Dear Ms [redacted] In reference to the complaint:This client came to this office in for a service She provided third-party payer insurance information at that time We provided the service and filed with the third-party payer she provided. It turned out that the insurance information she provided was incorrect That was no longer her payer at the time So, we filed with new insurance information she gave this office. That insurance company never paid for the service provided We filed several times Still no payment The patient was billed over the course of time without this office ever receiving payment for the services provided.Ultimately, this office underwent an internal audit and found several old claims that were never resolved We sent out bills to those clients Many of the clients paid what they owed without any issue They realized this office provided a service, never got paid, and deserved to get paid, so they paid the balances due. This client contacted her insurance payer to complain, after she contacted this office to complain That insurance payer contacted this office and asked for proof of timely filing, which we provided Yet they still did not payUltimately, the burden is on the client to resolve the bill when the insurance will not This insurance is a product bought by the client, not by this office If the client’s product does not pay, they themselves are accountable for the balances due. This office understands the frustration this client feels, since the claim is so old But this office has frustration of its own—having provided a service ten years ago and still have not received payment for the services provided. The service was done Payment was never made This is the bottom line Not the fact that the service was ten years ago Thank you for your attention to this matter [redacted] ***Office Manager

Complaint: I am rejecting this response because:I requested an itemized bill of services showing insurance payments and/or denialsSo the only way we can be at an impasse, is if DrStubee is refusing to provide the itemized bill of services with insurance details and still expects me to pay for a service that should have been covered by insurance (essentially being paid twice for the same service)Once an itemized bill is provided, I will verify with the insurance I had at the timeI will then either pay for what insurance would not cover at the time of service, or the balance should be removed if insurance did cover the service Sincerely, [redacted]

Section of the Texas Civil Practice & Remedies Code does, in fact, state what this person has noted; however, it is not applicable under these circumstances as she was billed for the services at the time they were provided but never paid for those services It is cost-prohibitive to send out bills with return receipt requested, so I have no proof whether in fact she received the bills or not As a result, and after an audit of unpaid accounts, she was again invoiced for the services provided which she failed to pay at the time they were provided in essence, she received health care services and simply refuses to pay for those services Under the same statute she cited, I am prohibited from being subject to disciplinary action for billing for these services And based upon the facts noted above, I am well within my right to continue to bill her for those services

I suppose we are done here--at an impasse
