Hello,I am in the accounting department of Bank Transactions, Inc., and I amresponding to a complaint from Western Medical Training Center dated11/7/2016.Part of what they said in their complaint is true, and part is notBy ourcalculations, Western Medical Training Center owes our company
$1,330.83.We have sent them a demand letter through their attorney and have notgotten a responseWe are in the process of referring their case to legalcounsel for further action.It is true that we were providing them with credit card processing fortheir in-office and online businessesHowever, we were not loaning anymoney to their studentsWe would check the students' credit, and if theyhad good credit, we would tell Western Medical, and they would make acontract with the student that the student would pay a small amount permonth or bi-weekly to attend their classesWe would then buy the contractfrom Western Medical and advance Western Medical the money for thestudent's class(It's a subtle difference, but importantWe do not andcannot loan money to consumers.)What actually happened is the following:1. Bank Transactions, Inc(BTI) began processing credit cards for WesternMedical Training Center (Western Medical) in November In March 2016,Western Medical had four batches processed on a certain day, but onlythree showed up in their bank accountThe fourth, the “missing batch”,was for $1,950.00.2. BTI wired Western Medical $1,on 3/15/as a courtesy advanceon the missing batch, to be returned to BTI when Western Medical receivedthe missing fundsWestern Medical received BTI’s wire on that same day.3. BTI repeatedly requested bank statements from Western Medical so thatwe might help trace the missing batchWestern Medical refused to providethose statements, finally providing them to BTI three months later in JuneThose bank statements showed that Western Medical had received$1,of the missing $1,on the day after they received the$1,wire from BTI(The reason Western Medical didn’t receive thefull amount of $1,was that there was a problem with one of thedeposits in the batch in the amount of $500.00, so the credit cardprocessor was forced to deduct that amount from the batch.)4. Instead of immediately returning BTI’s good faith advance of $1,950.00,Western Medical and owner Yousaf Farook attempted to defraud BTI and keepthe advance.5. In a separate incident, the first retail finance contract BTI fundedfor Western Medical was for student Tracy HunterBTI sent $1,toWestern Medical on behalf of Hunter on 11/11/Hunter promptlydefaulted on her agreement and never made a payment to BTISeveral BTIemployees contacted Western Medical soon after the funds were sent toWestern Medical to inform Western Medical that the student had defaulted.BTI employees requested that the classes which the student had purchased,and which had not yet begun, be withheld from the student until paymentarrangements could be made with the student.6. No action was taken by Western Medical on BTI’s behalf, and the studentwas provided with the classesIn Section on page of the RetailInstallment Contract, the Buyer (BTI) may require the Seller (WesternMedical) to reimburse to Buyer the outstanding balance of the Contract,and may charge back the outstanding balance of the contract to the Sellerif a billing dispute is not resolvedThis situation clearly falls underthis section.7. Finally, a free credit card processing terminal was provided to WesternMedical when they signed up with BTI to do their credit card processing.As part of that agreement, Western Medical agreed to process credit cardswith BTI for three years, or if that agreement was cancelled sooner thanthree years, Western Medical would return the terminal to BTI within 14daysWestern Medical stopped processing credit cards through BTI and keptthe terminalThe agreement provides that, in this situation, the merchantwill be charged $for the terminalThus Western Medical owes BTI anadditional $995.00.8. Until Western Medical’s credit card funds were withheld by BTI, WesternMedical owed BTI a total of $4,($1,for the advance,$1,for the Tracy Hunter contract, and early termination charges of$for cancelling their credit card processing services with us beforethe completion of three years.) BTI repeatedly reached out to WesternMedical to resolve these issuesWestern Medical and Yousaf Farook refusedto respond.9. On September 12, 2016, BTI withheld credit card funds from WesternMedical in two payments, one for $2,and the other for $200.00,totaling $3,144.17, as a partial recovery of the funds owed to it.10. The current balance owed to BTI by Western Medical is $4,-$3,= $1,330.83.Western Medical and Yousaf Farook have breached Western Medical’scontracts with BTI on several different occasions and have attempted todefraud BTIBTI has every intention of pursuing the balance they areowed.Thank you for attempting to act as an intermediary in this matter.Sincerely,

Bank Transactions, Inc told me they had shipped the terminals over night on 11/18/2016. I ended up receiving the terminals a week later on 11/25/2016. Which is definitely not overnight shipment or the best communication with Bank Transactions.

In the meantime I emailed Bank Transactions a closure of account notice. Eventually I was able to get a hold of [redacted] at customer service and she had closed my account.Bank Transactions, Inc Charged my Bank Account $995 per machine. Total of $1990.00. As I mentioned above the Terminals were returned to Bank Transactions in a timely manner as stated in the addendum. There was No Damage to the equipment as stated by [redacted] since Bank Transactions knew the Terminals were never used.I have attached proper documentation to prove my claim. The issue was for $25 Dollars. But once the account was closed by Bank Transactions they retrieved their machines in immaculate condition and yet charged my account $1990 for the equipment that they retrieved. According to Bank Transactions, Inc Addendum that [redacted] is talking about, It clearly states to return the machines within 14 fourteen days of account closure. [redacted], Sales Representative of Bank Transactions had retrieved the machines.

We received the complaint issued by the merchant and are actively trying to reach her to resolve the issue. The merchant sent in a cancellation on 03/08/2016 asking to cancel due to high rates. The fax was then followed up with a phone call where she was told that she would be issued a refund. The...

merchant was given information on getting a new terminal and agreed to keep the services. We did not receive any follow up from the merchant asking to cancel after that. We spoke to the merchant and were trying to help her get cancellations and fees back from another processor which kept charging her. On May 12, 2016 we again received a fax which requested us to cancel the services again. We issued a cancellation the same day we received this fax. Because the cancellation was done in the middle of the month the merchant was hit with additional fees which we fully plan on reimbursing the merchant. We would like for this complaint to be wiped from our account being that we were under the impression the merchant no longer wished to cancel. When we were made aware that she in fact wanted to cancel we cancelled the account right away and are reimbursing her for the excess fees that were charged.

This merchant is completely off.  They were shipped a terminal and immediately shipped another before his business began operations.  He must have some sort of disorder.  
 
He stopped using our terminal and owes us money.  We may or may not purse legal action.  If the Revdex.com would like or anyone would like more information, please let us know.

In response to merchant’s complaint, there was no written request for WI-FI terminals on the original merchant application we received on 11/07/16.  We deployed (2) terminals on 11/15/16 and arrived at the merchant’s business location on 11/18/16. The sales representative informed us later that afternoon that the terminals need to be WIFI terminals and he made a mistake by not writing the WI-FI request on the merchant application.  The sales representative said the merchant needed terminals by 11/21/16. We immediately responded to this request by ordering WIFI terminals, we informed the Sale Representative that we had  to special order the WIFI terminals and due to the holidays and weather alert that there could be a possible delay in receiving the terminals by 11/21/2016.
To expedite the request we did overnight WI-FI terminals they were deployed on 11/23/16 and arrived 11/25/16/. Ms. [redacted] Business Manager returned merchant’s call on 11/26/16. He complained that he was unhappy with the service and that he do not receive the WI-FI terminals on 11/21/16 as he expected.  He said he wanted to be compensated for the inconvenience.  Ms. [redacted] told the merchant that she apologized that the terminals didn’t arrive on 11/21/16.  She told him that Bank Transactions did everything in good faith as a company to get the WIFI terminals to him by 11/21/16 but do to the special order request for the WI-FI terminals, server weather conditions and Thanksgiving holiday it simply was not possible.
Ms. [redacted] stated “that WI-FI terminals request was not written on the original application…we value your business and unfortunately due to unforeseen circumstances the terminal could not arrive on 11/21/16. Ms. [redacted] told merchant that he has now the WI-FI terminals were his procession and he start processing. “ The merchant said he wanted to cancel, therefore, Ms. [redacted] referred to Customer Service for account closure procedure.

Review: We canceled services with this company in Oct. 2013...They kept taking fees out. I contacted them they told I needed to return terminals. I returned them and they continued to take fees out totaling about 194.00 each of the 3 acoounts.

contacted again they told me I needed to send a letter of cancellation I sent it and In May they took about 19.00 out each account. I called them again they told me accounts were closed and they did not know why that happened and they told me they were going to reverse the amount...they never did. This morning there is an attempt to debit 4,558.85 from one account 5343.00 from another account 1477.57 from 3rd account. I have gone to the bank to put a stop on these transactions they told me they could not stop them since they were already going through, however they will be returned since there was not enough money in accounts but I was going to get charged a return fee.Desired Settlement: Refund all fees taken out from October 2013. And discontinue any future unauthorized fees.
