I am the President of Banton Construction I have owned and operated the Firm for over years and originally founded it in I was not aware of this situation and I will immediately research it with my personnel involved with the project It would never be our intention to leave a situation that is not per code or incorrectly finished in any way We do have situations with insurance jobs where the insurance company is only willing to pay for certain work and the homeowner is left with the decision to pay for the additional 'desired scope' This however, appears to be an issue that would go beyond that Once I look into this matter I will follow up with additional information ***

years. Upon further research with my people I confirmed the following. Clearly this is something that our people missed in the estimate and was not paid for by the Insurance Company.   However, this is our issue and not that of the homeowner. We have no problem taking care of the insulation scope. I believe that [redacted] who oversees our Restoration Division will be contacting you immediately to schedule the work. Ms. [redacted] I apologize for any inconvenience.  I only wish that it had been brought to my attention sooner.    [redacted]

Review: In August of 2012, I contracted with Banton to perform mold remediation in my attic. They quoted me a price and stated that they would subcontract with [redacted] to handle removal of the insulation and removal of the mold on the surfaces in my attic. They were also doing other work for my house for an insurance claim, through my insurance company. We agreed on a price and they began work. My house is two levels and the attic is accessed from two different places. Banton's project manager oversaw the [redacted] work, which consisted of sealing off the bedroom which contained the access to the lower level of the attic, removing all insulation from the lower level, then cleaning the mold from that level, plus repeating the process for the upper level. This took place over several days. After [redacted] finished, the Banton people came in and replaced the insulation, plus cut soffit vents around the lower level of the attic, as it had none. They then finished the insurance work and I subsequently hired them to remodel my bathroom. The lower level of my house has been cold ever since. I have stage 4 colon cancer and my health is not good. When it started to get cold, I asked a friend to go up in my attire to see if I needed additional insulation in my lower attic. He discovered that there was NO insulation in my lower attic. After [redacted] removed it, Banton never replaced it. Further, the insulation in my upper attic was only partially installed and was not secured in any way. I immediately contacted Banton, who sent [redacted] out to inspect the attic. He noted that there was no insulation and that I needed insulation in the entire lower attic. He went back to Banton to check their files. His response was that their estimator (who is no longer with them) failed to include the cost of re-installing the insulation in his internal estimate, so they will not come finish the work unless I pay them more. They contracted with me to remediate the mold in both portions of my attic, oversaw [redacted] removal of the insulation and mold in both portions of my attic, drilled vents around the lower portion of my attic, and I paid them in full for their work. They neglected to reinsulate the lower portion of my attic and are now trying to charge me additional money to do so.Desired Settlement: I would like for Banton to install the same insulation in my lower attic as they did in my upper attic, plus finish the missed areas in the upper attic and make sure that both levels are properly installed and attached, as agreed to and paid for.
