As we indicated in our earlier statement, the grading and drainage plan for this property is the one described in the engineer’s overall drainage plan for the development and compliant with MSD, the appropriate county oversight agency We met with MSD last week at the property and MSD agreed that the drainage and grading were in compliance with the plan

We have met with this customer on several occasions to provide an understanding of the drainage plan for his property, and address his concerns. This yard is intended to drain toward the front of the lot, and not toward the drainage ditch in the area behind the customer's yard.
This is documented in the drainage plan for the subdivision, and a copy is provided with this reply. To address the concerns about drainage and water in the yard, we have reviewed the photographs submitted by the customer of the yard during heavy rain, which confirm that it is carrying runoff appropriately. We also reviewed the yard on 2/27/18, hours after unusually heavy rains, to check for standing water as defined in the warranty guidelines. The yard was not retaining standing water, and we have photographs of the yard at that review to document our response. One of those is provided with our response. Due to upload space limitations, the others are available as neededAs we have communicated to the customer, the engineering-designed drainage plan for this property and surrounding ones is compliant with MSD, the appropriate third party county oversight agency. We have encouraged the customer to contact MSD to review the original plans and investigate any concerns about grading and compliance. As of 3/12/18, the appropriate manager at MSD verified that the customer has not made contact.We understand that setting accurate expectations is important to customer satisfaction, and we have worked to do so. At the time of contract, we provided the customer with a written Surface Water and Drainage Disclosure regarding storm water runoff and drainage considerations for his and all lots in that section of the development. We also met with the customer on 10/9/16, shortly after he contracted to purchase the home and prior to starting home construction, to review the homesite together. The drainage plan was in place on the lot on that date, during home construction, and prior to closing. These documents are part of our customer education process, and are signed by the customer. Copies are provided with our reply From a warranty perspective, the 2-Warranty stipulates that within hours following a rain there will be no standing water. As described, we have reviewed the yard and found no standing water and no sign of sod damaged by standing water. It should be noted that the Surface Water and Drainage Disclosure states that the conditions specific to this section of the development actually override 2-Warranty expectations. However, the drainage is functioning within warranty expectations.We have worked to assure that neighboring construction does not adversely affect the customer's yard and will continue to do so. As the yard is compliant with the approved drainage plan for the lot, which is working as intended and meeting warranty guidelines, we must decline the request to make changes to the grading or drainage

I'm sorry as I put the incorrect year as I was in hurry and frustrated as I was filling this out I have multiple pictures and have talked to the *** inspector for my area and he said he didn't care what we had Also I was never told they wouldn't fully sod my yard as promised when buying the home It is completely unacceptable what they are doing over sodAlso the whole area isn't the easement as I have pictures to prove this I feel misled on this and as I have read online and heard from my neighbors I'm not alone I made purchase of my life with this company and when I bought the house there was no sod and I was told the WHOLE PROPERTY would have sodIt's extremely difficult to maintain this area as it is weeds and rocks and I'm concerned it could effect the easement in a negative way As I mentioned the whole part that wasn't provided with sod is not an easement I have called, sent pictures, and done everything in my power to get this resolved in a fair manorI'm not looking to get anything for free, just what I paid for Please help me Last but not least other homes in the neighborhood next to ours (also built by BALL HOMES) have sod near easements I can provide pictures for that as well

[Provide details of why you are not satisfied with this resolutionPlease respond here ONLY]the response says they have met with me several times that is not true I met with *** *** at my walk thru before closing and addressed this issue with him he told me they would grade more on the back part of the property when we returned from closing the sod was down and he didn't grade any on the property so I called tina with ball homes and she talked with *** and he said he would be over to work on yard *** brought the guy over to do the grading and showed him what to do then they told me they were going to grade the lot beside me for their closing first so I said ok then after that *** told me he would do my lot when the house on the other side was done so when that lot was done I called because nothing was done to my lot and get a response of everythig is fine and they were not going to do anything.as far as the water discloser we were told that was for if you build down in the court it holds water in the street and for the home sight review all we did was measure the lot with our realtor and thier was a constrution fence anout feet into my lot not back on the outside of the lot and the grass was tall and from what I remember there was not a big berm or a swell as they call it in the back it was flat thats why I picked that lot they can say whatever they want but at the end of the day *** *** knows he told me he would fix it and I even have a saved voice maill from tina saying *** *** is going to your yard to fix the problem with the water in your back yard and he never did what he said he was going to do and didnt tell the truth to his manager to save his butt so if I ever exted my patio it will be under water every time it rains because its like a creek in the middle of my yard I get drainage from the two houses beside me then it dumps in the neighbors yard on the other side of me then my yard is soggy and lumpy for days

We received your email regarding this complaint. Thank you for its prompt

We are aware of this complaint. Over a period of several years, we have gone
over and beyond what we were obligated to do, and spent much time and...

effort, trying
to address it for these customers. In that regard, I do note that we feel
the complaint submitted is disingenuous and inaccurate in several
respects, including the statement that the house was built and purchased last
year. The house was built and sold to them in 2012.
In short, we sodded the yard as provided in our contract with
these purchasers. Prior to closing, our supervisor on that build went over
several times with the purchasers exactly where the sod would and would not
be placed on the property (including at the final inspection prior
closing), and the sod was installed as described. We asked them multiple times
over the years for them to show us exactly where we have failed to properly sod
pursuant to the contract and they have refused to do so. It appears that what
they really wanted was for us to sod the side of fairly heavily-sloped
drainage easement swale that is located towards the back of their lot (which
was in place well before they contracted to build/purchase their home, and is
behind the privacy fence on their lot). Again, this was not provided for in the
contract and we were not obligated to do so, but we nevertheless offered several
times to seed the area with grass seed. However, each time we attempted to gain
approval from the Louisville Metro Sewer Division were told that because of the
nature and characteristics of the swale we were not to disturb the established ground
and the existing grass/vegetation on that bank.  
We very much value each and every one of our customers, and we often
try to go over and beyond what we are obligated to do to try and satisfy their
desires – as we did here.
