BAR Electric was hired to do the electrical work for our new car dealership building in ***. Throughout the project, all their invoices were paid. They failed to pay their suppliers. Now *** (a materials supplier) is threatening to lien the property due to non-payment and *** is threatening similar action because they were not paid either. Other issues may arise during the statutory lien period.
We still have some money due us on retainage on this project, this money can be applied to the supplier when it is released.
Some of the invoices on the court filing have other projects (no ***) included in the amount, that should not be for ***, and we'll try to deal with those separately.
We are attempting to work with our supplier, through our lawyer, to work out a payment schedule to get the paid over a period. We been in business for a long time without any other complaints, ever.
We had (2) large projects in the past year that did not go well. We are attempting to make good on the materials for them. It would be in ***'s interest and all parties concerned, for *** to work out a plan so they can get fully paid, liens can get released, and everybody can get on.
As this something we haven't ever dealt with before (these large losses) we are trying to accommodate everybody.
