My son got married on January 4th in *** AL. The reception was held at *** across from a parking lot owned by the Barber Companies. During the reception, my 82-year-old father and mother'who is in a wheelchair'left early. When they arrived at the lot, their car was missing and they saw a tow truck hooking up my son's (the groom) car to be towed. My 82-year-old father who cannot walk well, tried to stop them from towing our son's car. We soon found out that my sister-in-law's car was also towed as well as one of the groomsmen and the father-of-the-bride.

I spoke with my father, sister-in-law, and son who was trying to enjoy his reception after the wedding. It was nighttime, cold and very windy, and none of them saw signs as the lighting was poor, and no lighted signs stating they needed to pay.

None of these 4 realized they needed to pay. Otherwise, they would have. Each of these people are honest, hard-working folks. My mother, in a wheelchair, was left stranded in the cold, windy evening. My father, who can barely walk himself was left out in the cold virtually stranded. My wife and I missed the end of our only son's reception and send-off to his new life as we left to help.

I personally paid for 3 of the 4 tickets which was $499.20. My sister-in-law paid for her own.

The are no lighted at night on the lot and when the parking lot is crowded, it is easy to miss the signs.

I contacted the Barber Companies and spoke with *** who was unwilling to help. She had no interest in my offer to pay the $7 for the cars that were towed and refund me the outrageous fee of $166.66 per car that we paid to have cars towed around the corner. Also, after questioning, Ms. Vickery as much as admitted they were watching lots just to catch people and take advantage of them.

Simply put, these people are taking advantage of disabled people and out-of-town visitors.

Desired Outcome

Billing Adjustment Refund the $499.20 minus the $14 parking fee for two of the three cars that were parked. We already paid $7 for our son's car that was parked in the lot.

The Barber Companies recognizes the apparent difficulties described in the complaint from Mr. and does not minimize the impact of the events that apparently occurred on January 4th. We indeed operate a parking facility on 2nd Avenue North across from the *** and frequently have the facility's patrons park in our lot for the required fee. Our facility, as with virtually all parking facilities in the downtown *** area, either prohibits non-registered patrons altogether or requires a fee for payment for a prescribed time-frame. There is no time period at which our facility allows parking without payment and we are not aware of any other facilities in the immediate area that allow free parking.

While severe weather can certainly make any signage difficult to see, we believe our facility is marked appropriately and exceeds the municipal requirements in this regard. We have worked to establish adequate signage to reinforce the fact that this is a fee-for-parking area. The lot not only has the required notice signs along the perimeter of the property but elevated signage and instructions at the payment kiosk located on the property. Severe weather is beyond our control and we are disappointed that the situation occurred.

We regret that Mr. and his family members parked in the facility without payment and were subsequently towed due to non-payment, however towing has been found to be the most effective means of deterring vehicles from parking in parking facilities without permission and payment. We contract with licensed third-party towing services to enforce the rules indicated on signage at the site. Additionally, the fee to retrieve vehicles after being towed is prescribed by a city ordinance and our company does not receive any compensation in the event of towing. That transaction is solely between the towing service and the vehicle owner. In this case, our company did not receive the towing fee and does not have the ability to refund the penalty charged.

We take exception to the accusation that we are somehow taking advantage of disabled persons, as the rules of our parking lots are administered without regard to anyone's personal situation.

My car was not towed. I am writing on behalf of four other people who were taken advantage of. I did pay for three of those people. They charged us $166.66 per car to tow them a few blocks away. I have photos that I have turned over to my attorney showing the signs are not lit at all. No sign in the lot is lit, they are depending on street lighting. The street lighting in the parking lot itself is poor and dangerous. My father had a handicapped tag yet he was towed. In good faith, I asked the Barber company to let me pay the seven dollars for the 4 cars of my family they towed and to repay us the outrageous $166.66 they charged us for each car. Every person in my family that was towed was from out-of-town and the car of the groomsmen was also from out-of-town. My phone call to the Barber company revealed that they are watching lots and calling the towing company to come pick cars up. Simply put, they ruined our sons wedding and left and 82 year old man and handicapped woman in the freezing cold all for money.

In reply to consumer's response dated 1/21/20, it is clear we have differing positions as to the facts of the dispute and actions of the parties involved, therefore, we do not see a remedy for the situation through Revdex.com's resolution process and must consider this our last communication on this matter.
