To Whom It May Concern:

I recently purchased a home in Belton, Bell County, TX through Barnes Home Builders. I have made several attempts to have my concrete walkway slab repaired through Barnes Home Builder's. The subcontractor whom performed the work that is affiliated with Barnes Home Builders has not yet fixed the error in my concrete walkway. A crack has formed due to poor craftsmanship and workmanship. Per my final walkthrough that was performed and signed off on by the Inspectors the issue was to be corrected per what the document states before the home was closed on. To this day, nothing has been done to correct the issue. The Builders have not given me any sort of response other then they are not going to proceed to fix it. The subcontractor has came out to my property several times and thrown dust in the crack and pretty much wasted my time by telling me that it's a normal occurrence. Moreover, with this being a brand new construction home and already having a defect on the property is ridiculous. The slab walkway formed the crack after it was laid. I've been very patient in hopes of having this issue corrected and the builder's and subcontractor have yet to help assist me in any way possible. I would like to file this complaint on my behalf due to negligence Barnes Home Builder's has offered and their inability to respond or act upon their word of standing behind their workmanship. I was told I was to have a 1 year Builder's warranty per what my contract showed. It doesn't seem like they are willing to go out of their way seeing how they got the funding from the sale of the home and are too lazy to want to help or fix anything for that matter.

We understand the homeowners concern about the nonstructural stress crack in the sidewalk. However this item is not considered a defect in workmanship or material as per industry standard. We will happily repair any warranty items in the first year, but as the information provided to the homeowner details only defects in workmanship or material would apply.

I am rejecting this response because:I didn’t spend over a $150k for a brand new home to have an item regardless if it was a structural or contractual item have something wrong with it. Per what has been discussed why isn’t everyone else’s home having the same situation? If all the homes are built by the same builder how is it that my home is the one with the item in need of repair? If the subcontractor were to come to my property and inspect the area pull up the concrete it would be recognized as to why the crack is displayed. How is it that the rest of the walkway is in perfect condition minus the one slab porition? Who can properly explain that to me in detail as to why the one area is cracked, no other homes are facing the same situation and why the rest of the walkway is in perfect condition.

We take great strides to properly set expectations for our new homeowners and provide documentation regarding many things to avoid issues like this. Unfortunately, non-structural stress cracks in poured concrete are normal, they do not affect the integrity of the concrete and are not something that would require a repair. In fact, repairs on non-structural stress cracks often make the area look more unsightly. We have explained this several times to this homeowner. Attached is a photo of the issue in question showing that this is a very minor, non-structural stress crack that does not require correction. Also attached is the documentation provided at closing and the homeowner's acknowledgment of its receipt. This is not a defect in workmanship or material and there is simply nothing more to be done with regard to this issue.

I am rejecting this response because due to the fact of going back and forth with the builder this is ridiculous. I've been more then patient with your company in hopes of you making the repair upon request. The subcontractor who placed the concrete must have had his eyes closed when he placed it. As a result of an agreement not being reached I'll take it upon myself to reach out to U.S. Department of Housing HUD to have them look into the matter. Your warranty company has informed me that I can file an arbitration to dispute this matter further. As I have explained numerous times, this is my home not yours. If you could understand the reasoning behind my request to correct this issue maybe you would fully understand. The fact of the matter is that the concrete had it been placed correctly would in fact result in a crack not being presented in the walkway. If you would possibly reconsider making the repair I would accept the response in full. However, you keep presenting documentation noting that we signed off on in agreement as this was due to providing documentation that we thought items we noticed in the Joint Inspection Report would be corrected. Yes, this is the correct. Moreover, though as I have mentioned per what was pointed out to the Inspectors at the time of the final walkthrough in February regardless of how it was notated in the document your company should be held accountable to make the repairs necessary regardless of how it would present the look of the walkway. As I have mentioned in all correspondence the only thing your company has allowed is the Subcontractor to come make the appearance of the walkway worse then what it looked like in February when it was originally pointed out. I've offered to see how much it would cost to make the repair if your company is unwilling to allow the Subcontractor to make the repair necessary. I do not agree with being told by your company nor the Subcontractor involved that this is normal. If it in fact was normal then everyone's home within the Subdivision would have a crack in their walkways, but that doesn't appear so. Therefore, if you would like to speak further I'll be available to meet at a time convenient for you as I have already extended this offer and it must have been overlooked. I'm not going to accept the fact of having a crack regardless of what your company states in my brand new home.

I wouldn't even give them one star! This was the worst buying experience I have ever encountered. Where do I even begin. Eric M was the face of Barnes Home building and He put in the wrong grass and never fixed it.(Lied to us multiple times on multiple occasion). Even though we had told him for the beginning exactly what we wanted. The night before we signed the cleaners had to come out 3 different times because the house wasn't cleaned and the sheet rock debris was all throughout the house. the house was a disaster!! When we moved in the following day we still had to end up cleaning. The bathroom tubs where all scratched up, the walls were scratched with paint missing, they never washed the brick and leftover concrete was all over the drive way, the flashing along the house was messed up where they just stuck pieces in to complete it. They also had walked all over the grass and we had huge pot hole and damaged grass we had to fix. I could go on and on about what was wrong with the house that they promised would be done before we signed. Now after we have moved in none of these items have been fixed even after being in contact with them about the issues. We have whole panels coming up off our floors. and our house is still a wreck and they dont even seem concerned. The poor customer service is unacceptable. I will make sure I tell anybody and everybody never do buy from them and never do business with Eric M he is shady person.

We are very sorry that you did not have a superb buying experience while purchasing your home from us. We strive to make all of our buyers satisfied with the purchase of their home from start to finish.
We would like to start by addressing your initial concern regarding the SOD. The buyers agent failed to communicate the home owner's change request for a different type of SOD type in writing to either the selling agent ( Eric M) or the homebuilder. Had the buyer's agent communicated this change request in writing prior to the SOD being installed, we would have been happy to meet the request.
Regarding the remaining items listed on your complaint, majority of the work orders that were reported were completed before the final walk thru. The remaining items were reported during the thirty day warranty letter and have either been completed or scheduled for repair at this time.
Once again, we are very sorry that you are unhappy with the customer service you have experienced to this point. We are certain that if you will communicate any further issues in writing to us, we will do our best to make your experience better from this point forward.
