Purchased Bar Nones Garbage
I did my very first Auction bidding with Bar None via Online on 6/10/20 I was very excited to try and start my own business by selling online my goods. It was a very large auction as Covid had been in full swing. I did my research and noticed that when an item or vehicle was not working they put Non Operational. I live in Reno and the Auction was in Sacramento. I did not Preview. The items I was interested seemed to all be shrink wrapped and looked brand new still in its original packing. I purchased two pallets or roughly 15 mowers. Also a shrink wrapped pallet of Home goods all in new boxes and a rototiller as well as two pretty big tools, a Concrete saw and a Rock cutter. I spent 2700.00 in all. My Boyfriend purchased a vehicle, Truck for 3000. Once home I was unwrapped everything when I started to see lots of broken items and crushed items, upsidedown gas mowers, oil everywhere broken wheels marred and dented items etc..So once inspected I found not one battery was with the mowers, the batteries are 190 ttl the missing bags are 52.00 basically the mowers are not worth much w/o those items. Brand new they are 259.00 with battery and charger, minus the battery and charger and bag you get 25 dol value. 5 of them did not start at all. The three gas mowers are all defective in some way and do not start. The Rotiller did not start and has blown pistons along with two flat or broken tires which was not pictured and is useless. same with the Rock and cement cutter. do not start at all. I get that I can preview the items but I do not understand why they would even bother to sell plain old useless garbage. I figured it would have to be a pre qualifacation that it at least run or start up, I mean I have old items that do not work in my garage and I would never just put them up for sale and let some one buy it without saying oh btw it doesnt run. So next was the home goods. that was a pretty funny joke on me as well. I had broken mirrors in boxes, broken lamps or my favorite was a microwave that was caked with food, after plugging it in to make sure it worked I spent a good hour cleaning up someones splattered food. I sold it the next day for 100 dollars, within an hour I received a call stating it did not heat up. So yes I purchased pretty much 2700 in garbage. I feel used and tricked. I emailed Bar None and of coarse I should have inspected it is all they can say. How do I inspect Plastic wrapped pallets? How do I inspect the Insides of a machine? Why would I even think they were all Home Depot or defective goods? Ok so the machinery, yes I could have inspected just like they could have said nothing works or starts. Or included a picture of the flattend wheels. I mean talk about a scam. I want to dump everything on the owners lawn and let him haul it all to to dumps. Is this normal? Defective items?
One of the mowers has exposed wires, whos fault is it when it shocks a child? I demanded my money back several times after being ignored by Scott. I am done emailing them. Let this be a warning to anyone trying to get a second income, do not buy at auctions especially this one. Lesson learned. .

Hi ***,
Please urgently send this email to your Manager as we would like to return the Ford Expedition VIN *** as it is not drivable and has a broken transmission belt This was not in the description and there is no way that your company did not know this or the dealership that asked you to sell it for them as it is VERY LOUD! So this is very much FRAUD
I purchased the Ford Explorer on Saturday, May 13th I was told that I would be sent the Invoice to pay for this and pick up the car on Saturday, May However, I didn’t receive the attached Invoice until 4:59pm and your company closes at 5:00pm
Since you were closed on Sunday I called and asked how late you were open on Monday to pick up the car and pay you I was told you were open until 5:00pm and to make sure to arrive by 4:30pm as there might be a line We arrived ar

This auction house is not to be trusted If you do business with them be very careful They will bid on their own items to raise the price and then hold the items over until the next auction, even though it appears as sold Many customers have filed complaints about this company They are slow to reply to concerns and do not have sufficient explanations They allow their auctioneers to retract bids, but this is not listed anywhere at the auction or on their website The auctioneers make no mention of this during the auction Municipalities that are doing business with this company should demand an independent review/ audit of their business practices

Hello, Please see attached contract from Bar None auctionMore specifically see line #where it clearly states that a clear title should be delivered to buyer at the time of purchaseIt goes on to state that the Auctioneers responsibility is to return monies paid to buyer in respect to purchase of vehicle if they cannot provide said title.*Regards

Vehicle was sold to another customer who took possession
My Card was charged $4, Total,
Company sold same vehicle twice, and will not refund my payment

I am rejecting this response because:I received a check for $2,out of my payment to this seller for $4,104.55.This is a Shortage of $2,which I am still owed.I never agreed to any "resale", and there is no Paperwork or agreement showing this. This Company is simply re-selling Owners cars without Legal authorization. They have "Double-Charged" Extra fees on a Vehicle they already sold once.I will await my $2,Shortage this Company collected from me

I am rejecting this response because:1) I did not verbally agree to
any "resale" of the Vehicle, nor sign any documents to this effect.2) I have not received any "Sellers Payment", Credit Card refund, or funds of any type or amount from this Company, for my $4,Payment they still are holding

I am rejecting this response because:
I am not complaining about Bar None Auction charges, they can charge as much they want, I am complaining, because they hide, as she wrote tiered large 15% buyers premium, and make clear visual only 2% internet premium, why they are not doing the opposite, make visual 15% buyers premium and tiered 2% internet premium, because of that technical trick I paid 15% more and they benefit from it, if they honestly display all charges (buyers premium 15%, internet premium 2%, state tax 7.75%), I will adjust my maximum bid according to all charges
Bar None Auction using Proxibid (internet bidding platform provider), below is copy and past from Proxibid web page for items I won from Bar None AuctionAs you can see Proxibid platform calculate the total price based on 2% internet premium and sales taxWhen I call Proxibid to tell them that Bar None charge me 15% more on top of their invoice, they were surprised, they didn't have any knowledge of that 15% technically hidden chargeKelly general manager was right, that is their business and they run that business their way, meaning that using technical tricks to misled or trick customers and same time be legally protected

The customer had it explained to him numerous times that the auction applet is set on eastern standard time. This is where the software provider and bidding application operations are located.

Bar None Auction lists all of the fees that are charged in addition to the winning bid price in the terms and conditions of each auction. Each auction has its own set of these terms and conditions. We have a tiered buyers premium of which is noted at the top of the webpage for each of our auctions....

Then the auctions "special terms and conditions" are listed beneath the title, location and time of auction. These are in a scrolling box. The specific line that the terms and conditions cover regarding the tiered buyers premium is line item 13. There should be no misunderstanding as to what the charges are for buyers premium.
I explained this to the customer. I also explained that we can not change the way that the platform is and how it is request us to input the details. I further explained that the terms and conditions have to be agreed to before any bidding can be done. I apologized that he did not have a pleasant experience and asked if there was anything further that I could help him with. The customer just wanted to continue to state how we should be operating our business. I again explained that there would not be any changes as we had to work with what we are given. Asked if there was anything further and closed the conversation with wishing him a good day.
There is nothing that can be done in regards to his complaint. The customer did not read through all of the terms and conditions of the auction before bidding.

allowed to bring in a mechanic to inspect the items as well. Bar None Auction is a consignment auction. None of the items that are sold at the auction are owned by Bar None Auction. The smog certificate on this vehicle was done in August of 2013. The vehicle was in dealer inventory from that time to the time that it was sold through Bar None Auction. The smog certificate was mailed out to the buyer as requested. All documents to transfer ownership on the vehicle have been submitted to the dealer services center at DMV as well. The terms and conditions for each and every auction are attached. These have to be signed and agreed to before any bidder is provided a bidder number.

Please close our complaint as all is resolved now J  We returned our 2003 Ford Expedition and received a full refund.  Kelly was very nice to work with today. Thank you for all your help!![redacted]
