Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below I am following up in regards to Baraboo Health & Fitness's response to my complaintI definitely would like to reject the response provided as it is not only completely untrue, but also unfairI am requesting you to ask the club for a copy of the agreement where it is written at the top the agreement that I made with [redacted] before signing the form in that my wife would be exempt for medical reasons when she had the babyIt also states about a change in addressI had contacted [redacted] the first time and had asked to cancel because I was unsure if I wanted to continue to live at the address close to the club as our lease expired that monthI wanted to leave the club for many reasons, I wish that I had brought up my breathing troubles up earlier in the dispute as he now has an arsenal of my statements to manipulate in his favorI have many documents proving that excessive dust has caused me breathing trouble in the pastI believe that [redacted] is failing in his business and that he will go to extreme measures to collect as much as possible before he closes downAs for his statement in the response about the things that I had stated they are almost all modified or else flat out lies with connections to things that I had saidIt is almost childish to make these things up in such a blatant lieFirstly, the girlfriend he brings up multiple times in the response is in fact my wifeI can provide documents to prove thatSecondly, I am currently a member at the house of wellness and have been for many yearsI also have joined pulse fitness in case that is brought up in his next responseHe has completely lied about my supposed statements regarding "getting out of other gyms" I have no idea where he even got that fromHe also lied about my behavior in the clubI did not yell or use excessive foul language I just stated that I would report him the the Revdex.com if he would not cooperate with me because I thought that he was using scare tactics, like getting in my face, raising his voice, swearing at me, trying to embarrass me, threatening to send me to collections, and also the he was being unfair in our agreementsHe also went into my "legal issues", I regret to have given him so much information as I feel that I am pretty honest and that people will often work with you if you be clear with themI had stated my wife just had a baby and that I had a bunch of other stuff to worry about, (roommates having trouble with the landlord at the house I was on a joint lease for in my college town, to which I was found to be not at faultI had asked [redacted] to give me a break and stated that I had a lot going on and did not want to spend time worrying about this At no time had I stated that I could not afford his gym and wanted to get out of it, I had stated that I cannot afford to pay for a gym membership that I cannot useI have a membership at Pulse fitness in Baraboo as well as me being included on my parents family membership through house of wellnessI hope that you can resolve this issue quickly as I am very upset about how I was treated by ***Thank you for your time and consideration, [redacted]

I did receive your letter dated Wednesday, June 7, We expected to be contacted by Revdex.com as the customer stated that he would be contacting you along with the Health Department "to make things as difficult as possible for us" if we didn't cancel his and his girlfriends membershipsHe stated
that he had done that in the past with another local fitness center, House of Wellness, to get his wayThe following is a response to his Statement of the P***lem.I had first received a phone call in the middle of May in regards to him wanting to cancel his membership as well as his girlfriends membershipThe first reason he gave was that "I just need to cancel our memberships"He repeatedly stated that he was happy with the facility but "I just need to cancel our memberships"He stated that he was happy with the facility both now and in the past, as he has been a member on two different occasions. It was during this conversation, and after continual questioning, that additional information was revealedIt was first revealed that he and his girlfriend had falsely completed their membership applications stating that they were husband and wife, to receive additional discounts on their memberships. Even though this does not affect whether or not we cancel his membership, it does show that he has not been honest from the beginningThe additional information revealed was that he and his girlfriend had an unexpected pregnancy that they were concerned with, as well as him being served notice that he had future legal action filed against him and would be going to court shortlyThis information told me that his reason for wanting to cancel the memberships were because of financial difficulties and no other reason.I explained to him that the membership that he agreed to was based on a month term, and him just needing to cancel his membership did not fall within the requirements to cancel a membershipHe asked me what the requirements were, and I explained that we had two different options to cancel a membershipThe first option was a "Cancellation upon Relocation" and the second was "Cancellation upon Death or Disability". His response was, "Well then, we are also moving"I then told him that if that was the case, we would certainly cancel the memberships, and that we would just simply need a proof of that move as specified in his membership agreementHe stated that we wasn't sure when they were moving and after further discussion, he admitted that he was not moving.The next reason he gave was that since his girlfriend was pregnant, she would not be able to workout at the facilityHe then stated, "If she couldn't workout, I don't want to"I again informed him that he and his girlfriend were obligated to fulfill the membership terms, unless they fell within the two cancelation requirementsHe then stated that because the facility was so dirty, that caused them both to have a disabilityFollowing the terms of the membership, I told him that if both of their doctors were willing to state that they both had permanent disabilities that wouldn't allow them to use the facility, that we would certainly cancel the membershipsOur phone conversation then ended.On June 6, 2017, he came to the facilityHe stated that he had gotten their doctors to write letters explaining that they both had permanent disabilities and weren't able to use the facility any longer. The first letter was for his girlfriendIt states...."is pregnant and soon will be with childIt is unsafe for her to continue working out in a gym/fitness center for several months as she will be healing"The second letter for him states...."The above patient is under my care for seasonal allergies (including dust) and asthma"Neither one of the letters state that either individual has a permanent condition that won't allow them to use the facility, but rather both of their conditions are temporary and not considered permanent disabilities.I explained to him that neither or the letters state that either of them have permanent disabilities, and that it was obvious that he was just a kid who didn't want to workout without his girlfriendHe continued to argue with me at the front desk of the facility insisting that the letters were proof that they had permanent disabilitiesIt was at that time he stated, " If you don't let us out of our memberships, I'll call Revdex.com and the Health Department to make things as difficult as possible for youBesides, what are you going to do if I don't pay you for the memberships"? My response to him was that he has ever right to call the Revdex.com and Health Department and that we allow any member to fall two months behindAfter that, we send them to our collection company to let them pursueHe continued to argue at the front desk and was asked on three different occasions to leave the facility because of other members insideIt wasn't until he was escorted to the door that he actually leftAt no time was he touched or intimidated.We treat all of our members the same and have for roughly years of service without any past Revdex.com complaints, to my knowledgeEven though we are sympathetic to his current financial situation, it is not due to our pour business practices or bad business choices. This particular incident was initiated by a dishonest attempt for him to get out of a legal binding contractWith that being said, we will not reward any individual who tries to use threats and dishonesty to get his wayWe will however, stand behind our membership terms and cancel any membership when those terms are metNeither he or she has met these terms to date.I have included a copy of the cancellation rights that are in their signed membership agreements.Please let me know if you have any other questions.Sincerely,*** ***

If possible please let the member know this as it may help relieve some of the tension.In that response, he states that he has included  "proof of my discharge for asthmatic symptoms." It also states "Please keep this information confidential and keep it from [redacted]." Unfortunately, if we aren't able to view what he is claiming to be the proof needed to cancel his membership, how do we proceed?There may be some confusion from the member as to what we need to cancel the memberships. I believe the membership clause that he feels he has the right to cancel with is as follows:Cancelation upon Death or Disability:  If you, the Member are unable to receive the center's services contracted because of death or permanent disability, the Member is only liable for the elapsed time portion of the Contract at the time of death or permanent disability. Thirty days advance written notice and proof of injury will be required for termination of this Contract.There are two points that need to be brought up if this is in fact the clause he would like to use. The first, is that we need "proof of injury" in order to process the cancelation. The second, after talking to him on the phone yesterday, is that he may not understand what the definition of "permanent disability" is. The definition is as follows from Wikipedia:"Total Permanent Disability (TPD) is a phrase used in the insurance industry and in law. Generally speaking, it means that because of a sickness or injury, a person is unable to work in their own or any occupation for which they are suited by training, education, or experience."One option to try to bring this to an end is if this is in fact the clause that the member is basing his right to cancel on, and the Revdex.com is willing to either confirm or deny that he does in fact have a "permanent disability" based on the definition above, I wouldn't need to see the his confidential information that he wants to keep private.Please let me know if this is an option to bring this to an end.Sincerely,[redacted]
