First and foremost I like to start out by saying that this complaint is absurd and totally without merit
I was contacted by the *** *** and her sister *** *** attorney *** *** to perform a forensic date of death estate
appraisal on their mother's home at *** *** *** *** *** XXXXXThe Date of Death was November 6, The date of my inspection was April 20, I was told that since the date of death *** *** who lives in the home had new windows installed, new vinyl siding installed, new doors, new gutter guards, plumbing repairs, etc., but I was supposed to value the home as of the date of death prior to any repairsThe home is a small bedroom bath home over a full unfinished basement with a car detached garage in fair-average conditionWhen you conduct a forensic appraisal to ascertain a value years prior to the present date assumptions have to be made
In any event, I completed the assignment and turned the appraisal report in to Attorney *** The appraisal report was USPAP (Uniform Standards of Appraisal Practice) and Fannie Mae compliantVery well written w/an abundance of photos
The purpose of the appraisal was to establish a date of death value both for the estate as well as a baseline value for the two sister's *** *** and *** *** to buy out the interests of granddaughters of the deceased who were daughters of *** and ***'s died brother whom had a 1/interest in the property
I received a call the week of May 16th from Attorney Fox asking me if I would meet with *** ***, *** *** and himself to discuss the appraisal reportI said that I would be glad to but wondered what the issue wasAttorney Fox indicated that they were not happy with the final valuation of *** and that there had been a prior appraisal report from 6-months earlier which came in at *** I asked if I could get a copy of that report to review prior to the meetingAttorney Fox emailed me the report
On or about May 20th *** *** came to my office to finally pay me for my appraisal and she was clearly mad at meI asked her what was wrong and she told me that her and her sister didn't agree with the valuation and would only say that it was high and that they would now need to go get a loan to buy the granddaughters out
It became clear to me that *** and *** were angling for a low ball appraisal to accomplish their buyout goal
On or about May 24th *** ***, *** *** and I all met at Attorney Fox's officeUpon arrival, I asked where the other appraiser was and they said that he wasn't invitedI said "so you think that he is right and I am wrong?" They really didn't answer but it was clear that this was the caseI went on to explain the appraisal process and talked about what you could do and what you shouldn't do and why the comparable sales that were used in the lower *** appraisal were unreliable and shouldn't be usedI further explained some omissions from that lower appraisal report, etc., etc
They showed me a typed list of upgrades, paid for by *** *** that were completed on the home AFTER the Date of DeathI asked them why they changed the siding from aluminum to vinyl and their answer was because they could get a better deal on the new windows if they also changed the sidingThat doesn't mean that the siding was bad and needed changing
Attorney *** said they should get a more detailed description of the work done and also why it needed to be done by the company that did the workThe ladies said that they would contact the company
I told them that I would reconsider those repairs in my valuation if they got the information from the contractor describing why the repairs needed to be done otherwise, I would have to consider the siding as a "want" and not a "need" in the reportThe ladies agreed and both apologized to me for doubting my valuation, integrity and years of real estate/appraisal knowledge
Attorney Fox indicated to them that I would need to come to court to testify on their behalf about the value of the property and that I would be compensated fairlyThe ladies agreed and everyone left the meeting feeling positive about the outcome
The very next day in the mail I receive the complaint letter from the Revdex.comI thought, what in the world is going onI contacted Attorney fox and he couldn't believe it eitherHe said that he would contact his clients and tell them to contact the Revdex.com to have the complaint dismissed
I waited and waited for a letter or notification from the Revdex.com about the complaint being dismissed but it has never come, so today June 6th, which was my deadline to answer, I called and spoke with *** *** *** indicated that *** *** had not contacted the Revdex.com to dismiss the complaint so I was forced to write/submit my side of the story
By the way, I have never received any information from the contractor about the windows/siding etc
Finally, I understand that when someone has a complaint about a business the Revdex.com has to follow up but I resent the implication that the business was at faultI have been in business for over years and have never ever had a complaint against me
I am a well educated professional who operates by the book and who has a stellar reputation
I hope that this response is enough to clear my good nameIf not then I will have no other choice but to pursue my options under the law
