I did receive the offer $ from choice but this offer will not resolve my complaintThe $ they are offering is an amount they agreed to pay me prior to my complaint.When I cancelled my policies with them they decided to charge $for each cancellation, which I reject and resent at the same time because of their unethical behavior.My main complaint is that this company has been getting away with murder as far as their customers are concernedThey pick and choose which damage they will cover (very few), most cases they offer the minimum if and when they decide to coverThis is why I will accept the $they agreed to pay, prior to the complaint but I wish to continue with my complaint
*** *** ,You placed your claim in July and during this time, the technician advised us that the failures were due to a lack of proper maintenanceHe specifically stated that "Both air-conditioning evaporator coil's and blowers need to be pulled and cleaned, also that the housing was partially plugged." These issues contribute to a lack of proper routine maintenance. Please note that an inspection does not constitute as a maintenance since the inspector only will check to see if the unit is turning on or off, nothing elseWe do understand that you are not happy with the way that this claim ended however, you did not provide us with any type of records to show that maintenance was done to the unit nor did you provide us with a second opinion. Our prior reply to you was within the timeframe that you still had your policy, your policy has expired as of 8/28/16 and therefore our system will not allow us to provide you with a technician.As a good faith effort to assist with this non-covered claim, CHW is willing to send you a check in the amount of $which is half the cost of the paid policy. This check would be sent directly to you since the policy itself has been expired and in good faith we are trying to assist you with a claim that according to this technician would be a maintenance issue, which per Section F#is not covered.If you would like to accept our offer, please contact us and we will send you a form that we would request you to sign and once we receive the form back, a check will be mailed.We do apologize that you disagree with the terms and conditions of our policy and do hope that you accept this offer as it is our only way to assist with this policy and claim.Thank you,Tracy M.CHW

We do apologize if anyone at this company was rude to you in any way, I personally did not speak to you myself I do see that on 7/20/15, *** *** gave us a diagnosis that the unit was out of Freon and it has leaked out due to rust or corrosion on the systemAlso, due to the unit
being out of Freon the compressor had failedAlthough you may have had someone come to your home and check the unit, they should have noticed that the Freon levels were very low to the point that the compressor could fail.Upon review of your claim you stated that you did not speak to a supervisor or a manger and we do show that you had spoken to both You had spoken to Kyle who assisted you with explaining that we do not cover any failures due to a lack of proper maintenance and Ike who is also a manager of our authorization department who also advised you of the corrosion that was on your unit The claims outcome was not solely based upon pictures but from the technician’s diagnoses.Per our policy, Section FLimitations of Liability #states that CHW doesn’t cover failures that are due to rust or corrosion and Section F #states that we do not cover units that have failed due to a lack of proper maintenance.We will not be covering this claim as we had explained to you over the phone and in writing We regret any frustration with this claim and do see that we have assisted you in past claims in the amount of $in authorized claims Just as any other claim, if it is covered under our policy we would be happy to cover the unit, this claim is not and therefore we are not able to cover the cost.We urge all of our customers to read the policy that we have and if you have any questions, please feel free to contact us We do appreciate your feedback as this does help us with our customer service and service providersChoice Home Warranty was in full compliance with its terms & conditions.Best regards,CHW

I am rejecting this response because:the company did not directly respond to my complaints: 1) the policy fails to describe the definition of "built in"If I was told that my microwave that is built in in the cabinet does not fall into the "built in" category defined by the manufacturer (GE), I would not have selected the policy; 2) I examined all microwaves sold by GEIn all listed models, none of them are defined as "built in"It seems that the company plays a "built in" game to escape the actual responsibility for coverage of microwaveI did not check other brands

I am rejecting this response because: the resolution is unsatisfactory1) CHW has reassigned the job again to the original tech (this will make visits to my home) and still no resolutionI should add here that the tech did not show upAGAIN! You continue to send a tech who has not shown up as scheduled on separate occasions nowHe ignores both mine and CHW callsTherefore my system is NOT fixed and we still do not have a definitive diagnosisI asked CHW whether I could just have a tech of my choosing come and and be reimbursed for the cost as per my policy and today I was told "NoYou must have the issue fixed by the original tech we sent out, *** *** *** This is yet another instance where CHW is deviating from the terms outlined in the policy. 2) You will not merely "apologize" and give me a free service call for blatant discriminatory behavior that I have endured from your colleaguesThis matter, I assure you will be escalated through legal channels. At this point CHW either needs to dispatch a tech who is going to show up, or allow me to find a tech of my choosing and reimburse me for whatever amount I am charged.

I am rejecting this response because: I have contacted my bank twice regarding my refund and they are not showing it anywhereI contacted the visa department as well who looked into my old card to try and find anything from the refund you sentThey have yet to uncover any format of payment made to me from CHWAfter telling a rep that the card was cancelled he informed me I would receive a check from CHW within 7-business days from July 6th.

I am rejecting this response because: After speaking with two different service companies they both came to the conclusion that CHW is using bad practices to deny my claimBoth said that a control board can and will suddenly stop workingThey asked, me what kind of inspection did CHW do prior to offering me a policy and taking full payment, I told them noneThen they questioned how can they claim this is a pre-existing condition if an investigation of the appliance was never doneI also believe CHW falsely represents claims made by the services technicians to deny claimsI spoke with the technician who CHW sent and he told me they most likely would fine a reason to deny my claim and you would be suprised what they can come up withThe dishwasher is in great condition; has not been misused; and only needs a simple repair that is caused by wear and tear.
