Initial Business Response / [redacted] (1000, 5, 2015/10/13) */ IN RE: Your Case No#190.42399; [redacted] Our File 06388-F9393, Fondulac Township Dear Sir or Madam: Our law firm represents Fondulac Township and the Fondulac Township CemeteryWe were recently made aware of the above-referenced complaint, but after consultation with our client, we are of the opinion the Cemetery appropriately follows its own policies and the lawIn support of our opinion, we offer the following Upon being contacted by Ms [redacted] , the Cemetery began a diligent review of all available records and consulted with numerous authoritiesIt explained to her the long-standing policy that: - The next of kin for any graves not used by the purchaser inherit the right of ownership; and - If there is more than one next of kin, there must be agreement and confirmation in writing of who can utilize the remaining grave(s) In this instance, Cemetery officials further notified Ms [redacted] (born: [redacted] ) that both its records and those of a local funeral home received written confirmation from " [redacted] " giving permission to bury Mrs [redacted] in the remaining grave at issue It is our understanding that Ms [redacted] firmly objects to and protests the validity of the letterIn an effort to resolve the matter amicably, the Cemetery forwarded copies of its packet of documentsEven after receiving the material, Ms [redacted] continued to contact the Cemetery, demanding Mrs [redacted] be exhumed Out of respect to Ms [redacted] , the Cemetery (through the Township Supervisor, [redacted] ***) contacted her to further explain the materials and policies, including the Cemetery's understanding that the law requires a court proceeding before any remains are exhumedMr [redacted] then took the extra step of contacting the Tazewell County Coroner and State's Attorney office to discuss the exhumation processIn short, those offices confirmed the Cemetery's position - the person seeking the exhumation must follow a specific procedure that typically requires them to plead their case to a judgeSupervisor [redacted] attempted to share this additional information with Ms [redacted] , but the telephone number she used to contact the Cemetery is now out of service As legal counsel for numerous townships/cemeteries, it is our advice to our clients that at no time will any remains be exhumed from a cemetery absent a court order to do soIf MS [redacted] has any evidence refuting the documents kept by the Cemetery, she is welcome to present it and start the process in seeking the exhumationThe Cemetery respects her right to do so under Illinois law, but the public expects a cemetery to be a final resting place except in extreme circumstances where the legal processes have been followedWithout following those procedures, a cemetery risks setting a dangerous precedent that subjects it to unnecessary scrutiny and liabilityFondulac Cemetery will not subject itself to such scrutiny and liability Ms [redacted] is welcome to contact the undersigned to discuss further Very truly yours, [redacted] Initial Consumer Rebuttal / [redacted] (3000, 7, 2015/10/20) */ (The consumer indicated he/she DID NOT accept the response from the business.) First, I going to address the bullets that were included in the letter from Mr [redacted] This is considering the next of kin for any graves not used the purchaser, does inherit the right of ownership, that is me [redacted] Next bullet, considering if there is more than next of kinThere wasn't I'am the only birth child of [redacted] and [redacted] My father, purchased these plots in 1957; one for himself, One for ***,(my mother)and one for me [redacted] Next paragraph stating that the cemetery notified [redacted] (me) That is a lieI never received notification, no telephone call, mail, nothingBut the answer would have been NO Who did the cemetery talk to, and how they even know about [redacted] , in the first placewhoever it was they stole my identitySigned a name, which isn't a legal name, eitherMy legal name is [redacted] , since and still is.If the Cemetery Board had done their job, they would have the identification of this personBut they didn't so they will have to take the responsibility of the liability in this situation of fraudI would like a copy of the original receipt of my father purchasing the three plots, the dates, his signature and the datewho were they talking to acquire [redacted] head's permission I know that the limitations has expired to pursue these people, if caughtSince the didn't check the identification to see if back in 1999, if it was the real [redacted] , the cemetery is left on the hook Because they should have done that, especially something this This cemetery cannot be trustedit is run by City counsel members which makes this more horrible situationThis should have NEVER HAVE HAPPEN, PERIODMr [redacted] states that Mr [redacted] contacted me to further explain the circumstances, He did not callthat is a liePlease check my telephone recordsI called the secretary,Ms [redacted] a week after I called the first time to verify Ms [redacted] burial.Aug14, 2015, Ms [redacted] stated that I could pay for Ms**removal if I chose to I did think that was strange, but no stranger than letting someone illegal take my plotThis situation I also prove through the letter sent to meand final telephone call, was on also on Aug14, 2015, where I wanted to talk to Mr [redacted] the supervisor When he came on the line to talk to me, he said he aware of my ase, but became belligerentHe wasn't nice to me at allLet along professional.This is when I asked the copy of the receipt my father had signed He sharply replied, we've given you enoughThis man doesn't know who I am, but they didn't know the real from the phony, either.Then came the shouting mess He yelled and screamed at me, implying that I must be some crazy lady from Phoenix, although he didn't say those words,but he was screaming at me, saying he was going to contact the State Attorney office to turn me in, then hung upSo much for being professionalUnder these conditions, I refused to talk to Mr***, although I did try again, after that, but I was trying to get him to calm down I'm the injured party here, not himI do have all the documentation to back up my case and then someIn conclusion, it does seem that everyone defending the cemetery is taking the fraud situation very lightlyThat's not rightMr [redacted] was stating the cemetery risks, that this is a setting a dangerous precedent that is subject to unnecessary scrutiny and liability that was an understatementThink again, this has already happen, this cemetery is under scrutiny and liability for how they treated me, and for what they have done back in Allowing a person without permission to enter my empty plot, is outrageous, and illegal.So you will know, that there was a box that a person could check if they thought the media should be involvedI Marked YESI have all the credentials to back up my validityI will continue to seek justice in my caseTo remove this body and place her somewhere else [redacted]
