I am rejecting this response because:***, I contacted you to inquire if you give free estimates. You confirmed that you do give free estimates. You sent your subcontractor to give a freeestimate on my driveway, sidewalk and underskirt Youcalled, and gave me the subcontractor’s report along with an estimate quoteover the phone. While on the phone, Itold you I wanted a free estimate for painting outside and inside my home. You came over, and give me a free estimatefor the cost for the jobs. I decided tohire you to do the removing and replacing the driveway, sidewalk andunderskirt. You came to my house on 9/4thto collect the half payment down $2750, and for me to sign the contract. The invoice/contract was handwritten with thescope for the driveway, sidewalk and underskirt included on it. The contract is the only document I receivedfrom you. I called Travis County PermitDepartment today 9/22nd, an Agent informed me that the only way tosubmit a request for a permit is on line. The Agent told me that no request for permits, payment nor applicationwithdrawal has been submitted for my address for this year 2015. It was not a few days later when I called youafter you notified me about having a survey, I called you the next day with myconcerns about a licensed contractor. *** you were the one who initiated cancelling the contract job, and Iagreed. I cannot show proof for ourtelephone conversation, but I do have your text message; where for the secondtime your cancelled the contract job. This is my proof of you forfeiting the contract. The invoice/contract I signed is for R ***Construction, the business card I received from you is R *** Construction; Imade the check out to *** Construction. At the time I signed my invoice/contract you did not mention your subcontractors. When you told me you could get one of yoursub-contractor to repair my driveway, I asked you why you did not tell me thiswhen I signed the contract; and you told me that you did not have to tellme. You have no legal claim to incurcharges on me. I want my refund of$

We met at the customers home to go over the project and accounting on 3/23/at which time they hired *** *** to oversee and manage the projectThe homeowners, Mrs***, and I came to the conclusion that the work that had been completed was $226,and payments to date were
$211,They made a check for the difference of $on this date to cover the unpaid balance for work completed to dateThe original bid for windows and doors was $which did not include window and door change ordersOf this $only $is for the windows. The work was terminated by both *** *** and I as we could not work togetherAs far as Mr & Mrs *** *** are concerned, the work that was completed was paid in full and the remainder of the work was left in the hands of *** *** as we they hired her to oversee and manage the workI have the documents that we went over that state that the work performed and the payments made were exactThere was not one dollar paid in advance for any further work. I believe that they hired *** *** to complete the work and since they had not advanced me with any money for the work needed to be done, she should perform the work she was hired to do and provide them with someone that is willing to work with her to complete this work. Everyone was in agreement that the final check given was to bring Mr & Mrs *** current for the work performed

I was contacted by Ms*** in regards to removing and replacing her drivewayI sent my subcontractor out to look at the project and he met with the H/OI followed up the following week to verify the information given to me in regards to this projectI then proceeded to write up the scope of
work and presented it to Ms*** for approval and depositDuring the conversation with Ms*** at her residence I addressed the concerns and steps in which her project would take placeI notified her that I had reached out to Travis county and was told that two permits were needed in order to do the workI told Ms*** that I would submit the request for permit in the next few daysMs*** was not in a rush as she was expecting an Engineer to go out to her residence to inspect the foundationUpon submitting the request for permit, Travis County Permit Department requested a drawing or survey of the existing and proposed workI then turned to Ms*** to see if she had a survey of the property in order to expedite the processI did mention to her that if she did not have the document that I would take care of it on my endMs*** stated that she did not think she had the document I was requestingI then proceeded to draw up a site plan of the existing site and the proposed workA few days later I received a call from Ms*** stating that she had contacted someone and that she was told that my company was not licensed to do the work and that she felt that I should have mentioned that to her before she hired meI ended the call and immediately called the permit departmentThey mentioned to me that "anybody" could do the proposed work I was hired to do including the homeowner without a licenseI called Ms*** and stated to her that she was misinformedMs*** then stated that she no longer wanted me to do the work and requested a refundI told Ms*** that I would submit the required documentation to my office for a refund and that I would sign the release once the process was completedThe process includes researching any expenses my company may have incurred during the research and process of permittingThis includes man hours, expenses, drive time, ect...I have submitted the request since we last spoke and my office is in the process of completing the research on expenses for this projectI believe we should be compensated for the expenses incurred on this project as Ms*** was misinformed by others and never mislead by us. R *** Construction is a General Contracting company and we hire qualified sub contactorsMs*** supposedly inquired on the licenses obtained by R *** Construction but never inquired on the licenses by R ***'s subsMs*** will be refunded the fair amount after expenses have been deducted. We have not exceeded the time that is allowed by the State of Texas for refunds in this matterRegards,*** ***

I am rejecting this response because: The windows were never ordered but partial payment was made. Bids by other companies for the windows are greater than $100,000.

I am willing to purchase the windows and have the customer pay the manufacturer direct. As far as the work and the balance on that project we are even to date. I refuse to work with the person they hired to manage this project. I am willing to have the customer purchase the windows at my discounted price and I will install them for a stand alone contracted amount paid upon completion.
