Barry Homes Inc

I contacted Barry Holmes Inc. to replace a fence on my property. I signed an agreement to pay them 50% ($4,800) up front and the remainder on completion of the job. They hired a subcontractor (MG Decks and Construction). I didn't know that it was a subcontractor doing the work. The subcontractor completed the work in a satisfactory way, and the contractor (Barry Holmes Inc.) billed me for the remainder ($4,807.50). Subsequently, the contractor refused to pay the subcontractor telling me that they had a dispute over another job. I stated that their dispute had nothing to do with me. I soon learned that was not the truth, and that Barry Holmes Inc. informed the subcontractor that they were not being paid for other construction projects and therefore they could not pay the subcontractor and advised the subcontractor that he should place a lien on my property to gain payment (for the job that I already paid for). I have been in contact with the subcontractor and have his correspondence with the contractor as well as documentation of my contract with Barry Holmes Inc. and proof of payment. My lawyer advised me to request 10% of the payment to Barry Holmes Inc. in good faith to hold towards the Canadian Lien Act, but they refuse to comply.Product_Or_Service: Fence replacementDesired SettlementThat Barry Holmes Inc. honours their contract with the subcontractor by paying what they owe him so that no lien is placed on my property as I have already paid the full amount agreed to.
