feb 22to [redacted] So will the framing start tomorrow?Sent from my Galaxy S®III[redacted] <[redacted]> Feb 22to me Doesn't really make sense to start framing since all 3 exterior walls have either window cuts, or floor cutting, for plumbing.Sent from my Verizon Wirele** 4G LTE smartphone [redacted] <[redacted]> Feb 22to me [redacted], also forgot to mention, building permit has not been approved yet. It will be MUCH quicker / easier to load lumber through the window openings, in the basement. It's a pretty tight turn at the bottom of your stairs, and if we load through the window openings, there is no chance of banging drywall, paint, etc.... I would expect to have the building permit in the next few days.As I said, earlier, I turned in the site-plan, bldg. permit application, and egress drawings, last Thursday afternoon, after I left your house. I think I sent you copies.... if not, let me know, and I'd be happy to send.[redacted] <[redacted]> Feb 23to [redacted], I have a call into the inspector to check on the status of the permit.  I am feeling like you played me last week and I gave you a check in good faith and now I am getting a lot of excuses.  You originally told me you could do the basement and then have the Windows cut later if necessary.  Now you are telling me something different.  It is going to be very cold for the several weeks.  I am not willing to wait that long for you to start when you told me you would start last week and then gave assurances you would start tomorrow at the latest.  Its funny that you didnt mention any additional delays last week when you wanted more money from me.  There is a lot of room in the basement for materials.  I dont want stuff in the garage until you have workers on site.    [redacted] <[redacted]> Feb 23to me I have NO problem with you calling inspector. It will only VERIFY what I told you.I was hoping for 2 days ( in a row ) where it would be closer to freezing. We can cut concrete ANYTIME, but to install windows, properly, I would prefer to wait. You are also forgetting that [redacted] locate ticket won't be valid until tomorrow, late morning. Would you like to verify that, also? The ticket # is:[redacted] <[redacted]> Feb 23to [redacted] You told me last week the diggers ticket was valid at 10:30 this morning.  If you are not starting by tomorrow I would like my check back from last week.[redacted] <[redacted]> Feb 23to me Actually, you're correct. I didn't look at the date, today. Ticket was valid after 10:25am, today. As soon as I get building permit, we will start bringing materials, the following day.If you have issues you'd like to discuss, please give me a call. I don't always have time to type on my cellphone, especially while driving.Permit was approved on Feb 27.  No materials were brought over until Mar 11.These are facts!  I have over 60 pages of e-mails confirming everything I have indicated about [redacted].  The public needs to be warned about this contractor.[redacted]

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
Mr [redacted] is again lying.  My first payment to him was on 01/14/2015 which I split into 2 checks because I was moving the funds from an investment account to my checking account.  [redacted] cashed the first check on the same day it was given to him and the second check on the following day.  The second check was issued on Feb 18 which he cashed on Feb 19.  He obtained this check by providing false information and promising to start my project on Feb 23 (He never started until Mar 12).  After he cashed the check he informed me it would be too cold to dig and it didn't make sense for him to start framing until the windows were cut.  He never started framing until Mar 12 and has absolutely nothing with getting the windows ready for cutting.  The accommodation he indicates about the framing was actually my accommodation.  His framers made a mistake and built the bathroom wall too big by 2 feet.  Rather than force them to tear it down and move it I agreed to allow the adjoining closet to be moved over by 2 feet.  Due to his deceitful practices I am not making another payment to him based on his promises.  I am not willing to wait another 3 weeks after writing a check to him to get service.  The excavator [redacted] references stopped by my home on Mar 23 and is unwilling to do any additional work for [redacted] because he has not been paid for the last job he did.  I have contacted 2 other contractors about this situation and both say he has no reason to be asking for any additional money due to the lies he has told, missed promised start dates, and the fact he has only worked for 2 days out of the 37 since the project was suppose to start on Feb. 17.  They both said he is the type of contractor that makes other contractors look bad.  Ask [redacted] to prove anything he has said about this complaint and he will not be able to.  I have written documentation (copies of e-mails) about all the statements I have made.Regards,
[redacted]

Review: In early March of 2012, [redacted] came out to give me an estimate to have a garage addition put on. While that was in the works, trying to figure out based on the survey of the land if there was enough room to build from the lot line, I had him come to my house to take measurements to have interior hollow core doors replaced with 6 panel doors. At the time of this visit, I paid him $289.49 ($256 cash and $33.49 in [redacted] rebate checks) to apply towards the purchase of three 6 panel doors and a bifold door for our main level bathroom, closet, basement entry, and closet doors. I was going to purchase the doors myself, however at the time of the visit, he mentioned that he was going to stop at [redacted] on his way home and would purchase the doors and had the knowledge of what to look for in terms of grain and making sure the door was a quality door and could purchase them for me so I gave him the funds to do so. On March 19th, he sent via email, a copy of the receipt from [redacted] stating that he had purchased the doors. Several emails (of which I have copies of) went back and forth trying to establish a time for him to drop the doors off (he set it up that he would drop the doors off and stain them in my basement) before installing them..... several emails and excuses were exchanged as to why he couldn't deliver the doors.....working in [redacted] one week, [redacted] the next, 3 ongoing jobs, cash flow tied up, being rained out, funds at the bank being held, to his truck getting broken into..... While these emails were being exchanged, he claimed to have also lost the receipt and it took several months for him to resolve the issue with [redacted]. On September 27, 2012, he emailed me stating that he found the receipt....that the doors were purchased on 4/22/13 for a total of $304.60 (even though the emailed receipt stated a date of 3/19/12). After several more failed attempts to have the doors delivered and by this time, well over a YEAR later, on May 10, 2013, I emailed asking if my husband and I could buy the doors to get the process going and he confirmed on May 15, 2013 that he could reimburse me with a check. SEVERAL email exchanges took place and another EIGHT months later, I still have not been reimbursed the funds that I gave to him in March of 2012. At one point, I received an email from him (after sending an email asking for an update and that it was getting awfully frustrating), he responded to me stating,

Frustrating?!

Like the 3 or 4 "free" estimates, I did, for your house.....

• 2 "free" estimates, in the winter, for a garage addition

• 1.... or 2 .... "free" estimates, for your doors....which changed

• a second/repeat visit, for the kids room/ pushing back the bathroom wall

• another "free" estimate for the cathedral livingroom, for stone finish.....

[redacted] and [redacted]..... I'll return your money, as soon as possible. This refund is LESS than $300....

I came out, willingly, measured, and paid, for doors, with a mix of cash, and [redacted] rebates, PLUS an additional $30-ish dollars out of my pocket.

You wanted me, to "hold off", for a bit...before delivering the doors.... no problem.

I lost... ( my foreman lost ) the receipt, after 6 months.

Stop treating me, this way.

NEXT TIME, GET ANY ESTIMATE, FROM ANY CONTRACTOR, FOR WORK YOU WANT DONE, WHEN YOU WANT IT DONE....

I know it's late, but I'm tired, and insulted..... gimme a break..... !!

A few emails, including an apology was sent after this email, promising the return of my money. I have YET to receive my money. [redacted] has my money, they are tied up on a receipt at [redacted]. He is the only one to my knowledge that has access to these doors. I have sent 5 emails asking for a status update, all of which have gone unanswered.

Please advise if my further action requires to submit through small claims court if the Revdex.com can help resolve this issue.

Thank you,

[redacted]Desired Settlement: I would like cash/cashier's check for the total of $289.49, the amount paid to him in February of 2012 for materials never delivered as promised.

Response:

I met these folks almost 2 years ago. I visited their home 4 or 5 times, for "free estimates" including a detached garage addition, an attached garage addition, interior door replacements, moving a bathroom wall, a stone veneer wall in their livingroom, etc..... We were never hired to do any of the work, although we were led to believe we would be.....

While we offer free estimates, to our customers, we were repeatedly called to provide estimates, for a variety of projects at their home. We were never hired to do any actual work.

We are willing to provide a refund, for doors that were never installed, nor delivered. Had the homeowners accepted delivery of the doors, when originally purchased, we wouldn't be having this conversation.

However, we did spend approx. $30.00 out of pocket, to purchase doors/jamb kits, and it would be nice to have the homeowners acknowledge the trips & time we spent at their house, with no work ever being performed.

Is the homeowner willing to partially re-imburse us for fuel costs, and 8-10 hours spent at their home, for non productive, numerous estimates?
