Review: Brian J[redacted] wrote my Property Settlement Agreement (PSA) to require that my ex-husband deplete all funds in his 401-k, as we knew my ex-husband would owe me more than what was currently or would ever be in his retirement account. When writing my QDRO to transfer these funds, Mr. J[redacted] asked for a lump sum amount instead of 100% depletion, which resulted in the QDRO being denied as there were insufficient funds to cover the amount Mr. J[redacted] asked for. For the past 11 weeks I have repeatedly shown proof that there was never enough money in the 401-k account to cover the lump sum amount Mr. J[redacted] requested in my QDRO; shown proof in my PSA where it states all 401k funds must be depleted; and have requested that Mr. J[redacted] correct his error and not charge me for it. I have been given this response: "While you claim that the QDRO was erroneously prepared, it is in fact in harmony with the agreement. It appears that your ex-husband's account lost value after the agreement was signed and that there was not enough money available in the account to satisfy the award when the plan administrator received the QDRO. That is not anyone's fault." Mr. J[redacted] should never have requested a lump sum, did so, and now wants to charge to re-write the QDRO for 100%.

In addition, my PSA stated that my ex-husband's paycheck would be garnished by DCSE. When Mr. J[redacted] wrote the Payroll Deduction Order he requested my ex-husband's employer to send me checks directly in one section, and 3 sections later requested for my ex-husband's employer to send money to DCSE. Currently due to this error, my ex-husband's employer is sending me checks directly.

Mr. J[redacted] also used incorrect income amounts and tables when calculating my child support.

I contacted Edward Barnes to try to get resolution, and I have been told that I must pay an additional $350 in order to have my QDRO and Payroll Deduction Order re-written to conform to my PSA. I have been told that I am welcome to "seek a second opinion, or obtain other counsel."Desired Settlement: correct (WITHOUT charging) my QDRO to require 100% depletion of my ex-husband's 401k account; re-submit my Payroll Deduction order to the Chesterfield Courthouse so that my ex-husband's paycheck will be garnished through DCSE; and correct the amounts in the Payroll Deduction Order for child support using the correct figures (total gross wages and not social security wages) so that I can recoup the $708 that I lost in child support from May 2015-2016 and from here on receive correct child suppor
