If there are issues with the technician not completing the job, another technician can be scheduled, however, the part needs to be secured from [redacted]. Limitations of Liability:4. We are not responsible for the repair of any cosmetic defects or performance of routine maintenance.8. We are not liable for repair of conditions caused by chemical or sedimentary build up, rust or corrosion, mildew, mold, misuse or abuse, failure to clean or maintain as specified by the equipment manufacturer, missing parts, structural changes, fire, freezing, electrical failure or surge, water damage, lightening, mud, earthquake, soil movement, soil settlement, settling of home, storms, accidents, pest damage, acts of God, or failure due to excessive or inadequate water pressure.12. We are not liable for normal or routine maintenance. We will not pay for repairs or failures that result from the Contract holder’s failure to perform normal or routine maintenance. CANCELLATIONThis is a maintenance agreement for repair, replacement, or partial replacement of the products listed that are deemed manufactured or sold by the manufacturer. This is not a contract of insurance, residential service, warranty, extended warranty, or implied warranty.  You may cancel within the first 30 days of the order date for a refund of the paid contract fees, less a $50 administrative fee and any service costs incurred by Us. This contract shall be non-cancelable by Us except for:1. Nonpayment of contract fees;2. Nonpayment of Service Fee, as stated in Section III;3. Fraud or misrepresentation of facts material by You to the issuance of this contract;4. Mutual agreement of Us and You. seriously.  Choice Home Warranty provides home warranty service coverage on the systems and appliances listed as INCLUDED’ under the terms of the User Agreement sent to you at purchase.  It may also be found on our web site at [redacted] Upon review of your policy that began on 4/10/16, we do see that you had attempted to place 2 claims prior to the policy start date for your Electrical System.  Per our policy, Section A. Coverage #3 states that all units must be in proper working order on the start date of the policy.  CHW provides you 30 days before the start date to make sure that all units are working properly, also to review the terms and conditions.  If you do not agree before the 30 days are up, you are able to cancel with a full refund. However, if you cancel after the 30 days, you are subject to the terms and conditions stated in Section L. Cancellations. The claim for the washer had failures such as: a drain pump failure and a level sensor failure. This unit is 8 years old and that is from the serial number off of the unit.  Per our policy, Section F. Limitations of Liability #1 states that CHW does not cover failures that are a result of any known or unknown pre-existing conditions. The issues with the washer are failures that cannot happen within the amount of time that you had the policy.  You stated to our Supervisor that the unit had an issue prior to the start date with the door as well.  Again, this would be a pre-existing issue that would not be covered under our policy. CHW provided you with a welcome packet the day you signed up with our company, this packet had the terms and conditions that we require of all units and appliances coming into the policy.  You can also access this through the customer account center if you did not receive the packet in the mail or email that we sent.  We follow the guidelines of the policy and expect all customers to do so as well. We see that you have chosen to cancel the policy with us and per your request we did so.  Since you did not pay for the policy in yearly increments and chose monthly, you paid for the policy as the months went and therefore we do not owe you a refund.  Choice Home Warranty provides home warranty service coverage on the systems and appliances listed as ‘INCLUDED’ under the terms of the User Agreement sent to you at purchase.  It may also be found on our web site at http://www.choicehomewarranty.com/user_agreement.php .  Upon review of your policy, I do see that you chose to sign up for a one year service.  This is not a requirement that we have; you can view all of the payment options for having a warranty with us on our website.  There are monthly customers that have a policy with us on a monthly basis; you are not required to pay for a year or more in advance.  Also, you are free to cancel the policy whenever you would like, you would be bound to our agreement as stated below.  If you have had any claims covered, you would pay them back plus an administration fee of $50.00.  Your refund would be processed accordingly. I have read the claims that you had placed and all the claims that you had placed, were under the excluded portion of our policy:Claim # [redacted] – there was a leak in your home and there were galvanized piping that needed to be replaced.  Our policy states, “D. COVERAGE # 8. PLUMBING SYSTEM – Excluded”…galvanized piping…”.Claim # [redacted] your refrigerator- you closed this claim and stated it was working-no tech sentClaim # [redacted]Electriacl System- outlets not working. Circuit breaker- technician stated that there needs to do a wire tracing. Our policy states, Section D. COVERAGE #7- EXCLUDED “…WIRE TRACING.”We do apologize that you are unhappy with our policy and if you do not want to be a part of CHW, you are not obligated to be.  Please follow the policy below as I stated and you will be able to cancel.L. Dear [redacted],Per the policy, Section Letter F. #19 states that CHW is not responsible for the technician’s negligence.  We did review the previous claim and it did not state that the technician replaced your pump, it stated that “the housing of the pump needed a drain plug and an “O” Ring”.  CHW did authorize this repair for you and did have [redacted] complete the repair.If you feel as though that company did something to the motor to make it break in any way, we do ask that you contact the company who is responsible, the number is [redacted].In reference to the service call fee that the last technician did receive; this fee is due for any claim that a technician goes out to unless it is within 30 days of the prior claim.  As a goodwill gesture we have added a onetime free service call fee to your policy but please keep in mind that you will have to pay for each service call no matter if it is covered claim or not.We do hope that you get this resolved as quickly as possible.Regards,CHW

Warranty provides home warranty service coverage on the systems and appliances listed as INCLUDED’ under the terms of the User Agreement sent to you at purchase.  It may also be found on our web site at[redacted]Upon review of your claim, we do see that the technician that came to your home first did explain to us that the failure was the compressor as well as the cooling fan motor.  He did state that the CFM failed causing the compressor to fail as well.  CHW at that time agreed to pay for the CFM to be replaced however we did not agree to pay for the compressor due to the shape that it was in and that it failed because of another failure.  Once you provided the second opinion, it was clear that the CFM was working however the compressor was shorted and not working at all.  The technician explained that the compressor was not working and it was in bad shape, this was a lack of proper maintenance.  We did advise you per our policy, Section F. Limitations of Liability #12 that CHW does not provide coverage for units that lack proper routine maintenance.We do see that we did offer a goodwill gesture to you in the amount of $400 which you declined and our Customer Advocate had offered you the amount of $550 to assist with the claim.Please feel free to contact her if she hasn’t contacted you by now.  Her email is [redacted]

Warranty provides home warranty service coverage on the systems and appliances listed as ‘INCLUDED’ under the terms of the User Agreement sent to you at purchase.  It may also be found on our web site at http://www.choicehomewarranty.com/user_agreement.php .  Upon review of your claims, it shows that you had the units replaced and then called CHW to place a claim, you requested a reimbursement form from us.  The invoice that you sent to us states that the units were in fact replaced before the claims were entered.  Per our policy CHW will not authorize any repair or replacement without prior approval. Please see Section C. SERVICE CALLS 3. We has the sole and absolute right to select the Service Provider to perform the service; and We will not reimburse for services performed without prior approval.Our customer service manager was offering you a goodwill towards the units since we could not approve the claims being that they were replaced for over the amount that we would have paid, they were replaced without our approval and they were replaced without a technician stating that they had to be; CHW does not know if they could have been fixed or not.I am very sorry that you chose to cancel your policy with us and not accept the goodwill offer that we had offered prior to you cancelling.  Unfortunately, since you have cancelled the policy there would be nothing further that we could do for you.Respectfully,CHW

The diagnosis that was received by the technician was that there was pest damage. The front of the unit was full of eggs and cockroach droppings, which resulted in the failure of the boards. Section Letter F, Number 8 of the policy indicates that damages that are a result of pest issues aren’t covered. The photos that were provided were also reviewed in great detail internally by the CHW authorizations team.   We do regret your frustration; however CHW is in full compliance with the terms and conditions of our policy.   Regards, CHW

I am rejecting this response because: The product that they offered me was 1.6 ft.³ in the microwave that I have was 2.1 ft.³ those specifications are nowhere near equal and it's ridiculous that they even attempt to say the same.
The last time but I checked when somebody offers you a product that is 40% smaller than the one you currently have that does not seem to be the same to me

CHW regrets the issues that you have encountered with the technician that did not complete the repair in the correct manner. The CHW policy states in section Letter F, Number 19, “You agree that we are not liable for the negligence or other conduct of the Service Provider, nor are we an insurer of Service Provider’s performance. You also agree that we are not liable for consequential, incidental, indirect, secondary, or punitive damages. You expressly waive the right to all such damages”.  A review of the claim shows that CHW has offered to assist by providing a goodwill gesture in the amount of $500, which is also the cap for this type of repair which is indicated in section Letter E, Number 1 which states, “We will pay no more than $500 per contract term for access, diagnosis and repair and/or replacement”. You stated that the unit had not worked since 2/6/16, being that the policy started on 1/29/16 the failure is a multicomponent issue that could not happen within the timeframe of the policy start date.  This claim would be considered to be a non-covered claim due to it being pre-existing to the policy.  Per Section A. Coverage #3 it states that all units must come into the policy in proper working order, it also states in Section F. Limitations of Liability #1 that CHW does not cover any failures that are pre-existing to the policy.In reference to the second claim that you placed the same day, for your washer you stated that the unit was not working since 1/1/16, this is before the policy began therefore this was a non-covered claim also pre-existing to the policy start date of 1/29/16.We do regret your frustration with this policy; however CHW is in full compliance with our terms and conditions.Thank you,CHW

I am rejecting this response because:Please note that my microwave and oven is a combination unit that is operated by the same key pad (see below in attachment).   My unit it practically new and the EXACT same unit is presently being sold by Lowes at a discounted price of $3, 329.00.  As stated, in CHW response referring to their home service agreement Section Letter F, Number 19 has NO bearing on issues with my key pad.  What is “Secondary damage”?   According to CHW Contract warranty booklet Section Letter D Number 9 and 10 built in microwaves and oven including ALL components and parts are covered.   In addition, although I made SEVERAL requests for a written decision, CHW DID NOT forward me a written decision on my microwave until Monday, August 17, 2015 at 12:28pm (see below in attachment)  After, I wrote to the Revdex.com. In addition, CHW has NOT provided a written explanation for denying repair work to my air conditioner unit.As of today, CHW did refund me in the amount of $348.33, which is $91.67 short of my full refund.  I am requesting that the $91.67 be refunded immediately since CHW refused to live up to their written agreement.

I am rejecting this response because: My contract policy states the  administration fee is $25 not $50. If need be I can scan the contract agreement to you all where it states $25. Plus you all charge me a $60 service fee on my refund and it's suppose to be $45. My lawyer also said you all prorated my refund at what you all are charging now and It's suppose to be prorated at what I paid, which was $1125 for 3 years. Which is $31.25 a month, not $50 which you prorated my month of service with you all. The company has unprofessional and unsatisfactory business practices. I need a refund of $560.00 or my lawyer will be forced to take further actions. I have included a copy of the contract I was mailed.

Per our policy we do not cover failures due to power failures. Please see section F. Anticipated check release on or before 3/21/2018 and for Choice Home Warranty to provide notification of release of check.
