Complaint: I am rejecting this response because:The plans sent on 5/13/was a design created by N [redacted] that was a basic kidney shape pool with a spa (nothing like the lagoon style pool we requested) N [redacted] and I spoke a few times between 5/13/and 5/31/14, then I went out of the state Upon returning around 7/1/14, I contacted N [redacted] again to request an update on the pool plans and was told N [redacted] was still working on it It wasn't until 8/30/that N [redacted] sent an email with the same plans he originally sent to us on 5/13/(NO CHANGES WERE MADE) The attached email Wisby references was sent by me to N [redacted] on 9/4/and started with the following..."Thank you for sending, although it doesn't seem right A Baledge was added on the right side with stairs coming off the corners, and there was supposed to be a seating area to the back left by taking coping away to make way for a planter near the spa Also want to confirm that there is NO beach entry."The above passage clearly indicates that NO CHANGES WERE MADE to the revised plans that were sent I sent another email to N [redacted] on 9/13/with additional pictures of what we wanted following a conversation between us earlier in the week to ensure I got my point across regarding the pool design I followed up a few times by phone with no responses and then gave up N [redacted] finally called me on 10/13/and left a voicemail I responded same day via email message stating “I received your voice mail and wanted to thank you for your effortsWe have decided to go with another pool company that fits our needs.”Wisby/N [redacted] maintain that they revised the pool plans but no revisions were ever received other than the plans first presented on 5/13/ No work was performed which warranted a $cost, therefore, I request a refund Regards, K [redacted]

Complaint:
I am rejecting this response because: Allstate has not responded to the additional information I have provided in an attempt to remedy this matter between us. I am still seeking a refund of the $that was paid, as no revised plans were ever produced by company even though they claimed to have continued working on it

I can not respond, due tothe advise of our attorney Allstate Pools & Spas has malign and subject to libel on yelp Allstate is seeking damages and will require legle remedies

On April 16, 2014, K[redacted] entered an agreement with
Allstate Pools to develop plans for a swimming pool at 10906 Canby, Northridge,
CA. for the sum of $1500.00. (Non-fundable Check # 1009, dated 4/16/14, for
design for plan).
On May 9, 2014, Jay N[redacted] paid a visit to...

K[redacted]’s
residence and presented the plans and computer generated pictures of their
swimming pool designed by a computer technician.  Mr. N[redacted] also presented a proposal for
the amount of $49,676.87.    K[redacted] wanted to change the beach
front.  On or about 5/13/14 we sent an
email with the attached 8 pictures of the poo design with the change.  Mr. N[redacted] left several messages with K[redacted],
but never heard for them until Aug. 30, 2014, when he received an email stating
that they never received the pictures.   Mr. N[redacted] resent them another email with
the attached pictures.  
On Sept.13, 2014, K[redacted] sent an email attaching swimming
pictures.  “I look forward to seeing what
a $29K free-form pool with Baja looks like”. 
Mr. N[redacted] had the computer technician develop a new plan and sent
them the new plan.  Mr. N[redacted] called
several time and on 10/13/14 the K[redacted] sent an email message stating “I
received your voice mail and wanted to thank you for your efforts.  We have decided to go with another pool
company that fits our needs”
K[redacted] is now asking for a refund.  No refunds is due to the K[redacted], as
we provided several designs and fulfilled our agreement.

This our response in
order of complaints:
1-     
Mr. B[redacted] did negotiate the price for three
months as he finely explained before the third and final plan was finished,
that his budget was $130,000.00 for the pool project.  We designed a pool that cost...

$125,251.00
2-     
Regarding the spillway bowels, they were not
plastic, but made of granite like resin. 
The bowels were not what Allstate expected and they were removed from
the job site.  Allstate installed two faux
boulders with copper scupper Mr. B[redacted] was very happy according to his
text.  This costs Allstate three time the
cost of water bowels. Why Mr. B[redacted] complained about this item is very confusing
to Allstate Pools.

Regarding the excess time building of the pool.  The permits took 2 months, due to Mr. B[redacted] removing
20 tree (most of them were on the neighbor’s property) without getting approval
from the City of Glendora and next door neighbor.  We started the pool excavation, plumbing, steel,
gunite, coping and faux grotto in workman like manor, however, Mr. B[redacted] wanted
to install paver decking in the front of his house.  We were waiting for his decision and finely  
He decided to change the decking completely
to a special stamped concrete.  He also,
wanted a plan for landscaping, in which, our associate R[redacted] spent a
month and a half creating 3D designs and a Video.  Mr. B[redacted] finally approved the plan on May
30, 2015.  Allstate completed all the
decking and landscaping.  After a week
delay because Mr. had not completed his fence and gate requirements, we plaster
the pool on Aug. 15, 2015.  Mr. B[redacted]
never complained about the time it took to complete the project.  I receive a text from Mr. B[redacted] “Oh wow just
got home. Awwwwwesome!!!!!”  He also text
“So peaceful back here.  Make the last
year of struggle all worthwhile.”

Regarding payment for permits.  This stated in Pool, Spa Grotto. Proposal.  It clearly states under Permits the
following: “Expediter fees and city fee not included” Mr. B[redacted] furnish all
checks to the building department and paid the expediter without any complaint.
5-     
Regarding the tile.  Mr.  B[redacted]
choose the tile from the Universal Tile book. 
The tile was delivered to the job site. 
While setting on the job site it rained and ruin all the boxes.  Mr. B[redacted] thought that the rain ruin the
tile; however, rain cannot ruin tile, because rain and pool water are always touching
the tile. Allstate warranties the tile for 3 years.  Allstate has installed tile in over 4,000
pools and never observed any damage by rain water.  Why would we put in tile that could be damage
by water?  We gave Mr. B[redacted] credit for
the tile he purchase and removed the old tile from the job site.  Allstate could not get their money refunded from
the supplier, because the boxes were damage.
6-     
Regarding the controller to be installed on his
iPhone.  This item was not written in the
contract.  Mr. B[redacted] stated this was promised
by Jay Nudelman. I do not know if this is true or not. However, Allstate worked
this out with Mr. B[redacted], that he will pay for the device and Allstate will pay
for insulation.
7-     
Allstate includes 28 days of star-up service to
make sure if there is any issues with the project.  Mr. B[redacted] complained about one jet and one
bubbler was not working.  These items
were already repaired.  R[redacted]
met with Mr. B[redacted] and when over every item on the pool and landscaping.  The certified pool Startup man will explain
how the pool works and program his iPhone.
8-     
Allstate never received any complaints from Mr.
B[redacted]’s neighbor.  According to Richard
Babcock, the neighbor only complaint was about Mr. B[redacted] putting plants on her
property, but Allstate was never rude to her.

The customer has agreed to pay their final payment to Allstate Pools, therfore, Allstate will make the repairs
