I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below First off, I took a couple of days to review the company's response and cool down enough to properly and professionally answer to the liesNO CONTRACTOR IS EVER PAID IN FULL BEFORE THE JOB IS COMPLETED !!! The owner's exact words were "PAYMENT IS NOT NECESSARY TILL WE HAVE COMPLETED THE JOB" and "DONT WORRY ABOUT THE COST IF WE HAVE TO GO FURTHER, YOU CAN PAY $OR SO A MONTH, WHATEVER YOU CAN AFFORD"I will give him credit as to being a decent human being but whomever is answering the phone and not scheduling the completing of the job is way out there in lyingI may not remember what I did or said on July 1st, when I was yrs old but I remember last year and when someone tells me something regarding my finance for a projectI am not going to lie nor do I have toI was told what I was told because I multiple times told the owner that I am disabled and on a limited income and to please do not go down more than X number of feet because we have a spring well already for years and it was simply frozen due to the harsh cold of that winter, and we can survive with a shallow well costing $6K or less because I can and was going to switch back to spring water in the springOur spring well was fine for yrs that we lived here and the water was the best in the worldDuring the winter, I have a heating bill called fuel and was why I didn't start the $payment until the spring, plus waiting for them to complete the jobNow it's winter again, and they still haven't completed the job, it's been nearly a year of us contacting and stopping payment when we were told by the female on the phone that they would be there next week or the week after, and we sent a double payment and when they didn't show up, and so we stopped payment againWe told the female that we would resume payment upon job completion, again, NO CONTRACTOR IN THE UNITED STATES EVER GETS PAID IN FULL IN ADVANCE BEFORE COMPLETING A JOB, just in case, they walk off the job and never return like what you see happening hereMy wife and I already suffered because of them, we fell multiple times having to go care and feed our animals, we had to have a neighbor get some gravel to back-fill a walking path to the animals but that came too late as the animals started to get sick and die, and so we got rid of all the animals and cagesMy new lawn mower blade was shot because it kept hitting stones in the yard, and they put us thru a year of BS promises of coming and then not coming and having us live with a trench that I had to semi fill with hay just in case we fell again, we would fall on hay and not on the hard ground surfaceMY RESOLUTION IS FOR THEM TO COME BACK AND BACK FILL THE TRENCH THEY CREATED, AND I WILL PAY THEM ACCORDING TO WHAT THE OWNER TOLD ME, $OR SO A MONTH, WHATEVER I CAN AFFORD AT THE TIME, WHICH WILL BE SPRING, SUMMER AND FALL, BECAUSE WE NOW HAVE THE HEATING BILLS COMING IN MONTHLY! I would like
to clarify and document the actual facts in this caseFirst, please see attached Estimate #*** dated 1/23/This estimate was prepared after Wade
Barney met with the homeowner to assess the situation. This estimate was for drilling a new domestic water
well,
excavating from the well to the house, installing a new water pump system and all related material, and providing a water bacteria test indicating the water was safe to use. The estimate was provided to the customer by e-mail as documentedThe total of this estimate was
$7,I also discussed it briefly on the phone with the customer's mother ** *** who informed me that she was willing
to pay $6,towards the
project and her son would be responsible for the difference. On 2/3/the customer called our office
to inform us that he was in possession of his mother's deposit check for $2,and would give it to Wade
Barney with the contract documents when we arrived on site to begin the workWe
undertook this project in the bitter cold winter because of the homeowner's need for water; they had been withoutOn 2/10/the well was
drilled and on 2/12/the pump installation was completedWe agreed with the homeowner that after the full amount of $6,was paid by his mother then we would work with him to accept monthly payments
on the balance dueContrary to the homeowner's statement that "we
drilled much further then they had informed
us to", our estimate was based on drilling 220' and installing 60' of
casingWade Barney bases his estimates on his knowledge of the surrounding area as he has been a well driller for over yearsA water well
is impossible to estimate exactly since no one knows what
is underground till the work is underwayThe completed well was
240' deep; only 20' more than the estimate resulting in $difference, and the amount of casing installed was 60' as quotedDuring the pump installation the homeowner agreed that it would be wise to install heat tape since it is a mobile home and we added that material and miscellaneous fittings necessaryAs per Invoice #*** dated 2/24/15, copy attached, the total amount invoiced was $7,This is only $over the original estimate,
not $2,as claimed in the customer's statementAs indicated on the attached Statement of the customer's account history,
we received a timely payment from the customer's mother in
the amount of $3,which brought the amount that she had paid on the account to
a total of $6,as she agreedThis left a remaining balance on the account of $1,We did not receive another payment on
this account until 5/6/2015, 2-1/months after the invoice date, a money order from the customer in the amount of $The next, and only other
payments received from this customer were on 7/20/2015, approximately months after the invoice date, totaling $Over the summer my assistant and I spoke to the customer several times requesting consistent payments on the accountA
verbal agreement would have been acceptableWe did discuss the lawn repair with the customer which was necessary due to the fact that we excavated in frozen ground in February to get them water and couldn't
backfill entirely perfect because of the freezing situationIt was expressed that
once a consistent payment agreement was made between Barney & Sons and the customer and the payment schedule was adhered to we would return to grade the lawn betterIt needs some work but is not as extreme as described in the customer's statement.Attached also is the signed contract from the homeownerPlease see Item
PAYMENTPlease note that although the balance is past due by months we
have not assessed any finance charges to this customer, nor have
we turned it over to collectionWe have been willing to work with them up until and
including nowSettlement: We will accept a signed installment agreement
for the balance on account of $1,from the customer at monthly payments as low as $per month beginning immediately, As long as the
payments are made consistently we will not assess any finance chargeOnce we have
received the first payment, along with the signed installment agreement, we will return within two weeks to repair the lawn, weather permitting, as we are now getting into winter
weather againThe installment agreement will also state
that if the payments are not made as agreed we shall have the right
