Dear [redacted]:This is in response to your reply letter of July 18, 2014.[redacted] still does not know what happen to his tax return. I had stated that had completed the tax return, but, I never said that I sent it to IRS or it was accepted. | tried to explain many times that it was a corrupt file; therefore, return has to be a mail return. I also explained that my office always covers the expense of postage. Please look at the form I sent to you. You will notice that I did try to file it 3/25/2013. You should have noticed that there was no acknowledgment or any statement made by me that the return was filed. His return has not been sent to IRS. He and his wife have to come into the office to sign for us be able to mail them. There are no penalties or interest due to the fact they do not owe any money.
They are certainly not in any jeopardy with any of the governments. He states that he did not hear from us by phone-he was called 4/2/2013-please look at the invoice sent you it states several phone calls.I went on to complete a lot of 2013s due to the fact that they were [redacted] grants, LLCs, [redacted] which incur penalties if not completed by March. Yes, my office was busy but due to his daughters recommendation I was glad to have him as a client.
I still do not understand why he only stopped by the office once as he stated before, he had all those days, weeks and months to stop again. I am thinking that he was here before the office was open or possibly came a day the office was closed.
Please note that the IRS rules/codes state that it is the taxpayers responsibility to have their tax returns filed. It is not a third partys such as a preparers responsibility. IRS 800-829-1040.Please call me with any questions you may have.Sincerely,Barbara J. Spangler/Accountant

Review: Ms. Spangler provides tax preparation services. My wife & I met with her @ 2/2013 to have our 2012 taxes prepared. We gave her all documentation, in person, at her office during a scheduled appointment. She has not yet completed our taxes. We have exchanged phone messages with others in her office on several occaisions but have not been able to speak to anyone in her office in person. The messages were that she was still working on them. I've left several messages in the last month but have not heard back from anyone. I know that her office has completed other clients 2013 taxes (our daughter & son-in-law being one) but our 2012 taxes are still not complete. Their office has a locked entry and no one answers the doorbell. I can't even get my documentation back. My wife and I are very upset and worried due to penalties and interest that are surely accruing.

Please help.Desired Settlement: Tax returns completed and filed, penalties and interest paid by Ms Spangler due to her delyas and lack of response.

Response:

July 8, 2014Dear [redacted].I am responding to the letter received from you dated July 2, 2014 concerning my client [redacted].| find that the alleged complaint that was made to you by my client [redacted] is found to be untrue. I find his complaint not to be flawless. [redacted] knew when he came into my office as a new client that I was very busy, due to the fact that he was recommended to me by his daughter I would do everything that I could when filed his return.I placed the [redacted]s on a valid extension which would be until August 15, 2014. Please note that I had filed his return March 25, 2013-you will find a copy of the invoice enclosed. The new client knew that I had all of my Corporations and business accounts to file first to avoid heavy penalties.I do not understand why the client would not have come in to my office to talk with me. A member of my staff had answered all his phone calls. I am not sure why he would have acted in this manner when my staff did everything they could have to accommodate him. I was very fair with his tax return.[redacted] stated that he was not able to speak to anyone in my office in person. The reason for this he never came into the office. He also stated that he was told that I was still working on the tax returns. Please note that his return was completed; but, there were issues with his file within the computer system. Please have [redacted] state the dates and times he was here that no one answered the door. The outside door to the entrance does not have a lock on it; he is referring to the second door with the security system and four door bells. My employees do answer the door when one of the bells ring. He could have called to have his documents sent back to him at our cost (certified). Please know that the IRS codes state that it is the taxpayers responsibility to have their tax return filed in a timely manner. There no penalties or interest accruing when there are none due - it was an extension filed and he did not owe any money. Please call me with any questions you may have. Sincerely,Barbara J. Review: [redacted]

I am rejecting this response because:

I have two saved voicemails from Ms Spangler's office employees dated 1/20/14 and 4/23/14 returning my calls and stating that my taxes were not completed and she was working on getting them done. She claims they were filed 3/2013 but I have no notification of this until her response to this complaint. I went to her office @ 3/2014 and no one answered the doorbell that I rang multiple times. There was another woman (customer) there also and she also got no response. I've called her office twice in the past 2 months (before filing this complaint) but have not heard back from anyone.
