I am rejecting this response because:
I have filed with the State Attorney General to research and investigate the builder for contract fraud. We initiated contract because we were told and reassured (they even spoke to our lender directly) that the community was FHA approved AT THE TIME OF CONTRACT. Shortly thereafter the design manager was fired. Several months later the Sales manager resigned. Several other contracts had fallen through due to what they called "financing issues" on the building across from ours that had just been completed. They broke ground on our strip of lots and gave an estimated arrival date of August. The contract clause for cancellation with a FHA loan under the federal guidelines was months after contract. That clause was exhausted way before the building was ever completedthey of course knew that it would be and we would have little recourseThey completed the lot around the time they had estimated however; prior to final walkthroughs we discovered that not only were they NOT FHA approved, they could not close our loan because they had not even started the FHA approval application and were not eligible for approval because they did not meet FHA community occupancy guidelines. We lost our funding and ultimately had no where to live because we had waited almost a year and a half for them to build the lot. We had put in notice where we were living and had moved out that month for my daughter to start school in the right district in September. I was pregnant so this was all very devastating and had a large impact on my family.
I firmly believe that they accepted our deposit acknowledging that our loan type was an FHA loan for which they knew they could not close on. They frequently (I have emails) attempted to get us in touch with other lenders (which worked for them) to select a mainstream loan with 5% down instead of the FHA's 3%. They KNEW WHAT THEY WERE DOINGWe specifically asked this question at the beginning of our contract and it was made part of our contract that we were an FHA loan. These people are deceptive and we are not the first family they have done this to

I am rejecting this response because while the builder has finally responded to my numerous inquiries dating back to January 2013, the builder has yet to address any of the items within this complaint, nor my complaint of 2012-2013 of which they did not respond.   I have given the builder sufficient time to address our issues and am willing to give the builder the further time they need provided they state an exact date when the items will be addressed and the exact manner (fixes) in which they will be addressed, provided the date and fix is mutually agreed upon by the builder and myself.  This complaint should not be closed until the builder has properly addressed each of the previously outlined issues.

The purchasers of [redacted] Lot [redacted] are writing to receive a response from the builder whether we (seller and purchaser) “disagree” as defined by Section VII of the builder’s Warranty Certificate. The purchaser has made repeated written attempts to contact the builder regarding the issues in the email thread of April 25, 2013 to present. Please see original email of April 25, 2013. Please also see pictures of cabinetry issues sent within previous emails (copies available upon request). A summary of written attempts is listed below.

NO ELEVEN-MONTH WARRANTY SERVICE

It is noted that purchaser did not receive the opportunity for a pre-drywall walkthrough nor a Warranty Service Checkup at eleven months. Purchaser’s Warranty Checkup at 90 days still has not remedied the majority of items on that list. The purchaser has made repeated attempts to contact the Warranty Service Department about these issues. The Basheer/Edgemoore-Moutoux, LLC Warranty Certificate provides in part:

Section III (2): You will be invited to make two Warranty Service Checkup of your home with us, approximately ninety days and eleven months after settlement, to determine the existence of any defects covered by this Warranty. [emphasis added]

Section V (1): Our Warranty Service Department will contact you about ninety days after settlement to schedule a Warranty Service Checkup of your new home to determine whether there are any defects in the home covered by the Warranty. During this Warranty Service Checkup, a list is usually prepared and signed by you and us. We will correct any defects so identified as soon as practible, weather permitting. If you and we disagree as to whether an item is defective or is covered by this Warranty, the disagreement will be resolved as describes in Section VII. [emphasis added]

PURCHASER’S GOOD FAITH GESTURE

If the builder requires more time to remedy the issues presented, the builder must state so within fifteen days of this letter. This statement from the builder must specify what steps will be taken to correct the issues presented and provide a reasonable timeline of when the issues will be corrected. This option is a good faith gesture by the purchaser in order to amicably work toward a resolution.

Additionally, a Warranty Service Checkup (eleven month checkup) must be provided to the purchaser at a date and time convenient to the purchaser and builder in which defects noted will attach to this request.

ARBITRATION

If the builder does not acknowledge this letter within the time specified or states disagreement then the purchaser will proceed toward arbitration as specified in the Warranty Certificate, which states in part:

Section VII (1): If we and you fail to agree on the existence of a defect covered by this Warranty, or fail to agree as to the sufficiency of the correction or repair of a defect, you will provide us, within twenty-one days after the date of disagreement arises, with a written statement setting forth your position regarding the disagreement and describing in detail the action you are requesting us to take. Failure to provide such written notice timely, waives any claims relating to the component or defect that is subject of the disagreement.

Section VII (2): Within fifteen days after receipt of timely written notice, we will respond to you in writing and state what action, if any, we will take to resolve the disagreement. If we do not respond to you within fifteen days, this constitutes a denial of responsibility for the component or defect that is subject of the disagreement.

Section VII (3): If you are dissatisfied with our response, or if we fail to respond within fifteen days after receipt of the notice, your sole recourse shall to be to file a Request for Arbitration with the American Arbitration Association (“AAA”) with a copy to us. The Request for Arbitration shall set forth your position concerning the disagreement and shall specify the action you are requesting us to take. Any correspondence between you and us relating to the disagreement and a copy of this Warranty shall be attached to the Request for Arbitration. [emphasis added]

OMISSIONS AND COMPENSATION

Also note that within the Agreement of Purchase and Sale Dated April 21, 2012, Section 4 (c) provides that:

It is understood that Purchaser is purchasing a complete dwelling, and that Seller is not acting as a contractor for Purchaser in the construction of the dwelling unit…[I]t is specifically understood that the Seller shall exercise reasonable care to see that all work and options are performed; however, Purchaser and Seller hereby agree that the Seller’s sole responsibility for omission of any work, options or design features shall be limited to the deduction from the Purchase Price of the amount of such option, or the cost as determined by the Seller of such option, feature, material or finish, or in the case of partial omission, the fair market value of such partial installed or provided option as determined by Seller.

Finally note that Section 25 (d) of the Agreement provides that:

In the event that any party files any litigation, lawsuit or legal proceeding to enforce any of the specific terms and condition of this Agreement, the prevailing party in any such legal proceeding shall be entitled to an award of all reasonable attorney’s fees and costs incurred by such party in the litigation.

Review: Code violation during building construction causing water damage to building structure. When contacting business manager [redacted] avoided issue. When contacted the contractor that they hired [redacted] Plumbing and [redacted] electric they stated it must go thru the builder Basheer and Edgemoore. Pictures taken to show them what they had done and temporary repair done. When contact Revdex.com, the business [redacted] replied "we are in receipt of the above referenced claim (copy attached) and have been in contact with the claimant. We will continue our discussion with the claimant" dated Aug. 16th this is a lie to Revdex.com, still no one has contacted me or offer to address or fix the problem. It has been almost three months since the incident still my little children and family living in this unsafe environment still no fix.Desired Settlement: fix the problem!!
