We agree with the customer that she has struggled to make payments on her loan However, the bank worked with this customer despite the fact that the loan matured in September, and one of the two parties on the Note/Mortgage did not sign the extension of the Note Also, loan payments and real estate taxes had not been paid In order to get clear title from either of the owners, foreclosure was the only action to take because of the various judgment liens on the propertyYet the Bank still made arrangements with the customer for her to make weekly payments of $ These payments were to go into a savings account in her name to be held as “good faith” payments, so that after the Sheriff’s Sale, the Bank would be able to refinance the note in the customer’s name only By October, 30, 2015, the customer had withdrawn all of the funds in cash from this account In September, 2015, the customer did bring in checks and releases from the insurance company for payment to two contractors for the following repairs: (1) emergency tree limb removal and (2) repair to woodstove which sustained damage from the tree limb The first check was made payable to the customer and her estranged spouse The second check was made payable to the customer, the estranged spouse and the woodstove repairman The customer informed bank personnel that her estranged spouse was not going to endorse the back of the checksShe was insistent that she needed the funds immediately to pay the contractors The concern from the Bank was the fact that without getting the signature from the estranged spouse, the insurance company would not honor the checks and the customer would be out the money Therefore, the checks were deposited and held in the customer’s escrow savings account until the checks were cleared from the bank In the meantime, the customer informed the Bank she was withdrawing the funds from her personal savings account to pay off one of the contractorsShe would reimburse the personal savings account with the funds from the insurance checks when they have cleared the bank It should be noted the estranged spouse came to the bank two weeks after the checks were deposited into the escrow account and could only sign the releasesThe checks from the insurance company cleared the bank on October 30, The Bank was researching the best way to reissue the checks so as not to cause any further issues for the customer Again, our concern was for the customer and the situation was remedied when we reissued the checks payable as they were originally issued by the insurance companyThe checks were mailed on November to the customer by certified mailIn conclusion:1) Our decisions were made based on the information provided by the customer.2) The dates the customer claimed she had no heat had record high temperatures of almost degrees on November and almost degrees on November 3) When the checks from the insurance company were cleared by the bank on October 30, the funds were returned to the customer on November Our checks were cleared by the Bank on 11-17-and 11-23-and were endorsed by all parties named on the checks [redacted] *** [redacted] ***NMLS ID # [redacted] Branch ManagerBank of Mauston - Dells Delton BranchCounty Road AWisconsin Dells, WI 53965Phone: 608-253-7030Fax: 608-253-9255Email: [redacted] Website: www.bankofmauston.com

We agree with the customer that she has struggled to make payments on her loan. However, the bank worked with this customer despite the fact that the loan matured in September, and one of the two parties on the Note/Mortgage did not sign the extension of the Note. Also, loan payments and real estate taxes had not been paid. In order to get clear title from either of the owners, foreclosure was the only action to take because of the various judgment liens on the propertyYet the Bank still made arrangements with the customer for her to make weekly payments of $200.00. These payments were to go into a savings account in her name to be held as “good faith” payments, so that after the Sheriff’s Sale, the Bank would be able to refinance the note in the customer’s name only. By October, 30, 2015, the customer had withdrawn all of the funds in cash from this account. In September, 2015, the customer did bring in checks and releases from the insurance company for payment to two contractors for the following repairs: (1) emergency tree limb removal and (2) repair to woodstove which sustained damage from the tree limb. The first check was made payable to the customer and her estranged spouse. The second check was made payable to the customer, the estranged spouse and the woodstove repairman. The customer informed bank personnel that her estranged spouse was not going to endorse the back of the checksShe was insistent that she needed the funds immediately to pay the contractors. The concern from the Bank was the fact that without getting the signature from the estranged spouse, the insurance company would not honor the checks and the customer would be out the money. Therefore, the checks were deposited and held in the customer’s escrow savings account until the checks were cleared from the bank. In the meantime, the customer informed the Bank she was withdrawing the funds from her personal savings account to pay off one of the contractorsShe would reimburse the personal savings account with the funds from the insurance checks when they have cleared the bank. It should be noted the estranged spouse came to the bank two weeks after the checks were deposited into the escrow account and could only sign the releases. The checks from the insurance company cleared the bank on October 30, 2015. The Bank was researching the best way to reissue the checks so as not to cause any further issues for the customer. Again, our concern was for the customer and the situation was remedied when we reissued the checks payable as they were originally issued by the insurance companyThe checks were mailed on November to the customer by certified mail. In conclusion:1) Our decisions were made based on the information provided by the customer.2) The dates the customer claimed she had no heat had record high temperatures of almost degrees on November and almost degrees on November 12. 3) When the checks from the insurance company were cleared by the bank on October 30, the funds were returned to the customer on November 11. Our checks were cleared by the Bank on 11-17-and 11-23-and were endorsed by all parties named on the checks. Review: 2014 I filed for divorce Struggled making payments, but communicated with the bank. Missed one full monthly payment in may of this year I called [redacted] of the dells/Delton branch left message telling her I would pay 200 a week till I got caught up.never heard anything back.In July I got a letter stating they were foreclosing and had a 200 cashiers check refunding my last payment.so from here we had a deal that I would put 200 in savings each week and at auction, bank of mauston would by the property back then refinance it to me Well In the meantime I had storm damage this summer I pay for my own homeowners insurance. When I received checks I took them to the bank and left them there to be signed by the bank and my soon to be ex-husband. When my ex went into sign the checks they would only let him sign the releases which was sept 23.So talked to [redacted] said I would pay 820 to one business and when check cleared it would go back into my savings. Well that never happened.[redacted] took the checks and put them into escrow. For the last 2 months I've tried getting that money from escrow to finish paying everyone. They refused In fact one message left on my voicemail by bank president, Robert fait, stated that they somehow had to recupt some of there money. I informed him that money was not for the forclosure it was for damage on the property and that I pay for this not the bank.My insurance company got involved also. Telling the bank they had no rights to this money. It was one lie after another from [redacted] and [redacted] fait One check was to fix my Woodstove. Which is my only heat source. both [redacted] and Robert were aware of this.Beginning of this week I started having problems with my Woodstove. Sometime during the night on Nov 11 it quit working. Made calls to both [redacted] and robert telling them the issue and that I needed that money put back in my acct. I get a call from Karin at dells bank telling me they would be sending the checks.I did get them today, but have to have them all resignedDesired Settlement: I think [redacted] meyers, bank of mauston and robert fait should have consequences for what they did. Holding money that didn't belong to them. We went 2 days without heat. It took me 2 months to finally get the money.
