Review: I signed a contract with [redacted]'s Construction on 12/11/2013 for the following work to be done at my house:

1) foundation work,

2) subarea plumbing / drain pipe replacement, explicitly including pipes under house and wall drain pipes,

3) bathroom remodel,

4) kitchen window replacement.

Item 1) has been completed, item 2) has been started but not completed (wall drain pipes still need to be replaced) and items 3) & 4) haven't been started at all.

The overall costs were estimated at $18333 with a down payment of $5864 made on 12/11/2013. The work on these projects ceased on 12/30/2013 after both parties agreed to terminate the contract in mutual agreement and [redacted]'s Construction to refund the down payment for not completed work.

The reasons leading to the contract termination were:

a) contractor refusal to add detailed work & material description and also timelines (start and completion dates for projects) to contract,

b) contractor refusal to provide subcontractor information, especially license & insurance information,

c) contractor asking for additional random upfront payments after an already excessive down payment.

[redacted]'s Construction has been contacted repeatedly by phone and email by myself without success resolving the dispute. I finally engaged an attorney on Jan 13th 2014 which resulted in a check for a partial refund, but at this point I'm still waiting for [redacted]'s Construction to refund me the full amount for the not completed work.Desired Settlement: Besides the disputed refund, I also have major concerns about the general business practices of this business. In particular:

a) the requested down payment is excessive and in violation with the Contractor State License Board guidelines,

b) the unexplained resistance to provide subcontractor information, including license & insurance information,

c) the unwillingness to add important details to the contract, as for example project start & end dates and material & components to be used.

Response:

I [redacted] in 21 years of doing business have never had a complaint from the Revdex.com. I am a working contractor. I do good work for a good price improving homes. ( all word of mouth ) Over the years I have learned some people will never be satisfied no matter what you do for them. In my opinion [redacted] is the most belligerent hostile person I have ever met. A mutual friend who referred her to me said she was hard to get along with. On occasion she would make random remarks like " you don't want to see my bad side" or " I'll bury you in the back yard ". One morning she said she would allow me access to interior of house at 9:00 am I arrived at 8:55 and she yelled at the top of her lungs I'm in a meeting!!! At this point I was beginning to question here mental status. I do not agree with the particulars of [redacted] complaint. I entered an agreement in good faith and was transparent the whole time. I provided an approximate time duration of work and also a list of materials with pricing. We even went to home depot before singing contract. As far as down payment the ten percent rule is applied only when your not starting work within ten days of date on contract. We were in that time frame. [redacted] was in violation of by refusing to make progress payments specified in contract therefore she terminated contract. She said she would not make any more payments until the entire project was finished. I'm not a Bank or Credit Union. You pay as you go! It was apparent [redacted] was trying to get something for nothing...We spent four days in a crawl space repairing foundation, digging, trenching, cutting and replacing sewer pipes for $ 3,161.00 which [redacted] feels she dose not have to pay for. She also received a refund of $ 2,317.74. I gave her good pricing because she was a friend of a friend and in return she hires an attorney to intimidate. This is indicative of her attitude from the beginning. I will move on from this doing good things for people, [redacted] on the other hand will still be [redacted]..

The accusations against my person are ludicrous and

unfounded, serving no other purpose than to distract from the real

issues at hand which still are:

a) the outstanding refund of $1332 for uncompleted work (see breakdown below),

b) the refusal to add written project details

to the contract (work, material / components to be used, project

start / end date etc.),
