I have reviewed the response made by the business in reference to complaint ID 11150178, and find that this resolution is satisfactory to me with the exception of a few notes:-*** never contacted us via phone unless we called him-*** took sometimes, up to weeks to respond to an email/question onlitook over a month after the first Shoring Report issue to hear from *** ***, saying they were waiting on Ground for a Shoring ReportThe last we had heard on the topic, they were looking around to see if someone could write the report.That lack of communication wasted a month with us not knowing they were waiting on us.-Never said we were moving out of staasked them to take a look at the design without a basement to possibly speed this project along, they said they were going to come up with numbers and call us on the next Monday, never received a call from them.

On 9/24/14 a Design Agreement was entered with the [redacted]s, which was to prepare a set of blueprints of a floor plan, elevations as needed, sections, an outline of specifications and an approximate price quote. The [redacted]s wanted to take care of the soil engineering as...

Mr. [redacted] worked for a local soil engineering company. A property survey, site plan, structural engineering drawings, floor plan, elevations and a proposal were completed and gone over with the [redacted]s On 4/3/15 a construction contract was entered between both parties. On 4/10/15 application for building permits were applied for with City and County of Denver, and from Denver an estimated completed review date of 5/8/15.This date was given to the clients as the date the permits could be expected from the City of Denver. The estimate date of 5/8/15 came and went with no communication form Denver the permits were ready, their website showed the permits were still under review, weekly emails and phone calls to Denver went unanswered. Even weekly visits to the building department and discussion with the reps showed the permits were still under review. On 6/2/15 we spoke to [redacted], we received information that the city was 4-5 weeks behind schedule an estimate 400 projects behind according to him. 4-5 weeks went by and no new information from the City, the permits still showed they were still under review. There was clear communication with the [redacted]s via email, phone calls, and site visits. We continued to contact the plan reviewer assigned the permit and their supervisor, and the department supervisor. We did not receive any communication returned by the City. We even supplied to the [redacted]s a news article from the Denver Post (http://www.denverpost.com/n...tors-waiting-permit s-struggle-start-projects) illustrating we were not the only ones being held up. We received the first review from the City beginning of September 2015 with comments concerning the building plans. Again this was communicated to the [redacted]s via email and phone calls. The changes were made to the plans; all which had to be done be each respective professional and returned to us. This did take some time. The plans were resubmitted to the City again for review. We received another set of comments on the building plans end of October 2015, this time the City wanted a shoring Letter with plans stamped by the engineer and valuation. We contacted Mr [redacted] to have this information to be provided to us since the soils report was done by the company he works (as mentioned). The explanation given to us was this could not happen because the engineer that did the work for them was no longer with the engineering company he worked for and if we could take upon getting the additional information. We sent out information to another soils engineer in order to gather the information needed for the City. After the engineer examined the soils report and other information, they turned down the work but referred us to another soil engineer. This occurred multiple times until the last engineer explained they could not take up the report of another engineer and add to it because it was against the law. They only way for them to do the work was to start at the beginning and provide a new report. We contacted Mr. [redacted] and explained the situation with having another soil engineer picking up the work, and that the best option was he need to have his company just to provide the information need; Mr. [redacted] was reluctant to have to go back.to his company he worked for but he did. We received the shoring report and information from Mr. [redacted] after the New Year’s Holiday. Once we had the information we sent the information to the structural engineer, started bidding on the work for valuation in order to turn into the City to obtain permits. Again this was communicated via emails and phone calls. Soon after we received a call from Mr. [redacted] to look into changing the plans which included a basement to only a crawl space. We explained we would need gather information from engineers and look at cost in order to provide them with the information needed to make the best decision. As we were working on getting information for the new foundation and holding on getting permits based on the original plans; 2/2/16 we were contacted by Mr. [redacted] stating they wished to cancel the project. The reason we were given was because they were looking to move out of state. We asked them to send a signed letter to us for proper documenting the wish to cancel the contract; and the contract would be canceled as outlined in the contract.We received a certified letter post marked 2/22/16 detailing the request to cancel the contract. A letter was sent to the [redacted]s in an act of good faith; within due time we would follow up with them after we have done a final accounting of the project as outlined in the Design Agreement and Construction Contract.
