Dear Revdex.com Dispute Resolution Department: Just a quick update re the basement finish project at [redacted] and [redacted] ’s residence We waited to respond to this complaint until the milestone of a county plumbing inspection had actually been accomplished with favorable resultsWe wanted it to be clear that there was resolution and that progress had not simply been discussed or scheduled Today a county inspector completed a plumbing inspection and the Arch Homes subcontractor’s work at that site was approved This meant that today, cement floor that had been broken out could be replaced and that work was begun Previously, the county had asked for additional information about the project that Arch Homes had provided and that also had been deemed as satisfactory and sufficient (This enabled today’s inspection to be put on the books for the county inspector to assess previously completed work.) Also, progress was previously made with framing of the new basement walls In short, progress has been made on the project and work at the [redacted] ’s residence is moving forward [redacted] , General ContractorArch Homes

Although safety and "doing the job right" is our focus, we are also glad that cities and counties provide cross-check protections for consumers in the form of the permitting processUnfortunately, providing the permitting authority that has jurisdiction over this consumer's property has slowed forward motion on this project In attempts to provide all information for the permit in the format preferred by this permitting body, we have hand-drawn the plans and done cross-section drawings Since we don't generally do new construction, a well-executed floor plan drawing via a software program showing what renovations we are proposing to do that are new and addressing/pointing out safety protections is fine for permits We are going out of our way with this permitting authority to provide the information requested in the format requested This is taking time because once information is provided, new information is requested and corrections are requested to some of what was provided For example, we use code-compliant building materials, specifically to make sure they complyBut in spite of providing the manufacturer and product (size) we proposed to use, we needed to go back and provide cross-section drawings of the product, etcWe can not move forward with our process with permits/approval/inspection and final inspections until the permitting authority is satisfied that they have all information they would like to seeWe recently told the customer that we were providing more information for this purpose We are updating the customer about how this is going Progress has been made but we do not have this information log-jam entirely resolved yetWe anticipate that this project can be completed in working/business days once the permitting body is satisfied that they have what they need

Complaint: [redacted] I am rejecting this response because:No attempt has been made by the business to contact me or to finish the contract We don't want to amend the contract to reduce the business commitment, we want the contract completed Business was notified by my attorney via email and by USPS mail on July 30th of intent to begin court action if contract was not completed within two weeks We still have not heard from the contractor at all Their response says they want to finish contract, but they have yet to take any action to that end or provide any indication of good faith If the business has not began work by the completion of the days allotted by my attorney, then on August 15th, I will move forward with court action Due to the contractor's history of default judgements, I will seek specific performance as my adjudicated remedy, additionally I will seek tortious damages for fraudulent misrepresentation preventing me from using portions of my home beyond the specified contract date Finally, I have began to prepare evidence to present to the Missouri Attorney General and the StLouis CoDistrict Attorney Office of criminal misappropriation by [redacted] and [redacted] in the allocation of funds by this company Due to this allegation of misappropriation, I have also began composing a motion of preliminary injunction against Arch Homes Contracting Incas well as Mr [redacted] and Ms [redacted] to prevent them from taking monies on any other project until either: my contract is completed to satisfaction and I lose standing in the case; or the termination of any criminal and/or civil litigation in this matter is completed I never wanted to go down this road I have always liked and respected Mr [redacted] as well as his employees, however I have to take measures to protect myself and my investment If the contract is completed in the time frame outlined by my attorney, I will end legal actions and withdraw my complaint Sincerely, [redacted]

This customer has changed the outcome desired in this complaint since sending it He no longer is desirous of contract completion Contractor and customer met after this submission and made decisions about what to do going forward Contractor also agrees that the working relationship is no longer productive and would like to sign addendumWe are in the process of wrapping up business with this consumer Some of the tasks in the proposal have been completed, but the consumer has decided he would not like to complete them all Our goal is to secure signatures of both parties on an addendum to the original proposal stating that the scope of the work will be smaller than was originally conceived We also will be getting together an itemization of the work done so far and its market value to settle up in a financially fair way for the consumer and our company

A resolution was immediately worked out verbally, but due to Christmas celebrations, the customer was not very available, the business was closed or preparing to close, and I was leaving the stateI did manage to get a revised agreement ready for customer signature, send to him for his comments, and speak to him very briefly before leavingThe agreement is not signed however, and I was unable to meet with him and provide refundNor apparently did he withdraw his complaintBut I don't expect him to do that until we revise the proposal and do a temporary refund as he is requestingSo as you can see from the letter below, we need to put this complaint on hold until I am back in town and can resume work on thisBecause there WILL BE NO COMPLAINT after he does what he said he wanted to do (withdraw it)Here it iscut/paste of prior email I had not heard back from Revdex.com about:

Arch Homes already was in touch with Revdex.com about thisI said that in spite of customer saying he doesn't want us to set foot on his property ever again, apparently that was said in a fit of angerbecause he does want us to finish his projectbut when the ground is dry and more weather is more condusiveHe and our general contractor reached a modified agreement
I sent him an amended proposal but like all our customers, he has been hard to reach this time of year and is apparently busy with Christmas celebrationsI emailed to set up an appointment to give Mr*** a $1,temporary refund, then he will re-pay us when work is done in springBut he emailed back after a delay saying that best way to reach him would be to callI did after sending amended proposalNo answer at that time and he hasn't returned my call yetWe are closed for the holiday but I was willing to meet with him today, Christmas eve, or on Christmas Day if it was important to him to do immediate refundI've just had mouth surgery and I look like someone hit me in the cheek with a baseballso I would prefer to put a hold on thisI am driving hours for the holidays the day after Christmas, so I won't even be here to do this refund for a whileIt was now or never for me before I leave town, but I can't reach ***I am saying this so Revdex.com will understand that I have been reaching out to the customer but I am seeing no option but to place response to this complaint on hold until we can get the new agreement accomplished

Dear Revdex.com rep.:I am pretty baffled about this complaintRichard, our GC, did answer it to say that our first choice is to complete the proposal agreement or modify it if need be, but I guess there's no need to post that answer. Because prior to his response, he had gotten a letter from
an attorney about this situation, so it was already out of Revdex.com's purview when Richard answered the Revdex.com complaintThe level of conversation now seems to need to be attorney to attorney, not customer to homeowner with Revdex.com assistance. Our attorney has instructed us step out and let him handle it. --***Arch Homes Contracting***

As you probably know by now, Arch Homes office already has reached out to you directly.  After some phone calls going back and forth previously, perhaps the step we are ready for now or the "next step" may be to get our old proposal agreement replaced with an addendum agreement to modify that...

I will reiterate what was said in that email to the effect that as soon as we are able, we hope both you folks and our company can move forward into doing positive things. For you that might mean improving your home in ways you still want to improve it, making it nicer, more usable, and more profitable to sell. Or devoting time to your work and family. For  the company, that would mean putting all our attention on the numerous things we have to do to keep all of our active projects moving forward. Oh, and if you look and can't find the email that was sent, let the office know and we will re-send it.

I am rejecting this response because:
We had offered a previous repayment plan for Arch Homes in November and received no response.
We received Mr. [redacted]'s long rationalization. The bottom line is [redacted] on behalf of Arch Homes took our money and has not...

returned it. The onus is on Mr. [redacted] to present a repayment plan beyond our proposal. We are not at all comfortable with [redacted] coming back to our property. He has already displayed the actions of a person that is not honest and lacks integrity. It would not be prudent of us to risk having him back to our property when he has already been to our property and the result was him stealing $2,500.00 from us. If I do not get a reasonable and collateralized proposal from Mr. [redacted] in 10 business days we will proceed with a different course of action.

I am rejecting this response because:  We do not want to make an addendum to the contract. We just want a refund for the $7000 of checks that were cashed by [redacted] and [redacted] on June 16 without any work being done ($4500 basement and $2500 patio). We also want a release of lien for all subcontracted work, including the electrical of which we just received a NOTICE TO OWNER from the electrician who ARCH HOMES did NOT pay. We paid [redacted] $3600 for the whole complete electrical work, and have an itemized reciept from them showing that, even though all we received in work from them was an electrical rough in (please see attached reciept from [redacted]).

An update on work progress as of this date is that the electrical work is complete since it's inspection was passed.  Yes, the egress window is already installed.  The HVAC sub went by the [redacted]s residence to look at the project so he is currently working on a proposal for the job.  That is a first step. Once the proposal is finished and is accepted by GC and the County, work can then begin.  After that pro is able to wrap up his proposal, the project will be finished.

However we are still frustrated that the proposed completion date continues to be pushed back further and further. In an earlier Revdex.com response the business indicated the work would be complete 30 working days after the first inspection. That should have been August 16.  The business now has indicated the project will not be done by the end of September. We continue to be disappointed and frustrated.

I am rejecting this response because: While it is true that there have been problems with getting the inspection, the time frame is still ridiculous.  It is mid-June and the work needing to be inspected was completed in early March.  For the first couple of months the contractor did nothing to get this going.  It's only been in the last 2 weeks that the problems with the county inspection was even an issue.This past week some good progress was made with a different part of the project, but now we may well be right back in a "holding pattern," waiting for work that should have been completed some six weeks ago.
