I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below
After hiring a third party structural engineer and another contractor to give an estimate based on what the structural engineer viewed as needing repair we do not feel confident in the original contractors abilities to finish the work correctly or in a timely fashionAlthough adding on to the proposed original project the projected week time frame was continually told to be the completion dateAfter over weeks the contractor breeched his own contract and the structure still is not finishedAlso errors made by the contractor has caused other damage to our home in terms of incorrect work and quality of work We did agree to a draw schedule however when asked for receipts of materials or windows etc we were told we didn't need them Also due to the fact money kept being requested without significant progress of work or in purchase of materials we did withhold the remaining amount until the work completed reflected the money given We previously attached the third party structural engineer report and the final quote given by another contractorWe again are asking for return of our money so that we can rebuild/fix all of the structural issues and finish all interior work of our addition to provide us with a safe structureWe will seek legal counsel to resolve the matterRegards,

They changed the plans a couple of times, they went from just a foundation with no basement to a full basement. We did additional siding and windows. The exterior, the framing, the preliminary...

inspection were all done and passed inspection. In November we were preparing to hang the sheetrock. With the cold temperatures we needed to put the heat ducts in so that we would be able to keep the interior warm enough to dry the sheetrock mud. Money was requested from the consumer for materials to be purchased, the heating materials. The arrangement was for money draws as work progressed. We are a small company and needed the money to purchase the materials needed. The consumer's owed $3,900 for remainder of job, $700 was requested for heating supplies. Consumer said no additional funds until job complete. Consumer did explain that they did not have the money at that time and he was going to notify us when he had the money. We checked back in January, consumer said he would contact me when he had it. We followed up in February and consumer stated the same thing. All work was inspected and passed. The failure of the basement was not due to any workmanship issues or our business. The consumer informed the inspector that he was going to use the basement as a living space and because it was not insulated it did not pass. The floor joists were all correct and also passed or we would not have been able to build upon them. Everything was complete but the drywall and flooring. We are willing to complete the job but would ask that a 3rd party be involved to identify any issues stated by consumer. We would also request $1,000 for the heating and flooring supplies to be paid up front and the remaining $2,900 upon completion.
